Subject: Fullerton Earmark Repurposing
Dear Mr. Levitt:
As you know, the Safe, Accountable, Flexible, Efficient Transportation Equity Act: a Legacy for Users (SAFETEA-LU) transportation funding bill was signed into law in 2005. As part of SAFETEA-LU and a subsequent appropriations bill, the City of Fullerton (City) received two federal earmarks for the State College Boulevard Grade Separation Project, one (CA807) for $490,000 and another (CA531) for $12,818,881. The State College Boulevard Railroad Grade Separation Project was implemented by the City and was completed in 2018 with final closeout occurring in 2021. At the end of the project, there was an unused balance of approximately $1.121 million of the federal earmarks. Since the project close out, the Orange County Transportation Authority (OCTA) and the City have been working with the California Department of Transportation (Caltrans) to redirect the $1.121 million to street rehabilitation, through a federal earmark repurposing process.
In late 2024, OCTA received information from Caltrans that the Federal Highways Administration (FHWA) was considering earmark repurposing submissions which included the submission for remaining funding from the two State College Boulevard Grade Separation Project earmarks. On January 14, 2025, OCTA and the City received confirmation from Caltrans that the FHWA approved the joint OCTA and City request to redirect the funding to street rehabilitation improvements along State College Boulevard from Yorba Linda Boulevard to Lark Ellen Drive (Project).
OCTA would like to thank City staff for their commitment and joint efforts to repurpose these earmarks. The funding for the Project is now approved in the Federal Transportation Improvement Program in amendment #25-03 under ID ORA250303 and available for obligation.
Mr. Eric Levitt
