Date: 3/25/2025
Subject: Consideration of a written request from the Christ Cathedral Parish, Diocese of Orange, to extend the operating hours and make an exemption to the City’s Noise Ordinance for three separate events scheduled at the Christ Cathedral property in 2025. (Action Item)
OBJECTIVE
To transmit a written request on behalf of the Christ Cathedral Parish, Diocese of Orange, to request approval to extend the operating hours and make an exemption to the City’s Noise Ordinance, Municipal Code Section 8.47.040, to extend the high er noise levels from 10:00 p.m. to 11:00 p.m. for three separate events scheduled at the Christ Cathedral property.
BACKGROUND
Over the years, the Diocese of Orange has organized events and conferences on their private property. The annual event, “Marian Days”, has been held since 2021 and draws Vietnamese faithful from Orange County, Los Angeles, San Diego, San Bernardino, and San Jose. In 2023 and 2024, the event welcomed approximately 20,000 attendees over two days, including a significant presence of out-of-state and international visitors.
DISCUSSION
Staff received a request from the Diocese of Orange, who will be organizing the annual Marian Days at the Christ Cathedral on July 11 and 12, 2025, as well as two conferences that will be held on October 17 and 18, 2025 and November 14 and 15, 2025. The Diocese of Orange would like to request to extend the operating hours from 10:00 p.m. to 11:00 p.m. for these three (3) events that will be held at the Christ Cathedral property. Additionally, this request would also require the approval to make an exemption (per Garden Grove Municipal Code Section 8.47.040) to the hours listed in the Noise Ordinance establishing lower noise thresholds after 10:00 p.m.
4 Item 97/2025
FINANCIAL IMPACT
Approval of this request will not have a financial impact to the City. The Police Department will be reimbursed for all personnel services provided during these events.
RECOMMENDATION
It is recommended that the City Council:
Consider the written request on behalf of the Christ Cathedral Parish, Diocese of Orange, to extend the operating hours and make an exemption to the City’s Noise Ordinance, from 10:00 p.m . to 11:00 p.m. for three separate events scheduled at the Christ Cathedral property on July 11-12, 2025; October 17- 18, 2025; and November 14-15, 2025.

Mayor, City of Garden Grove

Re: Request to extend operating hours
Dear Mayor Jones,
I hope this letter finds you in good health and spirits.
As previously discussed, the Diocese of Orange has been diligently organizing the annual “Marian Day” event since 2021. This cherished celebration, drawing Vietnamese faithful from Orange County, Los Angeles, San Diego, San Bernardino, and San Jose, has experienced remarkable growth over the years. In 2023 and 2024, we were blessed to welcome approximately 20,000 attendees over two days, including a significant presence of out-of-state and international visitors.
This year, we are excited to announce that Marian Days will be held on Friday, July 11, commencing at 5:30 PM, featuring a captivating keynote speaker, a solemn mass, and delightful entertainment. The festivities will continue on Saturday, July 12, starting at 8:00 AM with mass, adoration, engaging workshops, a joyous procession, a closing mass, and further entertainment. Given the event's increasing popularity and the heightened demand from our faithful attendees, we kindly request an extension of operating hours until 11:00 PM, along with an adjustment to the amplified sound curfew. This extension will afford our attendees more time to relish the diverse culinary offerings at our food booths and immerse themselves in the rich cultural entertainment. While it is worth mentioning that our permit previously restricted operations until 10PM, the overwhelming response from the community necessitates this adjustment to ensure the continued success of Marian Days. We are grateful to you for granting the last year request and looking forward to it this year.
Furthermore, we would like to ask the same permission for two more conferences on Friday and Saturdays, October 17 & 18, 2025, and November 14 & 15, 2025.
We eagerly await your thoughtful consideration of this request and are open to addressing any inquiries or suggestions to ensure the seamless compliance and success of Marian Days and other conferences. I am happy to be reached at 714-620-7872, or [email protected], should you require additional information. May God bless you always!
Respectfully yours,
Very Reverend Bao Thai
Rector

