Subject: Approval of a request from Edgemoor Infrastructure and Real Estate to modify construction hours and exemption from Noise Control Ordinance, Municipal Code Section 8.47.040 and 8.47.060, to accommodate construction activities for the Civic Center Revitalization Project. (Action Item)
OBJECTIVE
To transmit a written request on behalf of Edgemoor Infrastructure and Real Estate (Edgemoor), requesting approval to be exempt from Noise Control Ordinance, Municipal Code Section 8.47.040 and 8.47.060 to accommodate construction activities for the Civic Center Revitalization Project.
BACKGROUND
In May 2024, the City initiated the Civic Center Revitalization Project, which is divided into two phases. Phase I involves constructing a new public safety facility and parking structure.
Phase II includes demolishing the existing Garden Grove Police Department to make way for a new 3.7-acre park. Completion of Phase I is estimated to be Fall 2026 and Phase II completion is estimated to be Fall 2027.
DISCUSSION
On Tuesday, December 3, 2024, the City received a written request from Edgemoor to extend construction operating hours and move the starting work hours from 7 a.m. to 4 a.m. and to deviate from ambient noise levels outlined in Section 8.47.040 of the Municipal Code during the extended construction operating hours. This request is to allow noise generating activities to begin at 4:00 a.m. instead of 7:00 a.m. for a limited number of days each year to accommodate essential construction activities, ensuring crew members have adequate time to complete their tasks. The project team will provide a 48-hour notice to the City before the requested early start days. Please refer to Table 1 on the following page for the exact number of days requested per year.

Table 1
Year Exemption Days
2024 2
2025 30
2026 15
2027 15
To minimize the impact to the residential neighborhood in the Civic Center Revitalization Project vicinity, the project team will utilize white noise backup alarms on all equipment and trucks to reduce noise activity. Additionally, the project team will continue to research opportunities to reduce the need for early start days, if feasible. This request requires an exemption from Municipal Code Sections 8.47.040 and 8.47.060. Granting this exemption will enable the Civic Center Revitalization Project to proceed more efficiently by meeting critical milestones and stay on schedule.
FINANCIAL IMPACT
Approval of this request will not have a financial impact on the City.
RECOMMENDATION
It is recommended that the City Council:
Approve a written request from Edgemoor, to extend construction hours and exceed ambient noise levels for a certain amount of days per year, exempting the Civic Center Revitalization Project from Noise Control Ordinance, Municipal Code Section 8.47.040 and 8.47.060 to accommodate construction activities.
