A. The California State Water Resources Control Board ("State Board"), which regulates all Public Water Systems ("PWSs") in California, requires PWSs to protect the public water supply by compliance with Title 17 of the California Code of Regulations. The State Board has adopted the Cross-Connection Control Policy Handbook ("Handbook"), effective July 1, 2024, to establish standards to which each PWS's drinking water distribution system will be subject regarding the backflow of liquids, gases, or other substances . The Handbook requires each PWS, no later than July 1, 2025, to prepare and submit a Control Plan that will describe how the PWS will fulfill the ten requirements identified in the Handbook. Each PWS in Orange County must submit its Control Plan to the Division of Drinking Water at the Santa Ana Regional Water Quality Control Board office for review and approval.

B. The Parties have determined that it will be to their joint advantage to collaborate to develop a template for a control plan (" Template Control Plan ") that may, with minor modifications, be adapted for use by each of the Parties. The Parties further agree that a qualified consultant with industry knowledge will be required to assist the Parties in developing the Template Control Plan (the "Work") . The Parties will schedule meetings that will be held approximately monthly with the selected consultant to adva nce the creation of the T emplate Control Plan.

C. The Parties intend by this Agreement to provide the framework under which they will share costs for the selected consultant's Work.

The Parties therefore agree as follows:

1. Contract for the Work . On behalf of all of the Parties, IRWD shall serve as the contracting agency and will request proposals from qualified consultants and ultimately select and enter into a Professional Services Agreement (“PSA”) with the successful proposer ("Consultant") to perform the Work. The selection will be made with the assistance of whichever other Parties volunteer to participate in the selection process. IRWD shall promptly pay all invoices submitted by the Consultant for the W ork. At the conclusion of the W ork and IRWD’s receipt of the Consultant’s final invoice, or by August 1, 2025, whichever occurs first, IRWD shall invoice each 2 20877033.10
of the Parties (including any additional parties hereafter added to this Agreement pursuant to Section 3, below) for their proportional share of the costs of the Work (as further described in Section 4, below).

2. Scope of Work. The Consultant will develop a specific scope for the Work, budget, and schedule necessary to produce a Template Control Plan that the Parties can adapt to meet requirements of the State Board as set forth in the Handbook. The Consultant will perform the Work on a time -and-materials basis for an estimated not -to-exceed amount of $180,000, which includes 20 percent for contingencies above the Consultant’s estimated costs of $150,000. These costs are subject to the cost-sharing provisions set forth in Section 4, below.

3. A dditional Parties . In addition to the Parties listed above, additional parties may be added to this Agreement, subject to all of the covenants, terms, and conditions of the Agreement .

Additional parties may join this Agreement at any time before completion of the Work upon written invitation by one or more of the original Parties, by executing the signature page and delivering an electronic version to all then- current Parties. Additional parties will be treated as original parties to this Agreement and equally share in the total cost of the Work, as described in Section 4, below.

4. C ost Sharing. The Parties shall share equally the cost of the Work . Each Party’s share of the cost will be determined by taking the total invoiced amount from Consultant for all completed Work and dividing that amount by the number of Parties at the conclusion of the Work.

At the conclusion of the Work, IRWD will invoice each Party for an equal share of the total cost of the Work. Each Party shall pay IRWD its equal share no later than 60 days after receiving the invoice. Upon the request of any Party, IRWD will provide copies of the Consultant's invoices and IRWD's payment records.

5. M eetings . IRWD shall coordinate all aspects of the Work with the selected Consultant. Any Party may participate in meetings with the Consultant to review interim and final results of the Work. IRWD will schedule meetings of the Parties to facilitate review of the Work, and will schedule meetings with the Consultant and the Parties at the reasonable request of any Party for the same purpose.

6. In demnity . Each Party shall indemnify, defend, and hold the other Parties, and their officers, agents, and employees harmless from any expense, liability, injury, loss, damage or expense to persons or property (collectively, “Claims”) that may arise or may be claimed to have arisen as a result of the development and approval of the Template Control Plan . Each Party's indemnity and defense obligations will not apply to any portion of a ny Claims determined by a court of competent jurisdiction to have been proximately caused by the negligence, gross negligence or willful misconduct of another Party, its officers, agents, or employees.

