• The Commission finds the following as to Lot 127:
• There are special circumstances applicable to the property, including size, shape, topography, location or surroundings, and because of such circumstances, the strict application of requirements of applicable setbacks would deprive the property of privileges generally enjoyed by other property in the vicinity and under identical zoning classification.
• The variance authorized does not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and in the same zoning district.
• The variance does not authorize a use that is not otherwise allowed in the zoning • The variance will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the premises in question. • All the applicable legislative requirements of Government Code Section 65906 are met.
• Therefore, pursuant to Galt Municipal Code section 18.68.140, the Commission grants a variance as to the setbacks on every side of Lot 127, leaving a minimum setback in every direction of at least three feet.
