Subject: Approval of a Purchase and Sale Agreement for the sale of the abandoned Water Well No. 93C located at 12281 W. Garden Grove Boulevard, Garden Grove, Assessor Parcel Number, APN No. 231-422-13. (Sale Amount: $51,000) (Action Item)
OBJECTIVE
For City Council to consider approval of a Purchase and Sale Agreement by and between the City of Garden Grove (the “City”) and Carlos Jimenez (the “Buyer”) for the sale of the abandoned Water Well No. 93C located at 12281 West Garden Grove Boulevard, Gard en Grove, Assessor Parcel Number, APN No. 231-422-13 (the “Site”), in the amount of $51,000.
BACKGROUND
The City’s Public Works Water Division determined that Water Well No. 93C is no longer in use, is no longer needed, and has been abandoned and capped. Since abandonment, the Site has experienced trespassing, vandalism, and numerous debris clean-ups. On July 25, 2023, the City Council declared the Site as “Exempt Surplus Property” pursuant to State of California Surplus Land Act. On August 10, 2023, the Department of Housing and Community Development confirmed that pursuant to the Surplus Land Act, the Site qualified as “Exempt Surplus Land” under Government Code section 54221, subdivision (f)(1)(B) (see attached letter).
DISCUSSION
The Site has been surveyed and appraised at $51,000. It contains an active , below grade City waterline. An easement will be reserved to allow the City access for future maintenance of the waterline and the capped well.
Under Government Code section 37350, the City is autho rized to dispose of real property.
The disposition will benefit the City by relieving the City of maintenance and security liabilities associated with the abandoned water well.
Approval of the Purchase and Sale Agreement will facilitate the opening of escrow, execution of all necessary documents, and the transfer of payment to the City and title to the Buyer.

FINANCIAL IMPACT
There is no impact to the General Fund. The proceeds from sale of the Site will generate $51,000 in revenue to the City’s Water Division.
RECOMMENDATION
It is recommended that the City Council:
Approve the Purchase and Sale Agreement for the sale of the former Water Well No. 93C Site located at 12281 West Garden Grove Boulevard, Garden Grove, Assessor Parcel Number, APN No. 231-422-13, for $51,000; and
Authorize the City Manager, or designee, to execute the Purchase and Sale Agreement, accept the water line easement, and any other documents necessary to effectuate the transaction, on behalf of the City.