Date: 3/25/2025
Subject: Acceptance of an Irrevocable Offer of Dedication granting an easement for public right-of-way for street and highway purposes for the property located at 13522 Yockey Street, Garden Grove. (Action Item)
OBJECTIVE
For City Council to accept an Irrevocable Offer of Dedication (“IOD”) granting an easement for public right-of-way for street and highway purposes for a portion of the real property located at 13522 Yockey Street, Garden Grove, owned by Hung Van Tran and Mau Thi Vo (“Owners”).
BACKGROUND
The property is located at the southeast corner of Trask Avenue and Yockey Street. Initially, the City reached out to the Owners to inquire about the future plans for the landscaping that is overgrowing into the public right -of-way. As a result, di scussion ensued between the City and Owners regarding their interest in improving their property and the City’s future improvement plans for Yockey Street and its intersection with Trask Avenue. The Owners inquired about the City’s plans to install an additional driveway approach along Yockey Street and if a driveway approach could be installed along Trask Avenue as well to provide additional access to their property. The Owners were informed that the City could work with them on the installation of a second driveway approach along Yockey Street, however, the Trask Avenue driveway approach would require site plan approval. In an effort to assist the City in their future project, the Owners decided to dedicate 10 feet along Yockey Street for an ultimate half-width road right-of-way of 30 feet and a corner cutoff at Trask Avenue ( Attachment 2 - Exhibit B).
After recordation of this transaction and the relocation of the Southern California Edison pole from the travel way of Yockey Street, the City will be able to construct the public street improvements fronting the subject property, which includes asphalt pavement and concrete curb, gutter, sidewalk and curb ramps.
12 Item 96/2025
DISCUSSION
The Owners have signed an IOD and an Acknowledgment of Donations, donating approximately 1,685 square feet of right-of-way along the western side of their property to the City.
FINANCIAL IMPACT
There is no financial impact to accept the easement for public street and highway purposes for a portion of the property located at 13522 Yockey Street, Garden Grove.
RECOMMENDATION
It is recommended that the City Council:
Approve and accept the easement for public street and highway purposes for a portion of the property located at 13522 Yockey Street, Garden Grove; and
Authorize the City Clerk to accept the offer of a grant easement by Irrevocable Offer of Dedication on behalf of the City.

Subject: Approval of an Amendment to the agreement with CT&T Concrete Paving, Inc. for concrete construction services. (Cost: $90,000)(Action Item)
OBJECTIVE
For the City Council to approve an amendment increasing the current contract price by 10% ($90,000) to cover the remaining concrete repairs needed for completion of slurry projects.
BACKGROUND
The City of Garden Grove currently has an agreement with CT&T Concrete Paving, Inc. for concrete repair services. The original contract, previously approved by the City Council, is set at $900,000. The contract includes provisions for optional renewal years, which allow s the City to extend the agreement based on performance and available budget.
DISCUSSION
Due to an increase in concrete repair prices and the volume of repairs needed across the city, staff recommends amending the contract to accommodate additional work. Specifically, staff is requesting a 10% increase to the existing contract amount for the remainder of the contract term ending on June 30, 2025. This adjustment will allow for the completion of additional repair projects identified during the fiscal year.
FINANCIAL IMPACT
There is no impact to the General Fund. The proposed contract increase of 10% will bring the contract to a new total of $990,000 for the remaining of the existing term, which expires on June 30, 2025. No additional appropriation is needed for the proposed contract amendment as f unding for th e increase will be covered by the existing Public Works Department ’s operating budget.

