Date: 8/13/2024

Subject: Approval of Amendment No. 2 for Quality Fence for the Caltrans Fencing Improvement Project. (Cost: $466,459.90) (Action Item)

OBJECTIVE

For the City Council to approve Amendment No. 2 to the construction agreement with Quality Fence Co. to implement Phase II of the Caltrans Fencing Improvement Project (CFIP).

BACKGROUND

In March 2023, the City Council approved a Cooperative Agreement with Caltrans, providing funding and for the City to install fencing, gates, rock slopes and gravel on unpaved slopes and narrow areas within the City and along certain underpasses of the 22 Freeway (SR-22) from Springdale Street to Garden Grove Boulevard (the “Project”). See Attachment 1 for maps of the locations (Phase I) included as part of the Cooperative Agreement. The Cooperative Agreement requires the State to reimburse the City in an amount not to exceed $1,000,000 to implement the Project. In December 2023, Quality Fence Co. was awarded a construction contract to execute the described scope and to date, Phase I is complete.

DISCUSSION

During Project implementation, the Garden Grove Police Department’s Special Resource Team (SRT) highlighted the effectiveness of deterrent fencing in preventing the rise of encampments within the City. Discussions with Caltrans emphasized the importance of fencing installation, leading Caltrans to authorize the removal of slope paving from Quality Fence Co.’s Phase I construction scope in exchange for an additional 1,000 linear footage of fencing and 20 access gates. The SRT also identified and shared with Caltrans additional locations throughout the City where fencing installations were needed. After months of discussions, on May 20, 2025, Caltrans sent the City a memorandum approving an additional Clean California allocation of $500,000 for further fencing installation.

Memorialized in the proposed Amendment No. 2 to the Cooperative Agreement (see Attachment 3) is the revised total amount from $1,000,000 to $1,500,000 for Phase II of the Project.

Quality Fence Co. submitted a cost proposal in the amount of $466,459.90 to implement Phase II of the Project, which is incorporated into the proposed Amendment No. 2 to the Quality Fence Co. contract (Attachment 4). Under Amendment No. 2, Quality Fence Co. will install fencing, gates, and galvanized vines and perform rock slope paving at the selected locations (see Attachment 2 for maps of Phase II fencing locations):

 LL-1: SR-22/Hoover
 LL-2: Yockey-Trask
 LL-3: SR-22/Magnolia
 LL-4: SR-22/Pedestrian Tunnel
 LL-5: SR-22/Brookhurst
 LL-6: SR-22/Taft and Euclid-Glenhaven
 LL-7: SR-22/Newhope
 LL-8: SR-22/Trask-Sorrell
 LL-9:SR-22/Harbor (Motel 6)

Quality Fence Co. has agreed to the change in their scope of work under the original contract to include these additional locations and improvements.

FINANCIAL IMPACT

Per the Cooperative Agreement with Caltrans, a hundred percent (100%) of the cost will be reimbursed by Caltrans in an amount not to exceed $1,500,000. Original allocation of $1,000,000 was increased by $500,000 per memorandum between the City and Caltrans dated May 20, 2024. Accordingly, an additional appropriation of $500,000 is requested to complete the Project.

RECOMMENDATION

It is recommended that the City Council:
 Authorize additional appropriation of $500,000 (GL: 242-711-1280-54006, JL:

GT1366000) per the Amendment to the Cooperative Agreement with Caltrans.  Authorize the City Manager to execute an Amendment to Quality Fence Co.’s construction contract in the amount of $466,459.90 for the Caltrans Fencing Improvement Project and make minor modifications, as appropriate, and execute any documents necessary to effectuate the contract on behalf of the City.
