Planning Division - (714) 738-6559 - [email protected] CITY OF FULLERTON I 303 WEST COMMONWEALTH AVENUE I FULLERTON, CA 92832 Updated Oct. 2026

Once the Planning Division determines the property is a good candidate the owner will be encouraged to submit a completed application packet along with a non-refundable fee of $1,000 to the City of Fullerton.

Then after the package is reviewed city staff will set up a pre-contract inspection of the property. The pre-contract approval inspection is required under State law enabling the Mills Act Program. The pre-contract inspection will be only for the exterior of the property and the property owner must be present for this inspection. The purpose of the inspection is to ensure all pre-contract items have been completed and what can be included in the proposed ten year Rehabilitation/ Maintenance Plan.

After the pre-contract inspection, staff will prepare a report making a recommendation to the City Council regarding approval of the Mills Act Contract. Mills Act Contracts are presented to City Council at a regularly scheduled public meeting, typically in early December. The City Council is not required to approve all Mills Act contracts and may modify or reprioritize the Rehabilitation/ Maintenance Plan based on preservation priorities. The City Council's decision on the Mills Act Contract is final. When the total number of Mills Act Contracts approved reaches 50, the City Council shall be required to adopt a Resolution reauthorizing the program and specifying how many additional Mills Act Contracts will be considered.

After City Council approval of the Contract, the Planning dept. will arrange for the property owner to come to City Hall to execute the Historic Property Preservation Agreement Contract. The property owner will sign and notarize two copies of the Contract. Then the City Clerk will sign both copies and have them recorded at the Orange County Clerk Office. Once recorded the Planning Department will email confirmation to the property owner.