INTER-DEPARTMENT MEMORANDUM
To:
Lisa L. Kim From: William E. Murray
Dept:
City Manager Dept: Public Works
Date: 3/25/2025
Subject: Approval of a Cost Sharing Agreement and Introduction and First Reading of an Ordinance updating the Cross-Connection Control Program, entitled:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GARDEN GROVE AMENDING SECTION 14.20.020 OF CHAPTER 14.20 OF T ITLE 14 OF THE
GARDEN GROVE MUNICIPAL CODE PERTAINING TO THE CROSS -CONNECTION CONTROL PROGRAM. (Action item)
OBJECTIVE
For the City Council to introduce and pass to second reading an ordinance updating the City’s Cross-Connection Control Program and approve the cost sharing agreement.
BACKGROUND
On December 19, 2023, the State Water Board adopted the Cross-Connection Control Policy Handbook (CCCPH). The CCCPH became effective July 1, 2024, replacing Title 17 of the California Code of Regulations, t he original regulations governing cross connection control.
The purpose of the CCCPH is to protect public health through the establishment of standards to protect the public water system’s potable distribution system through the prevention of any potential backflow or back -siphonage of water from end -user sources back into the potable distribution system. The City falls under the CCCPH definition of a “community water system” and is subject to the CCCPH requirements.
DISCUSSION
The CCCPH is designed to offer greater technical details and explanatory language. All public water systems must implement the CCCPH and develop a Cross-Connection Control Plan by July 1, 2025. The City is currently entering into a cost sharing agreement among other Orange County agencies to retain consultant services to conduct a hazard assessment and development of the Cross-Connection Control Plan. The other agencies involved in this joint effort include Irvine Ranch Water District, City of Anaheim, City of Brea, City of Buena Park, City of Fountain Valley, City of Fullerton, City of Huntington Beach, City of Newport Beach, City of San Clemente, City of Santa Ana, City of Seal Beach, City of Tustin, City of 60 Item 90/2025
Westminster, El Toro Water District, Laguna Beach County Water District, Me sa Water District, Moulton Niguel Water District, Santa Margarita Water District, South Coast Water District, Trabuco Canyon Water District, Yorba Linda Water District and City of Orange.
Updating this ordinance will bring the City into compliance with this new regulation.
FINANCIAL IMPACT
The City's share of the project cost is $6,167.08. No additional appropriations are necessary as the cost will be absorbed from the existing Water utility operating budget.
RECOMMENDATION
It is recommended that the City Council:
Introduce and conduct the first reading of the ordinance updating the City’s Cross- Connection Control Program and pass it to second reading; and Authorize the City Manager, or designee, to execute the Cost Sharing Agreement for development of the template Cross-Connection Control Plan.

(Development of Template Cross-Connection Control Plan) This Development of Template Cross-Connection Control Plan Cost Sharing Agreement ("Agreement") is effective for each party as of the later date of the two signatures below ("Effective Date") and is between IRVINE RANCH WATER DISTRICT (" IRWD"), CITY OF
ANAHEIM, CITY OF BREA, CITY OF BUENA PARK, CITY OF FOUNTAIN VALLEY,
CITY OF FULLERTON, CITY OF GARDEN GROVE, CITY OF HUNTINGTON BEACH,
CITY OF NEWPORT BEACH, CITY OF SAN CLEMENTE, CITY OF SANTA ANA, CITY OF

WATER DISTRICT, TRABUCO CANYON WATER DISTRICT, YORBA LINDA WATER DISTRICT and CITY OF ORANGE . Each is referred to individually as a " Party," and collectively as the "Parties."
A. The California State Water Resources Control Board ("State Board"), which regulates all Public Water Systems ("PWSs") in California, requires PWSs to protect the public water supply by compliance with Title 17 of the California Code of Regulations. The State Board has adopted the Cross-Connection Control Policy Handbook ("Handbook"), effective July 1, 2024, to establish standards to which each PWS's drinking water distribution system will be subject regarding the backflow of liquids, gases, or other substances . The Handbook requires each PWS, no later than July 1, 2025, to prepare and submit a Control Plan that will describe how the PWS will fulfill the ten requirements identified in the Handbook. Each PWS in Orange County must submit its Control Plan to the Division of Drinking Water at the Santa Ana Regional Water Quality Control Board office for review and approval.
B. The Parties have determined that it will be to their joint advantage to collaborate to develop a template for a control plan (" Template Control Plan ") that may, with minor modifications, be adapted for use by each of the Parties. The Parties further agree that a qualified consultant with industry knowledge will be required to assist the Parties in developing the Template Control Plan (the "Work") . The Parties will schedule meetings that will be held approximately monthly with the selected consultant to adva nce the creation of the T emplate Control Plan.
C. The Parties intend by this Agreement to provide the framework under which they will share costs for the selected consultant's Work.
The Parties therefore agree as follows:
1. Contract for the Work . On behalf of all of the Parties, IRWD shall serve as the contracting agency and will request proposals from qualified consultants and ultimately select and enter into a Professional Services Agreement (“PSA”) with the successful proposer ("Consultant") to perform the Work. The selection will be made with the assistance of whichever other Parties volunteer to participate in the selection process. IRWD shall promptly pay all invoices submitted by the Consultant for the W ork. At the conclusion of the W ork and IRWD’s receipt of the Consultant’s final invoice, or by August 1, 2025, whichever occurs first, IRWD shall invoice each 62 2

