INTER-DEPARTMENT MEMORANDUM

To:

Dept:

City Manager Dept: Public Works
Date: 4/28/2026

Subject: Approval of an Amended and Restated National Pollution Discharge Elimination System Stormwater Permit Implementation Agreement with the County of Orange and Orange County Flood Control District. (Action Item)

OBJECTIVE

To seek City Council approval of the Amended and Restated National Pollutant Discharge Elimination System Stormwater Permit Implementation Agreement with the County of Orange (County), Orange County Flood Control District (District) and participating Orange County cities for management and implementation of the National Pollution Discharge Elimination System (NPDES) Stormwater permit.

BACKGROUND

The NPDES Stormwater Permit Implementation Agreement (Agreement) delegates the responsibilities between the County, District and all local cities for compliance with the Santa Ana Regional Water Quality Control Board (SARWQCB) and San Diego Regional Water Quality Control Board NPDES Stormwater Permits. The County is the administrator and permit holder for both NPDES permits, however, north Orange County, includin g Garden Grove, is only subject to the conditions of the SARWQCB NPDES permit.

The original Orange County NPDES Stormwater Permit Implement ation Agreement was executed in 1990 and amended in 1993 and 2002.

DISCUSSION

The proposed revised Agreement updates the 2002 agreement to reflect current regulatory requirements, administrative practices, and programmatic needs. Some of the key provisions of the revised Agreement include the clarification of responsibilities for each jurisdiction for federal and state mandated reporting, monitoring, site inspections and enforcement of Best Management Practices (BMPs) , and engagement with the Orange County City Managers’ Association for strategic input on compliance and funding . Other aspects include updates related to new legislation and an updated collaborative review process for annual operating budgets, and related regional programs.
