Subject: Change Order #1
Ponce Recycling Project
1937 West Street, Gardena CA

Dear Kevin:

As you may be aware, our proposal for services assumed that the information provided by the City or applicant would include a Preliminary Geotechnical Investigation; the project applicant has reported that such a report does not exist currently and asked f or a proposal to prepare one. This Change Order presents a proposal to complete a Geotechnical Investigation for the proposed project.

This work will be conducted by our subconsultant, NOVA Engineering.

SCOPE OF SERVICES

The purpose of the services will be to address the geotechnical issues of the proposed development.

Specifically, the scope of work will consist of the following:

• Reviewing relevant geologic maps and other readily available literature pertinent to the geotechnical conditions at the site.
• Coordinating site access with UltraSystems.
• Marking the investigation locations in accordance with Underground Service Alert (USA) requirements.
• Hiring a private utility locator to mark potential subsurface conflicts at investigation locations.
• Drilling four geotechnical borings to depths of 5 to 50 feet below the ground surface (bgs), or refusal if shallower, using a truck -mounted drill rig. A NOVA geologist will log the borings and obtain samples for examination and laboratory testing. • Drilling one percolation test boring up to a depth of 15 feet for planning phase infiltration testing. No information was provided for any infiltration within the RFP.

The test will be planned in the vicinity of the lowest portion of the site. • Performing a seismic shear wave survey by a Professional Geophysicist. The seismic shear wave survey will be performed within the upper 100 feet of the subsurface soils. The seismic shear wave velocity (Vs30) will be measured for evaluation of the seismic site class.
• Assessing groundwater levels, if encountered.
• Backfilling the borings with cuttings.
• Performing laboratory tests on selected soil samples.

City of Gardena
January 13, 2026

Page 2 ends

NOVA will prepare one report that includes a subsurface investigation map, boring, and laboratory test results for both lots. We will submit an electronic copy of the report. The report will provide applicable conclusions and recommendations regarding:

• Subsurface conditions beneath the site, including groundwater levels if encountered. • Potential geologic hazards.
• Criteria for seismic design in accordance with 2025 California Building Code (CBC) and ASCE 7 -22. We assume that a site -specific ground motion hazard analysis (GMHA) will not be required for this project.
• Site preparation and grading.
• Excavation characteristics.
• Expansive soil mitigation.
• Appropriate alternatives for foundation support, along with geotechnical engineering criteria for design of the foundations.
• Resistance to lateral loads.
• Estimated foundation settlements.
• Support for concrete slabs-on-grade.
• Soil corrosivity.
• Planning phase infiltration rates.

Please note that it is anticipated that the project site and subsurface materials are free of environmental contamination or pollution. The scope and fee presented herein do not include assessment, sampling, analysis, or management of suspected contaminate d materials. However, unexpected conditions can always arise. Should we encounter soil or groundwater that is suspected to be contaminated, either because of odors, colors, free liquids, or other suspicious conditions, we will immediately notify the client . The client should take necessary initial measures to protect workers, the site, and other personnel.

COSTS
NOVA will perform the scope of work above on a Fixed Fee Basis, per the table below. UltraSystems fee is based on 10% of the overall fees.

Task Work Scope Fees
1 Geotechnical Investigation and Report $22,000
2 Design Development Services $ 2,000

COUNCIL ACTION REQUIRED:

STAFF RECOMMENDATION: Ratify Administrative Approval
RECOMMENDATION AND STAFF SUMMARY:

The City has an existing agreement with BPR Consulting Group, Inc. (BPR) to provide contracted building and safety services. The Council previously approved a blanket purchase order allocating $924,000 for fiscal year 2025-26. This was staff's anticipated amount needed for the entire fiscal year based on past history performance and likely projects that would occur during that time period. However, building activities fluctuate and are often unpredictable.

This past fiscal year, building plan check review services had increased. An additional $470,087.29 in plan check fees were collected by the City than had been anticipated. Therefore, an additional $314,958.49 (67% of $470,087.29) was required to be paid to BPR for conducting the building plan check review work.

Staff respectfully recommends that the City Council approve the additional amount of $314,958.49 for BPR Consulting Group, Inc. for fiscal year 2025-26.

