Subject: Adoption of the Relocation Plan for the Single Family Household Residing at 12371 Harbor Boulevard, Garden Grove, CA 92840 (Cost: $131,000) (Action Item)
OBJECTIVE
For the City Council to consider adoption of the Relocation Plan prepared in connection with a single-family residence located at 12731 Harbor Boulevard, Garden Grove, CA 92840.
BACKGROUND
In July 2013, the City acquired the real property located at 12371 Harbor Boulevard, identified as Assessor’s Parcel No. 231 -451-40, with the intent of building a new fire station. At the time of purchase, the property was leased to an existing low-income household, and the City maintained the original lease terms and monthly rental amount. Due to the propert y’s deteriorating condition, the household will be permanently relocated, and the home will be demolished. The City retained Overland, Pacific & Cutler (“Consultant”), a division of TranSystems, to prepare a Relocation Plan and provide relocation assistance to the affected household in accordance with State regulations.
The California Relocation Assistance Law, Government Code Section 7260, et seq., and the implementing regulations in Title 25 of the California Code of Regulations Section 6000, et seq., are the State laws that govern relocation assistance and benefits (collectively referred to as “Relocation Law”). The Relocation Law requires preparation, public availability, and action by the legislative body on a Relocation Plan in the event of displacement. The City Council is vested with the authority to review and take action on relocation plans for the City.
DISCUSSION
On May 28, 2024, the City authorized the Consultant to initiate the relocation process. The Relocation Plan was prepared based on interviews with the impacted househ old utilizing a survey method to collect information on household size and composition, gross household income, current housing costs, relocation area preferences, and other special needs. On Item 466/2024
September 30, 2024, the draft Relocation Plan was made available for the required 30-day review period, allowing the household to provide comments, which were then incorporated into the final Relocation Plan.
Following City Council approval, the impacted household will not be required to move without receiving at least 90-days advance written notice from the City. During this period, the eligible displaced household will receive relocation assistance and benefits pursuant to Relocation Law, with the following provisions:
1. Comprehensive relocation advisory assistance will be provided, including in-person oral, and written communication in the language most easily unde rstood by the displaced household;
2. Adequately inform household of the relocation assistance benefits, polices, practices, and procedures, including grievance procedure;
3. Provide fair and reasonable relocation payments;
4. Provide the services offered in the City’s relocation assistance program, and
5. Provide orderly, timely, and efficient relocation to comparable replacement ho using without regard to race, color, religion, sex, marital status, or national origin with minimum hardship.
FINANCIAL IMPACT
The relocation costs are estimated to be $131,000, and will be absorbed by the department's existing budget. No additional appropriation is deemed necessary currently. Overall General Fund budget will be evaluated during mid -year review, and adjustments would be made if needed.