of the Parties (including any additional parties hereafter added to this Agreement pursuant to Section 3, below) for their proportional share of the costs of the Work (as further described in Section 4, below).
2. Scope of Work. The Consultant will develop a specific scope for the Work, budget, and schedule necessary to produce a Template Control Plan that the Parties can adapt to meet requirements of the State Board as set forth in the Handbook. The Consultant will perform the Work on a time -and-materials basis for an estimated not -to-exceed amount of $180,000, which includes 20 percent for contingencies above the Consultant’s estimated costs of $150,000. These costs are subject to the cost-sharing provisions set forth in Section 4, below.
3. A dditional Parties . In addition to the Parties listed above, additional parties may be added to this Agreement, subject to all of the covenants, terms, and conditions of the Agreement .
Additional parties may join this Agreement at any time before completion of the Work upon written invitation by one or more of the original Parties, by executing the signature page and delivering an electronic version to all then- current Parties. Additional parties will be treated as original parties to this Agreement and equally share in the total cost of the Work, as described in Section 4, below.
4. C ost Sharing. The Parties shall share equally the cost of the Work . Each Party’s share of the cost will be determined by taking the total invoiced amount from Consultant for all completed Work and dividing that amount by the number of Parties at the conclusion of the Work.
At the conclusion of the Work, IRWD will invoice each Party for an equal share of the total cost of the Work. Each Party shall pay IRWD its equal share no later than 60 days after receiving the invoice. Upon the request of any Party, IRWD will provide copies of the Consultant's invoices and IRWD's payment records.
5. M eetings . IRWD shall coordinate all aspects of the Work with the selected Consultant. Any Party may participate in meetings with the Consultant to review interim and final results of the Work. IRWD will schedule meetings of the Parties to facilitate review of the Work, and will schedule meetings with the Consultant and the Parties at the reasonable request of any Party for the same purpose.
6. In demnity . Each Party shall indemnify, defend, and hold the other Parties, and their officers, agents, and employees harmless from any expense, liability, injury, loss, damage or expense to persons or property (collectively, “Claims”) that may arise or may be claimed to have arisen as a result of the development and approval of the Template Control Plan . Each Party's indemnity and defense obligations will not apply to any portion of a ny Claims determined by a court of competent jurisdiction to have been proximately caused by the negligence, gross negligence or willful misconduct of another Party, its officers, agents, or employees.
Notwithstanding the foregoing sentences in this section, each Party is solely responsible for its own costs and expenses associated with the indemnity and defense obligations set forth in this section, and such costs are not subject to cost sharing under this Agreement. This section shall survive the termination or expiration of this Agreement.

Subject: Proposal for Development of Template Cross-Connection Control Plan
Dear Ms. Hatch:
John Robinson Consulting, Inc. (JR Consulting) is pleased to submit this proposal to develop a Template Cross-Connection Control Plan (Template CCCP) for the Irvine Ranch Water District and fifteen other Public Water Systems (PWS) in the Orange County Area. We have been following the implementation schedule by the S tate Water Resources Control Board Division of Drinking Water (SWRCB DDW) for the Cross-Connection Control Policy Handbook (Handbook). We have already helped one Inland Empire agency develop a draft plan to meet the requirements of the Handbook, conducted one meeting with DDW staff and are awaiting comments from the DDW to complete the Handbook.
Our Familiarity with PWS and Regulatory Agencies - JR Consulting has worked with numerous agencies and agency representatives that could play a role in the development of the Template CCCP, including the Orange County Health Care Agency (Hasham “Sham” Elmishad), Santa Ana Regional Water Quality Control Board and SWRCB DDW (Oliver Pacifico). The JR Consulting team has helped numerous agencies prepare recycled water master plans, develop recycled water conversions plan s, and performed cross connection testing for multiple recycled water use sites throughout Southern California.
Unique combination of Public and Private Recycled Water Planning Experience - For this project we have assembled a Project Team of experts with over 70 years of combined public/private agency experience in potable and recycled water systems. Our Project Manager, John Robinson, who has over 30 years of experience in recycled water system will be joined by Mr. T homas Holliman, PE, who has over 40 years of experience in recycled water systems and has managed recycled water programs for the Irvine Ranch Water District and the Long Beach Water Department . Tom is our designated backflow prevention assembly tester and cross-connection control specialist.
Acknowledgements - John Robinson Consulting will function as the Prime Consultant, T.R. Holliman and Associates, Inc. will be a subconsultant. We have no conflict of interests issues working in with any of the PWS. JR Consulting carries all of the required insurance and will provide certificates of insurance when the contract is awarded. Further we take no exceptions to IRWD’s standard agreement included in the RFP. Finally, per the RFP, the budget proposal, including fee schedules and breakdown of the fee by task is being submitted separately from the project proposal
Should there be any questions, please feel free to contact me at (626) 375 -9389 or at [email protected].
Sincerely,

