PRIORITY POLICY STATEMENT
This item matches the following Priority Policy Statements:

Fiscal and Organizational Stability
Infrastructure and City Assets.

FISCAL IMPACT
The fiscal impact associated with the proposed Solid Waste Management Services Agreement with Republic Services is based on the rates set forth in Exhibit A Approved Rates, attached to the agreement. These rates establish the applicable maximum charges for services provided under the agreement and serve as the basis for the rates passed through to ratepayers.

Any rate adjustments during the contract term would be made in accordance with the terms and conditions of the agreement, including annual adjustments based on the applicable Urban Consumer Price Index (CPI-U), subject to the agreement's provisions.

The City would continue to oversee the agreement to ensure compliance with the approved rates, proper accounting of applicable City fees, and all contractual requirements.

DISCUSSION
Public Resources Code Chapter 13.1, commencing with Section 42652, (Senate Bill 1383 (2016)), established mandatory statewide organic waste recycling and food recovery requirements to reduce methane emissions in 2016. To meet these obligations, the City must implement compliant collection and processing programs, necessitating a new Solid Waste Handling Services Agreement.

Following the law’s implementation, and connection with efforts to comply, in early 2025, the City initiated an RFP process for a new franchise agreement to address new requirements. After responses were received from various proposers, on October 6, 2026 City Council selected Republic Services. The Public Resources Code requires City Council adopt a resolution approving the franchise agreement. The recommended resolution would approve the franchise agreement and authorize the Mayor to execute the agreement on behalf of City Council.
