RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GARDEN GROVE,
CALIFORNIA, ESTABLISHING AN UPDATED SCHEDULE OF PENALTIES FOR
PARKING VIOLATIONS
The City Council of the City of Garden Grove, California, hereby finds, determines, declares, and resolves as follows:
WHEREAS, violations of local and state regulations respecting the standing or parking of vehicles are subject only to civ il penalties and are governed by the civil administrative process found in California Vehicle Code sections 40200, et seq; and WHEREAS, pursuant to California Vehi cle Code section 40203.5, the parking violation fee schedule and late payment penalties must be establishe d by the governing body of the jurisdiction where the notice of violation is issued; and WHEREAS, municipalities may also enter equipment violations on notices of parking violations pursuant to California Vehicle Code section 40225(a) and process said violations in accordance with the civil adminis trative process found in California Vehicle Code section 40200, et seq.; and
WHEREAS, the City Council has reviewed the existing parking violation penalty schedule and now desires to approve an updated penalty schedule for parking violations in order to ensure continued compliance with state and local regulations and to maintain an effective parking violation deterrence program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CI TY OF GARDEN GROVE, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
SECTION 1. That the above reci tals are true and correct and are incorporated herein by reference.
SECTION 2. That parking violation penalti es for violations of the California Vehicle Code, Garden Grove Municipal C ode, and City Council Policies pertaining to parking regulations and vehicle equipment specifications are hereby amended and restated and are approved as set forth in Ex hibit “1,” entitled “Garden Grove Parking Violation Penalty Schedule,” which is atta ched hereto and incorporated by reference herein.