This section is comprised of our Project
Understanding. It includes a statement of our
understanding of the objectives of the project
and how the objectives will be accomplished.
Irvine Ranch Water District, in conjunction with
fifteen other Orange County agencies is working
to develop a Template Cross-Connection Control
Plan (Template CCCP) which will comply with
the State Water Resources Control Board
Division of Drinking Water (SWRCB DDW)
Cross-Connection Control Policy Handbook
(Handbook). The Handbook was adopted by the
SWRCB in December 2023 and Draft Template
CCCPs are due to SWRCB DDW on July 1,
2025.
Currently, sixteen Orange County public water
systems (PWS) are collaborating on the
development of a Template CCCP which, with
minor modifications, can be adapted for each
entity. Those entities include:
1. City of Anaheim
2. City of Fullerton
3. City of Garden Grove
4. City of Huntington Beach
5. City of Newport Beach
6. City of San Clemente
7. City of Santa Ana
8. City of Tustin
9. El Toro Water District
10. Irvine Ranch Water District
11. Laguna Beach County Water District
12. Mesa Water District
13. Moulton Niguel Water District
14. Santa Margarita Water District
15. South Coast Water District
16. Trabuco Canyon Water District
Domestic water supply permit holders ( also
known as Public Water Systems or PWS) are
required to protect the public water supply by
performing six (6) tasks identified in Title 17 of
the California Code of Regulations.
1. Adopt operating rules and ordinances;
2. Conduct surveys (aka hazard
assessments) to identify premises where
cross-connections are likely to occur;
3. Provisions for backflow protection;
4. Provisions for at least one person trained
in cross-connection;
5. Establish procedures for testing backflow
preventers; and
6. Maintain records of locations, tests, and
repairs of backflow preventers.
The Handbook incorporates Title 17 as well as
adds the following four (4) new PWS
requirements:
7. Ensure all backflow testers and cross-
connection control specialists are
properly certified;
8. Develop and implement procedures for
investigating and responding to
suspected or actual backflow incidents;
9. Implement a cross-connection control
public outreach and education program;
and
10. Coordinate with applicable local entities
to ensure hazard assessments can be
performed.
The Handbook requires each PWS to prepare and
submit a Template CCCP that will describe how
the PWS will fulfill the ten ( 10) requirements
identified in the Handbook.
Each PWS in Orange County must submit its
Template CCCP to the SWRCB DDW at the
Santa Ana Regional Water Quality Control
Board office for review and approval by July 1,
2025.

