INTER-DEPARTMENT MEMORANDUM

To:

Lisa L. Kim From: Chief El-Farra
Dept:

City Manager Dept: Police
Date: 8/12/2025

Subject: Authorization to adjust Community Corrections Partnership (AB 109) Funds allocated for Public Safety Realignment and Post-Release Community Supervision. (Action Item)

OBJECTIVE

To obtain City Council authorization for the Finance Director to make necessary budget adjustments to the Community Corrections Partnership (AB 109) funds allocated by the State for Public Safety Realignment and Post-Release Community Supervision.

BACKGROUND

Under the Public Safety Realignment Act (AB 109), the State provides annual funding to local jurisdictions to support the supervision and rehabilitation of individuals released from State prison. These funds are allocated through the Community Corrections Partnership to enhance local law enforcement, reduce recidivism, and improve public safety outcomes. The Garden Grove Police Department receives a portion of this funding each year and uses it to support various programs and services aligned with AB 109 objectives.

DISCUSSION

Annually the Garden Grove Police Department receives an allocation of approximately $200,000 in AB 109 funding, with the potential for additional growth funds to be distributed after July 1 based on the State’s adopted budget. These funds are designated to support local law enforcement services and are subject to non -supplanting requirement under the State law.

During the budget development process, the Police Department collaborates with the Finance Department to estimate anticipated AB 109 allocations. These r evenue estimates are budgeted in the State Grant Fund (Fund 233), with corresponding appropriations included in the Police Department’s operating budget.

Because actual AB 109 disbursements vary annually, based on the State’s budget and each local law enforcement agency’s allocation percentage, it is recommended that the City Council Item 262/2025

authorize the Finance Director , or designee, to adjust the budget as necessary to align revenue estimates and appropriations with the actual disbursements . This flexibility w ill ensure efficient and timely use of AB 109 funding and minimize operational delays.

FINANCIAL IMPACT

The use of AB 109 funds to support public safety-related services imposes no burden on the City’s General Fund.

The proposed budget adjustment for the current and future fiscal years will increase both revenue estimate and appropriation by the same amount, resulting in no net fiscal impact to the City.

RECOMMENDATION

It is recommended that the City Council:

 Authorize the Finance Director, or designee, to adjust the revenue estimate in the State Grant Fund (Fund 233) and increase the corresponding appropriation in the Police Department’s operating budget for Fiscal Year 2025-26 and future years, to reflect actual AB 109 disbursements.
