Planning Commission Meeting

GALT Thursday, February 13, 2025 6:00 p.m.
Commissioner Gerling called the meeting to order at 6:00 p.m. The Commissioners present were Denier, Jones, Gerling, Johnson, and Jackson
Staff members present: Interim Community Development Director Amie Mendes, Attorney Olivia Clark, Senior Planner Kristyn Bitz, and Associate Planner Stacy Schafer.
INFORMATION/CONSENT CALENDAR
A. SUBJECT: Election of Officers
RECOMMENDATION: Pursuant to Galt Municipal Code §2.70.060, election of a Planning Commission Chairman and Vice Chairman shall be conducted at the first regular meeting of the following year after January 1st..
ACTION: Commissioner Denier was nominated to Planning Commission Chair by Commissioner Gerling; approved unanimously. Commissioner Jones was nominated to Planning Commission Vice-Chair by Commissioner Gerling; approved unanimously.
B. SUBJECT: Minutes of the December 12, 2024, Regular Meeting.
RECOMMENDATION: The Planning Commission approve the minutes of the December 12, 2024, Regular Meeting.
ACTION: Vice-Chair Jones motioned to approve the minutes of the December 12, 2024 Regular Meeting. Commissioner Gerling seconded the motion. The motion was passed by Chair Denier, Vice-Chair Jones, and Commissioner Gerling.
C. SUBJECT: Minutes of the February 2025 Special Meeting.
RECOMMENDATION: The Planning Commission approve the minutes of the February 5, 2025, Special Meeting.
ACTION: Vice-Chair Jones motioned to approve the minutes of the February 5, 2025 Special Meeting. Commissioner Gerling seconded the motion. The motion was passed by Chair Denier, Vice-Chair Jones, Commissioner Gerling, Commissioner Johnson, and Commissioner Jackson.
PUBLIC HEARING:
A. SUBJECT: Tattoo Parlor Conditional Use Permit (CUP) at 812 C Street RECOMMENDATION: 1. Receive presentation; and 2. Open public hearing to receive comments; and 3. Upon closing the public hearing, recommend that the Planning Commission adopt a resolution approving a CUP at 812 C Street, Galt CA 95632.

CEOA: This project is exempt from the California Environmental Quality Act in accordance with State CEQA Guidelines, Section 15061 (b)(3) (Common Sense Exemption) of the State CEQA Guidelines (Chapter 3 of Division 6 of Title 14 of the California Code of Regulations).
ACTION: Commissioners Johnson and Jackson recused themselves because of business entity conflicts of interest due to close proximity to 812 C Street.

Chair Denier opened the public hearing.
John McFadyen read a letter from his wife in support of the business.
Chair Denier closed public hearing.
Applicant Raina Saldivar presented her business plan to the Commission.
Chair Denier opened the floor to Commissioners for questions and comments.
Vice-Chair Jones motioned to adopt a resolution approving a CUP at 812 C Street, Galt CA 95632.
Commissioner Gerling seconded the motion.
The motion was passed by Chair Denier, Vice-Chair Jones, and Commissioner Gerling.
B. SUBJECT: Housing Element Program Implementation
RECOMMENDATION: 1. Receive presentation; and 2. Open public hearing to receive comments; and 3. Upon closing the public hearing, recommend that the City Council introduce an ordinance amending Chapters 18.12 and 18.16 of the Galt Municipal Code, in accordance with the adopted 2021-2029 Housing Element Implementation Program HE-K.

C. SUBJECT: Ordinance Amending the City of Galt Municipal Code Regarding Accessory Dwelling Units and Junior Accessory Dwelling Units
RECOMMENDATION: 1. Receive presentation; and 2. Open public hearing to receive comments; and 3. Upon closing the public hearing, recommend that the Planning Commission find that the adoption of the proposed ordinance is statutorily exempt from review under the California Environmental Quality Act ("CEQA") under Public Resources Code section 21080.17; and that the Planning Commission adopt a resolution recommending that the City Council adopt the proposed ordinance, attached thereto as Exhibit "A".
CEOA: Under California Public Resources Code section 21080.17, CEQA does not apply to the adoption of an ordinance by a city or county implementing the provisions of Article 2 of Chapter 13 of Division 1 of Title 7 of the Government Code, which is California's ADU law and which also regulates JADUs, as defined by section 66313. Therefore, the adoption of the proposed ordinance is statutorily exempt from CEQA in that it implements state ADU law.
ACTION: Staff Schafer presented.
Staff Bitz provided additional examples.
Chair Denier opened the public hearing, and there being no public comment, closed the public hearing.
Chair Denier opened the floor to Commissioners for questions or comments.
Vice-Chair Jones motioned to recommend that the Planning Commission find that the adoption of the proposed ordinance is statutorily exempt from review under the California Environmental Quality Act ("CEQA") under Public Resources Code section 21080.17; and that the Planning Commission adopt a resolution recommending that the City Council adopt the proposed ordinance, attached thereto as Exhibit "A".
Commissioner Gerling seconded the motion.
The motion was passed by Chair Denier, Vice-Chair Jones, Commissioner Gerling, Commissioner Johnson, and Commissioner Jackson.