Notwithstanding the foregoing sentences in this section, each Party is solely responsible for its own costs and expenses associated with the indemnity and defense obligations set forth in this section, and such costs are not subject to cost sharing under this Agreement. This section shall survive the termination or expiration of this Agreement.

7. P
roperty . All documents, data, and written materials furnished by a Party to Consultant shall remain that Party’s property and shall be returned to that Party upon request. All 3 20877033.10
documents, data, or written material prepared or caused to be prepared by Consultant, its officers, employees, agents, and subcontractors in the course of implementing this Agreement shall become the joint property of the Parties, and each Party shall have the right to use and modify such materials without further approval or compensation to Consultant or the other Parties.

8. Withdrawal. Any Party may withdraw from this Agreement upon 30 days’ written notice to the other Parties. However, the payment obligations of that Party will be pro-rated based on the percent of the Work accomplished up to the withdrawal date.

Irvine, CA 92618

Subject: Proposal for Development of Template Cross-Connection Control Plan

Dear Ms. Hatch:

John Robinson Consulting, Inc. (JR Consulting) is pleased to submit this proposal to develop a Template Cross-Connection Control Plan (Template CCCP) for the Irvine Ranch Water District and fifteen other Public Water Systems (PWS) in the Orange County Area. We have been following the implementation schedule by the S tate Water Resources Control Board Division of Drinking Water (SWRCB DDW) for the Cross-Connection Control Policy Handbook (Handbook). We have already helped one Inland Empire agency develop a draft plan to meet the requirements of the Handbook, conducted one meeting with DDW staff and are awaiting comments from the DDW to complete the Handbook.

Our Familiarity with PWS and Regulatory Agencies - JR Consulting has worked with numerous agencies and agency representatives that could play a role in the development of the Template CCCP, including the Orange County Health Care Agency (Hasham “Sham” Elmishad), Santa Ana Regional Water Quality Control Board and SWRCB DDW (Oliver Pacifico). The JR Consulting team has helped numerous agencies prepare recycled water master plans, develop recycled water conversions plan s, and performed cross connection testing for multiple recycled water use sites throughout Southern California.

Unique combination of Public and Private Recycled Water Planning Experience - For this project we have assembled a Project Team of experts with over 70 years of combined public/private agency experience in potable and recycled water systems. Our Project Manager, John Robinson, who has over 30 years of experience in recycled water system will be joined by Mr. T homas Holliman, PE, who has over 40 years of experience in recycled water systems and has managed recycled water programs for the Irvine Ranch Water District and the Long Beach Water Department . Tom is our designated backflow prevention assembly tester and cross-connection control specialist.

Acknowledgements - John Robinson Consulting will function as the Prime Consultant, T.R. Holliman and Associates, Inc. will be a subconsultant. We have no conflict of interests issues working in with any of the PWS. JR Consulting carries all of the required insurance and will provide certificates of insurance when the contract is awarded. Further we take no exceptions to IRWD’s standard agreement included in the RFP. Finally, per the RFP, the budget proposal, including fee schedules and breakdown of the fee by task is being submitted separately from the project proposal

Should there be any questions, please feel free to contact me at (626) 375 -9389 or at [email protected].

Sincerely,

John Robinson Consulting, Inc.

PROJECT UNDERSTANDING
This section is comprised of our Project
Understanding. It includes a statement of our
understanding of the objectives of the project
and how the objectives will be accomplished.

Irvine Ranch Water District, in conjunction with
fifteen other Orange County agencies is working
to develop a Template Cross-Connection Control
Plan (Template CCCP) which will comply with
the State Water Resources Control Board
Division of Drinking Water (SWRCB DDW)
Cross-Connection Control Policy Handbook
(Handbook). The Handbook was adopted by the
SWRCB in December 2023 and Draft Template
CCCPs are due to SWRCB DDW on July 1,
2025.

Currently, sixteen Orange County public water
systems (PWS) are collaborating on the
development of a Template CCCP which, with
minor modifications, can be adapted for each
entity. Those entities include:

1. City of Anaheim

2. City of Fullerton

3. City of Garden Grove

4. City of Huntington Beach

5. City of Newport Beach

6. City of San Clemente

7. City of Santa Ana

8. City of Tustin

9. El Toro Water District

10. Irvine Ranch Water District

11. Laguna Beach County Water District

12. Mesa Water District

13. Moulton Niguel Water District

14. Santa Margarita Water District

15. South Coast Water District

16. Trabuco Canyon Water District
Domestic water supply permit holders ( also
known as Public Water Systems or PWS) are
required to protect the public water supply by
performing six (6) tasks identified in Title 17 of
the California Code of Regulations.

