Subject: Adoption of a Resolution to accept Tobacco Law Enforcement Program Grant funds and authorization of Agreements for implementation of the Program. (Grant Amount: $735,990)(Action Item)
OBJECTIVE
For the City Council t o approve the Tobacco Grant Program Resolution, Memorandum of Understanding (MOU), and a Professional Services Agreement for the Tobacco Grant Program Cycle Fiscal Year 2024-25.
BACKGROUND
In June 2024, the City’s Code Enforcement Unit applied for a California Department of Justice (DOJ) grant program with funds authorized under the California Healthcare, Research and Prevention Tax Act of 2016. The DOJ grant program made available $28.5 million to local agencies in California to support various tobacco-related programs. These programs include support for local tobacco retailer enforcement and enforcement of flavored tobacco bans. The total amount awarded to the City of Garden Grove is $735,990 of which grant funds will be distributed incrementally over a four (4) year period from FY 24-25 through FY 28-29.
DISCUSSION
The City was last awarded Tobacco Grant Program funding for FY 21 -22 through FY 24-25, and the newly-awarded funds will continue our Local Tobacco Law Enforcement Program. This program is administered by the Code Enforcement Unit. A contracted Tobacco Enfo rcement Officer will be assigned to the City’s commercial areas to seek compliance through standard code enforcement action and compliance methods. The City will contract with Willdan Engineering to provide one enforcement officer to implement the program. The DOJ requires that the City Council approves a resolution accepting grant funds and authorizing the City Manager to execute a MOU with DOJ and a Professional Services Agreement with Willdan Engineering for a contract Tobacco Enforcement Officer.
Item 448/2024
FINANCIAL IMPACT
The DOJ grant program does not require match funding from the City. The expected yearly cost includes a full -time contractual Tobacco Enforcement Officer, operating expenses, and administrative costs. There is no impact to the City’s General Fund.
