Attorney Branham advised that requested changes from the previous months' meeting had been addressed.
Commissioner Gerling asked if there were any scenarios where an ADU can be built without a permit.
Attorney Branham advised that there are certain parameters that would only require a health check.
Staff Hoffman clarified that would be difficult and that would be a space in the existing house that is being used.
Chair Denier opened public hearing at 6:24pm.
Bonnie Rodriguez asked if a two-story ADU would be allowed in a neighborhood with only one- story homes.
Staff Hoffman advised yes, an ADU only has to meet setback and square footage requirements so if someone wanted to construct a two-story ADU in a one-story neighborhood, the law requires us to allow it It would, however, be an expensive project that could be too expensive for most builders.
Commissioner Jones questioned if there was any code that could prevent the above-mentioned situation.
Staff Hoffman advised that this is allowed by the State so the City cannot deny it.