1. Adopt operating rules and ordinances;

2. Conduct surveys (aka hazard
assessments) to identify premises where
cross-connections are likely to occur;

3. Provisions for backflow protection;

4. Provisions for at least one person trained
in cross-connection;

5. Establish procedures for testing backflow
preventers; and

6. Maintain records of locations, tests, and
repairs of backflow preventers.

The Handbook incorporates Title 17 as well as
adds the following four (4) new PWS
requirements:

7. Ensure all backflow testers and cross-
connection control specialists are
properly certified;

8. Develop and implement procedures for
investigating and responding to
suspected or actual backflow incidents;

9. Implement a cross-connection control
public outreach and education program;
and

10. Coordinate with applicable local entities
to ensure hazard assessments can be
performed.

The Handbook requires each PWS to prepare and
submit a Template CCCP that will describe how
the PWS will fulfill the ten ( 10) requirements
identified in the Handbook.

Each PWS in Orange County must submit its
Template CCCP to the SWRCB DDW at the
Santa Ana Regional Water Quality Control
Board office for review and approval by July 1,
2025.

APPROACH
This section is comprised of our Approach. It
includes a detailed description of the intended
methodology to be utilized in addressing the
project. It describes our perception of the work
required and how our firm, personnel, and
services will be utilized.

Assessment of Available Cross Connection
Control Program Information
After the initial kick-off meeting the JR
Consulting team will begin gathering required
information from each PWS.

1. Step 1 – Schedule meetings with each of
the PWS Cross Connection Control
Managers and additional staff to review
their current programs, staffing, ordinances,
and procedures.

2. Step 2 - Create a Template CCCP from the
Handbook to use to compare the existing
PWS cross connection programs.

3. Step 3 – Circulate a draft of the Template
CCCP to each of the PWS, and request
review and comments.

4. Step 4 - Perform a GAP analysis to
determine what information is missing from
each PWS’s current cross connection
control program based on the requirements
of the Handbook.

5. Step 5 - Provide each PWS with an
assessment of the missing sections of their
respective programs based on the
Handbook.

6. Step 6 - Obtain copies of existing
ordinances from the PWS’s and compare
against the requirements of the Handbook.

Provide a results matrix to each PWS.

7. Step 7 - Create matrix comparing each
agencies existing programs to the
Handbook requirements.

8. Step 8 – Support IRWD staff with any
future DDW and OCHCA meetings to
address areas where the 16 PWS do not
agree to finalized Handbook.

9. Based on final agreed upon modifications,
finalize the Template CCCP and circulate
to the PWS.

Communication Strategy
While facilitating the discussions between the
PWS, the JR Consulting Team will work closely
with District staff as well as representatives from
PWS and OCHCA and the S WRCB DDW. T o
maintain proper communication with District
staff JR Consulting will provide:
• Monthly summaries of work with invoices
• Progress meetings at key deliverables to
review the materials prior to the PWS
review
• Finally, close-out presentations and delivery
of all project materials.

Building Consensus
In order to be considered successful the Template
CCCP will have to effectively meet the
objectives of the District and the PWS. Although
the stakeholders of each PWS are the same, t he
strategic objectives of each PWS are specific to
their strategic mission.

To reach mutual agreement for a Template CCCP
JR Consulting will assist the parties in:
• Identifying their specific objectives
• Identifying specific concerns
• Evaluating what additional activities or
procedures, the 16 PWS might need to meet
the requirements of the Handbook
• How the Handbook requirements fit into their
existing planning and budgets
• Detail out responsibilities for hazard
assessments to be performed, etc.

The final Template CCCP may not include
everything each PWS wants, but it must meet
Development of Template Cross- Connection Control Plan

Instead of a pool of engineers with only limited
specific cross-connection control experience, JR
Consulting provides experts that can bring their
collective experience to bear on the development
of the Template CCCP . This “ based in reality ”
approach will reflect both the economics and
technical analysis needed for a successful Draft
Template CCCP for IRWD and the 15 PWS.

