INTER-DEPARTMENT MEMORANDUM
To:
Lisa L. Kim From: Chief El-Farra
Dept:
City Manager Dept: Police
Date: 8/13/2024
Subject: Approval to participate in the 2024-2025 Cannabis Tax Fund Grant Program. (Grant Amount: $200,000) (Action Item)
OBJECTIVE
To obtain City Council approval to participate in the Cannabis Tax Fund Grant Program through the California Highway Patrol (CHP). Through the proposed grant, the City is eligible to receive $200,000 in federal funds to implement DUI/CDL Checkpoints, selective DUI enforcement operations, and educational activities within the community.
BACKGROUND
With the passage of Proposition 64, the Control, Regulate, and Tax Adult Use of Marijuana Act (AUMA), California voters mandated the state set aside funding for the California Highway Patrol to award grants to local governments and qualified nonprofit organizations, as described in the Revenue and Taxation Code Section 34019(f)(3)(B). The Cannabis Tax Fund Grant Program marks an essential step toward reducing impaired driving crashes, increasing public awareness surrounding the dangers of impaired driving, and making California roadways a safer place to t ravel. The Garden Grove Police Department has applied for and been awarded similar grants since 1996.
DISCUSSION
The California Highway Patrol works closely with state and local agencies and other traffic safety stakeholders to actively address impaired driving. The CHP will consider various factors in determining specific needs for each grant cycle, including opportunities and projects best suited to prevent the loss of life, injuries, and property damage caused by driving under the influence of alcohol and/or drugs.
The purpose of the Cannabis Tax Fund Grant Program is to provide alternative funding sources to augment, but not supplant, current activities and programs. The CHP will allocate funds for the project categories by California COD of Regulati ons (CCR) sections 1890.05 through 1890.07, as determined by the CHP.
Item 310/2024
FINANCIAL IMPACT
The total amount for the fiscal year 2024 -2025 grant will be $200,000. There is no local matching requirement. The City is neither required, nor plans to hire additional personnel or incur additional expenses to participate in the grant program. The California State Controller’s Office appropriates the funding provided, and all grants are awarded on a competitive basis.
RECOMMENDATION
It is recommended that the City Council:
Authorize participation in the Cannabis Tax Fund Grant Program (CTFGP);
Accept CTFGP Grant Funds in the Amount of $200,000.00;
Authorize the Police Chief, Finance Director and Finance Deputy Director to execute the grant agreement on behalf of the City; and
Allocate these grant monies to fund Selective Traffic Enforcement Operations.