APPROACH
This section is comprised of our Approach. It
includes a detailed description of the intended
methodology to be utilized in addressing the
project. It describes our perception of the work
required and how our firm, personnel, and
services will be utilized.
Assessment of Available Cross Connection
Control Program Information
After the initial kick-off meeting the JR
Consulting team will begin gathering required
information from each PWS.
1. Step 1 – Schedule meetings with each of
the PWS Cross Connection Control
Managers and additional staff to review
their current programs, staffing, ordinances,
and procedures.
2. Step 2 - Create a Template CCCP from the
Handbook to use to compare the existing
PWS cross connection programs.
3. Step 3 – Circulate a draft of the Template
CCCP to each of the PWS, and request
review and comments.
4. Step 4 - Perform a GAP analysis to
determine what information is missing from
each PWS’s current cross connection
control program based on the requirements
of the Handbook.
5. Step 5 - Provide each PWS with an
assessment of the missing sections of their
respective programs based on the
Handbook.
6. Step 6 - Obtain copies of existing
ordinances from the PWS’s and compare
against the requirements of the Handbook.
Provide a results matrix to each PWS.
7. Step 7 - Create matrix comparing each
agencies existing programs to the
Handbook requirements.
8. Step 8 – Support IRWD staff with any
future DDW and OCHCA meetings to
address areas where the 16 PWS do not
agree to finalized Handbook.
9. Based on final agreed upon modifications,
finalize the Template CCCP and circulate
to the PWS.
Communication Strategy
While facilitating the discussions between the
PWS, the JR Consulting Team will work closely
with District staff as well as representatives from
PWS and OCHCA and the S WRCB DDW. T o
maintain proper communication with District
staff JR Consulting will provide:
• Monthly summaries of work with invoices
• Progress meetings at key deliverables to
review the materials prior to the PWS
review
• Finally, close-out presentations and delivery
of all project materials.
Building Consensus
In order to be considered successful the Template
CCCP will have to effectively meet the
objectives of the District and the PWS. Although
the stakeholders of each PWS are the same, t he
strategic objectives of each PWS are specific to
their strategic mission.
To reach mutual agreement for a Template CCCP
JR Consulting will assist the parties in:
• Identifying their specific objectives
• Identifying specific concerns
• Evaluating what additional activities or
procedures, the 16 PWS might need to meet
the requirements of the Handbook
• How the Handbook requirements fit into their
existing planning and budgets
• Detail out responsibilities for hazard
assessments to be performed, etc.
The final Template CCCP may not include
everything each PWS wants, but it must meet
75 Development of Template Cross- Connection Control Plan

Orange County Regulatory Experience
The JR Consulting Team recognizes that the
implementation of Template CCCP will need to
comply with the SWRCB DDW Han dbook. We
understand that assisting our clients with their
regulatory issues which includes cross -
connection control under tough permitting
constraints has contributed to the success of our
potable and recycled water projects. Our
extensive experience with the State Water
Resources Control Board Division of Drinking
Water (DDW), Santa Ana Regional Water
Quality Control Board (RWQCB) and Orange
County Healthcare Agency (OCHCA) have
increased our understanding of the involved
processes, enabling us to provide sound guidance
to our clients.
Draft Template CCCP Experience
The JR Consulting team has extensive
experience conducting preliminary and final
cross-connections at sites to be converted to
recycled water as discussed.
Recently, the JR Consulting Team was hired by
Jurupa Community Services District (JCSD) to
complete a Draft Cross-Connection Control Plan
that incorporated all the requirements of the
Handbook.
The document was completed and encompasses
all ten (10) items from the Handbook. The
process incorporated two rounds of comments
from JCSD staff and was submitted to SWRCB
DDW – San Diego Office. A conference call was
completed with SWRCB DDW – San Diego
Office staff and we are waiting for written
comments.
That effort has provided key experience to
complete the Template CCCP as it provides a
starting framework that can be provided to
IRWD and the 15 PWS so we can be more
efficient with the section preparations.

Summary
TRHA in conjunction with John Robinson
Consulting, prepared the City of Santa Ana’s
Recycled Water Master Plan which will allow the
City to add multiple new users to their recycled
water distribution system. The City currently
receives recycled water from the Orange County
Water District through the Green Acres Project
(GAP) pipeline. The master planning effort
included reviewing existing water use records of
all the City’s water customers to identify
potential conversion sites. Once identified
TRHA performed site visits to confirm the
viability of the conversion sites. Hydraulic
models were developed to connect the new users
to the planned recycled water pipeline extensions
from the GAP pipeline. Four different
subsystems were developed for the City so the
projects could be built in phases as funding
became available. Cost estimates were developed
for each of the conversion sites.
The report was constructed in accordance with
State funding requirements to allow the City to
pursue grants for the system expansions.
TRHA also prepared use site supplements for all
the twenty -three existing recycled water
customers including detailed maps of the
locations of all control valves, signs, and quick
couplers. These maps will be used by the City
and the Health Department in conjunction with
scheduled cross connection testing.
At the conclusion of the master planning, TRHA
was retained by the City to develop onsite
supervisor training in both English and Spanish,
evaluating desalting shallow groundwater to be
used for irrigation, and a satellite sewer package
plant to produce recycled water within the City,
in lieu of dependence on the GAP pipeline for
supply.