We bring collective experiences from dozens of
agencies to ensure the Draft Template CCCP is
based on solid proven results.

Local Resources and Knowledge

JR Consulting Project Team’s past success has

Orange County Regulatory Experience

The JR Consulting Team recognizes that the
implementation of Template CCCP will need to
comply with the SWRCB DDW Han dbook. We
understand that assisting our clients with their
regulatory issues which includes cross -
connection control under tough permitting
constraints has contributed to the success of our
potable and recycled water projects. Our
extensive experience with the State Water
Resources Control Board Division of Drinking
Water (DDW), Santa Ana Regional Water
Quality Control Board (RWQCB) and Orange
County Healthcare Agency (OCHCA) have
increased our understanding of the involved
processes, enabling us to provide sound guidance
to our clients.

Draft Template CCCP Experience

The JR Consulting team has extensive
experience conducting preliminary and final
cross-connections at sites to be converted to
recycled water as discussed.

Recently, the JR Consulting Team was hired by
Jurupa Community Services District (JCSD) to
complete a Draft Cross-Connection Control Plan
that incorporated all the requirements of the
Handbook.

The document was completed and encompasses
all ten (10) items from the Handbook. The
process incorporated two rounds of comments
from JCSD staff and was submitted to SWRCB
DDW – San Diego Office. A conference call was
completed with SWRCB DDW – San Diego
Office staff and we are waiting for written
comments.

That effort has provided key experience to
complete the Template CCCP as it provides a
starting framework that can be provided to
IRWD and the 15 PWS so we can be more
efficient with the section preparations.

As the Project Manager, Mr. Holliman, in
conjunction with Mr. Robinson prepared a
Recycled Water Facilitator Report for the City of
Beaumont, Beaumont Che rry Valley Water
District (BCVWD), and the San Gorgonio Pass
Water Agency. This report was the culmination
of background research on the City of
Beaumont’s recycled water plant, its operating
permits, and history of discharges to Cooper
Creek. The report also reviewed documents
prepared by the Beaumont Cherry Valley Water
District on the use of recycled water in the
Beaumont Valley.

TR Holliman and Associates also prepared a
Recycled Water Implementation Roadmap to
provide BCVWD with the steps necessary to
convert their 300 non- potable water sites to
recycled water from the City of Beaumont. The
project required multiple meetings with the City
and water agencies individually, and then as a
work group. TRHA developed a recommended
plan to allow the three agencies to move forward
with the multiagency project. TRHA was also
retained to assist the City in preparing an RFP for
assistance in preparing a Conditional Use Permit
and an Adaptive Management Plan to allow the

Summary

TRHA in conjunction with John Robinson
Consulting, prepared the City of Santa Ana’s
Recycled Water Master Plan which will allow the
City to add multiple new users to their recycled
water distribution system. The City currently
receives recycled water from the Orange County
Water District through the Green Acres Project
(GAP) pipeline. The master planning effort
included reviewing existing water use records of
all the City’s water customers to identify
potential conversion sites. Once identified
TRHA performed site visits to confirm the
viability of the conversion sites. Hydraulic
models were developed to connect the new users
to the planned recycled water pipeline extensions
from the GAP pipeline. Four different
subsystems were developed for the City so the
projects could be built in phases as funding
became available. Cost estimates were developed
for each of the conversion sites.

The report was constructed in accordance with
State funding requirements to allow the City to
pursue grants for the system expansions.

TRHA also prepared use site supplements for all
the twenty -three existing recycled water
customers including detailed maps of the
locations of all control valves, signs, and quick
couplers. These maps will be used by the City
and the Health Department in conjunction with
scheduled cross connection testing.

At the conclusion of the master planning, TRHA
was retained by the City to develop onsite
supervisor training in both English and Spanish,
evaluating desalting shallow groundwater to be
used for irrigation, and a satellite sewer package
plant to produce recycled water within the City,
in lieu of dependence on the GAP pipeline for
supply.

Summary

The Project Team led by John Robinson
developed IEUA’s Recycled Water
Implementation Plan. We developed the overall
project approach and methodology, coordinated
project tasks with IEUA, and provided the
technical content of the report. As part of the

Development of Template Cross- Connection Control Plan

approach, our team developed a 10 -year
implementation plan based on hydraulic
modeling performed in InfoWater.