Summary
The Project Team led by John Robinson
developed IEUA’s Recycled Water
Implementation Plan. We developed the overall
project approach and methodology, coordinated
project tasks with IEUA, and provided the
technical content of the report. As part of the
84 Development of Template Cross- Connection Control Plan
13 | Page
approach, our team developed a 10 -year
implementation plan based on hydraulic
modeling performed in InfoWater.
The IEUA service area encompasses 242 square
miles in the southwestern corner of San
Bernardino County and is projected to develop
significantly in the next 25 years. The Recycled
Water Implementation Plan provides an
overview of IEUA’s recycled water supplies,
existing and estimated recycled water demands,
and a recommended regional backbone system to
distribute recycled water throughout the service
area.
The proposed backbone system is sized for build-
out demand conditions and delivers recycled
water to all IEUA’s member agencies and
selected based on life-cycle cost evaluations. The
proposed system goal was to serve the maximum
amount of potential recycled water customers
while meeting the pressure criteria and selecting
the most cost -effective alignments by avoiding
significant utility conflicts where possible.
The number of recycled water customers in this
area is estimated to increase from 100 to over
2,000 users in 25 years, resulting in a recycled
water demand increase from 7,900 acre-feet/year
to 93,000 acre -feet/year. The proposed system
consists of seven pressure zones, 110 MG of
reservoir storage, equalization storage at the five
regional plants, 13 booster stations with a
combined capacity of 145 mgd (nearly 15,000
hp) and 35 regional pipeline projects totaling 92
miles and ranging from 12 to 60 inches in
diameter. The 10 -year implementation plan
includes a seven -phase program with capital
costs of $200M. The capital cost of the CIP
through build-out is $325M.
In addition to the implementation plan, the
Project Team was selected to design four
pipelines, pump station and reservoir projects.

INTER-DEPARTMENT MEMORANDUM
To:
Lisa L. Kim From: William E. Murray
Dept:
City Manager Dept: Public Works
Date: 3/25/2025
Subject: Approval of Amendments to the agreements with Associated Soils, Inc. and GMU Geotechnical Services, Inc., to exercise the first option year and increase each agreement by $150,000 per year. (Action Item)
OBJECTIVE
To request the City Council’s approval to authorize the City Manager, or designee, to execute contract amendments for Associated Soils, Inc., and GMU Geotechnical Services, Inc., before the first year term is up and increase the contract amount s by an additional $150,000 for each remaining option year for both on-call geotechnical services contracts.
BACKGROUND
In March 2023, the City executed three (3) contracts for on-call geotechnical services with Associated Soils, Inc., GMU Geotechnical Services, Inc., and Geocon West, Inc. Each contract is valued at $400,000 for a two -year period, with two additional option years at $150,000 each. These contracts are essential for supporting infrastructure projects by providing soils and geotechnical analysis.
After entering into these agreements, the City learned that Geocon West is unable to assist with construction contract service needs because they are not in compliance with Community Workforce Agreement (CWA) requirements. This has significantly limited their usability. As a result, the majority of so ils requests have been diverted to the remaining two contractors, causing a faster-than-expected depletion of their allocated funds.
DISCUSSION
Due to the accelerated depletion of funds for the Associated Soils, Inc., and GMU Geotechnical Services, Inc., contracts, the City requests to amend the agreements to apply the first option year earlier than anticipated. Additionally, to ensure continuity of services and accommodate the increased demand, it is proposed to increase the contract amounts for the opti on years from $150,000 per year to $300,000 per year for the remaining option years. This amendment will allow the City to continue receiving the necessary geotechnical services without interruption and support the timely completion of infrastructure projects. 95 Item 98/2025
FINANCIAL IMPACT
There is no impact on the overall cost for on-call geotechnical services. The amount previously allocated to Geocon West will be redirected to Associated Soils, Inc. and GMU Geotechnical Services, Inc. No additional appropriation is required if the recommended actions are approved.
RECOMMENDATION
It is recommended that the City Council:
Authorize the City Manager, or designee, to execute Amendments exercising the first option year for the agreements with Associated Soils, Inc., and GMU Geotechnical Services, Inc.; and
Approve the increase in the contract amou nts for on -call geotechnical services with Associated Soils, Inc., and GMU Geotechnical Services, Inc., from $150,000 each year to $300,000 for each remaining option year.

INTER-DEPARTMENT MEMORANDUM
To:
Lisa L. Kim From: Patricia Song
Dept:
City Manager Dept: Finance
Date: 3/25/2025
Subject: Approval of implementation of merchant fee payment by customers for electronic payment transactions. (Action Item)
OBJECTIVE
For the City Council to approve the option provided by Point and Pay LLC to charge customers the fees charged by credit and debit companies for electronic payments.
BACKGROUND
On March 11, 2025, the City Council approved a contract with Point and Pay LLC for merchant services. The City's estimated annual cost for these services is $450,000, based on transaction types and volume. Th e City Council has directed staff to explore cost recovery options to reduce the financial burden on the general taxpayers for the convenience provided to credit card users.
DISCUSSION
Staff worked with Point and Pay LLC and identified two options for re covering merchant service fees:
Option 1: Fee Study and Convenience Fee Implementation
Conduct a fee study to establish a convenience fee for credit and debit card transactions.
The City pays merchant fees to Point and Pay but recovers the cost by charging customers a convenience fee as cost recovery.
Option 2: Direct Convenience Fee Charge to Customers
The convenience fee is charged directly by Point and Pay to customers using credit or debit cards.
218
Item 109/2025
Customers pay the fee directly to Point and Pay, eliminating the City's involvement in fee collection.
Under Option 1, based on projected transaction volumes, the City’s estimated annual cost is $450,000.
Under Option 2, Point and Pay will directly charge customers using debit or credit cards. The negotiated fee structure is as follows (illustrated with a $100.00 transaction):
Point and Pay charges a fee for electronic check transactions. It is recommended that the City absorb this electronic check fee, offering customers a free online payment option to enhance convenience and improve the overall customer experience. Based on historical transaction data, with approximately 100,000 electronic check payments annually, the City's estimated annual cost would be $20,000.
Currently, debit and credit card transactions are limited to $5,000.00 to minimize City costs.
If the City implements the cost recovery option, this transaction limit would be removed, further enhancing customer convenience and efficiency.
Staff also surveyed neighboring cities to assess whether they pass on a convenience fee to customers. The results are as follows:
FINANCIAL IMPACT
The annual merchant service fee is estimated at $450,000, based on the City’s current volume of debit and credit card payments. This significant cost re duces funding available for other programs that benefit the general population. While providing payment convenience remains a top priority, placing the financial burden on general taxpayers is not the desired outcome.
Payment Type Rate Amount
Master/Visa/Discover Cards 2.20%, min. $2.00 2.20$
America Express Card 2.20%, min. $2.00 2.20
Digital Wallet (Apple Pay/Google Pay) 2.20%, min. $2.00 2.20 Electronic Checks/ACH $0.20 0.20
Fountain Valley $1.25 for all online payment
Newport Beach 2.85% for card payment, no fee on E-Check Santa Ana None
Anaheim None, limit card transaction to $5,000
Irvine $2.50 for card payment
Fullerton None, looking to implement soon
Westminster None, looking to implement soon
Huntington Beach 3% for all card payment
Buena Park 3-4% on Building/Planning related transaction through 3rd party Orange None, looking to implement soon
Stanton 2.6% for card payment
219
Item 109/2025
Therefore, it is highly desirable to pursue cost recovery from customers who directly benefit from the convenience of using debit or credit cards, as is the practice in many neighboring cities.
Both options presented would achieve the cost recovery goal, with Option 2 being more favorable due to its greater transparency and efficiency. If the City adopts Option 2 and absorbs the cost of electronic check processing, the estimated annual expense would be $20,000.
RECOMMENDATION
It is recommended that the City Council:
Approve Option 2, the direct convenience fee charge to customers, with the fee for electronic checks covered by the City.