The IEUA service area encompasses 242 square
miles in the southwestern corner of San
Bernardino County and is projected to develop
significantly in the next 25 years. The Recycled
Water Implementation Plan provides an
overview of IEUA’s recycled water supplies,
existing and estimated recycled water demands,
and a recommended regional backbone system to
distribute recycled water throughout the service
area.

The proposed backbone system is sized for build-
out demand conditions and delivers recycled
water to all IEUA’s member agencies and
selected based on life-cycle cost evaluations. The
proposed system goal was to serve the maximum
amount of potential recycled water customers
while meeting the pressure criteria and selecting
the most cost -effective alignments by avoiding
significant utility conflicts where possible.

The number of recycled water customers in this
area is estimated to increase from 100 to over
2,000 users in 25 years, resulting in a recycled
water demand increase from 7,900 acre-feet/year
to 93,000 acre -feet/year. The proposed system
consists of seven pressure zones, 110 MG of
reservoir storage, equalization storage at the five
regional plants, 13 booster stations with a
combined capacity of 145 mgd (nearly 15,000
hp) and 35 regional pipeline projects totaling 92
miles and ranging from 12 to 60 inches in
diameter. The 10 -year implementation plan
includes a seven -phase program with capital
costs of $200M. The capital cost of the CIP
through build-out is $325M.

In addition to the implementation plan, the
Project Team was selected to design four
pipelines, pump station and reservoir projects.

The design component was later expanded to six
design projects and program management
services, including development of a customer
geodatabase. The project work required a strong
client/consultant partnership to develop a plan
for the system as well as detailed designs of
several major backbone facilities, which were to
run in heavily populated/developed areas.

Thorough knowledge of recycled water customer
physical locations and their demands were also
required. The IEUA service area includes the
Cities of Rancho Cucamonga, Ontario, and
Montclair, California.

The project included gathering information from site investigations and evaluations in addition to identifying any fatal flaws to the conversion of any of the four sites from domestic water to recycled water. The report evaluated the impact of the proposed recycled water quality on the plant materials and provided recommendations for any necessary modifications to the irrigation systems and replacement of certain plants that may be significantly affected by recycled water. Finally, the work included a Recycled Water Master Plan Update that included identifying the total potential recycled water demand through multiple potential landscaping, park, and school conversions. Recycled water system alternatives were produced using all previous

information that would develop a distribution system which would deliver recycled water to the various use sites with the most cost-effective way.

Project Manager, GREAT Project, Phase IB, City of Oxnard, CA Provided full technical and adminstrative support for the on -site recycled water conversions for the City of Oxnard’s Groundwater Recovery Enhancement and Treatment (GREAT) Program. This work consisted of identifying commercial/industrial, landscape irrigation, schools, parks, and golf course irrigation conversion opportunities. After identifying the users, conducted user interviews, mapped all the use sites, developed a Master Engineer’s Report for all the landscape irrigation sites, and individual reports for the schools, River Park Development, and the River Ridge Golf Course.

Conversion plans were developed for all the parks a nd schools adjacent to the recycled water pipelines.

Project Manager, Recycled Water Feasibility Study, City of Lompoc, CA Developed a recycled water feasibility study to determine where there are opportunities for recycled water use by the City. The report determined what barriers exist ed to implementing a recycled water system, and developed a cost/benefit analysis. The study identified pertinent regulatory requirements, performed a market assessment of potential customers and demand estimates, analyzed recycled water supply availability and quality, prepared system alternatives, included cost/benefits for each option, and provided recommendations and further analysis needs.

Project Manager, Recycled Water System Coordination, Inland Empire Utilities Agency, Chino, CA
Recycled Water Coordinator/Program Manager for the implementation of IEUA’s Three Year Recycled Water Business Plan. Work included identifying recycled water customers, developing site specific conversion plans, preparing engineer’s reports, onsite recycl ed water supervisor training, interfacing with member agency staff, developing conversion cost estimates, and monitoring recycled water demand.

Project Manager, East Pomona Recycled Water Feasibility Study, City of Pomona, CA Prepared of a recycled water retrofit feasibility study for eastern Pomona. This work included identifying all potential recycled water customers, developing alternative facility alignments, creating a hydraulic model of the proposed recycled water system , developing the preferred alternatives, preparing cost estimates for each alternative and combining all the information into a comprehensive report with recommendations.