TO: THE HONORABLE MAYOR AND MEMBERS OF THE GARDENA CITY COUNCIL AGENDA TITLE: SECOND READING AND ADOPTION OF ORDINANCE NO. 1891, Amending Chapter 8.70 of the Municipal Code for Stormwater and Runoff Pollution Control and Declare California Environmental Quality Act (CEQA) Exemption
COUNCIL ACTION REQUIRED:

Staff Recommendation: Adopt Ordinance 1891
Contact: Public Works
RECOMMENDATION AND STAFF SUMMARY:

On July 14, 2026, the City Council introduced Ordinance No. 1891 to amend Chapter 8.70 Stormwater and Runoff Pollution Control of the Garden Municipal Code and Declare California Environmental Quality Act (CEQA) Exemption.

The City’s Stormwater Consultant has advised staff that the State has made changes to the requirements the City must enforce under the Clean Water Act. These changes largely revolve around the characterization of projects required to comply with different portions of the clean water requirements. There will be minimal impacts to the City and the community.

Additionally, declare that the adoption of this ordinance is categorically exempt under CEQA Article 5, Section 15061 (b), (3), "the commonsense exemption." The action is largely administrative in nature and designed to improve, not degrade, environmental quality, such that there is no possibility that adopting this Ordinance would adversely affect the environment in any manner that could be significant.

SECTION 6. Amendment to Chapter 8.70. Section 8.70.110 (B) of the Gardena Municipal Code is hereby amended to read as follows:

1. Development Construction. Construction projects that disturb one or more acres of soil by grading, clearing, and/or excavating or other activities are required to obtain coverage under the Construction General Permit ("CGP") from the State Water Resources Control Board ("State Board"). No grading permit shall be issued to such construction projects without obtaining a Waste Discharge Identification (WDID) number for coverage under the CGP. Projects that disturb less than one acre of soil are required to comply with minimum best management practices ("BMPs") to reduce the discharge of construction-related pollutants to the municipal separate storm sewer system ("MS4"). The type of BMPs required shall be based on such factors as the amount of soil disturbed, the types of pollutants used or Ordinance No. 1891
3 stored at the project site, and proximity to water bodies. Erosion control plans may be required at the discretion of the city. If required, the project applicant must submit an erosion control plan to the city for approval as a condition for grading permi t issuance.

2. Low Impact Development. New development and redevelopment projects that are subject to the MS4 permit are required to comply with post -construction runoff pollution reduction BMPs implemented through a low impact development plan ("LID Plan")LID conditions assigned by the city shall consist of: (a) low impact development ("LID") best management practices ("BMPs"); (b) source control BMPs; and (c) structural and nonstructural BMPs for specific types of uses. LID controls effectively reduce the amount of impervious area of a completed project site and promote the use of infiltration and other controls that reduce runoff. Source control BMPs shall prevent runoff contact with pollutant materials that would otherwise be discharged to the MS4. Specific s tructural controls are also required to address pollutant discharges from certain uses including but not limited to:
housing developments; retail gasoline outlets; automotive- related facilities; restaurants; industrial and commercial facilities, parking lots, and new streets.

Subject projects are more particularly described in the city's stormwater management and watershed management program plan.

3. Low Impact Development Plan Review and Approval. An applicant subject to new development or redevelopment requirements shall submit a n LID Plan for city review and approval, which shall be incorporated into the applicant's project plans.

4. California Environmental Quality Act ("CEQA"). Any project subject to CEQA review that is not specified in a redevelopment or development project category may be required to comply with any of the LID Plan requirements at the city's discretion.

5. Stormwater Management/Watershed Management Program. The city's stormwater management program ("SWMP") plan or watershed management program ("WMP") plan, whichever is in effect at the time of review, shall contain specific conditions and procedures for m eeting low impact development and development construction requirements. The program plans shall contain guidance documents to facilitate compliance including but not limited to an updated LID guidance manual, the latest copy of the County of Los Angeles’ LID Standards manual , USEPA's Green Street guidance manual, and best management practices applicable to certain categories of soil disturbing construction projects over and under one acre.

6. Certificate of Occupancy. As a condition for issuing a certificate of occupancy for new development or redevelopment project identified in subsection (B)(1) of this section, the authorized enforcement officer shall require facility operators and/or owners to build all the stormwater pollution control best management practices and structural or treatment control BMPs that are shown on the approved project plans and to submit a signed certification statement stating that the site and all structural or treatment control BMPs will be maintained in compliance with the LID Plan and other applicable regulatory requirements.

7. Transfer of Properties.

Ordinance No. 1891
4 a. The transfer or lease of a property subject to a requirement for maintenance of structural and treatment control BMPs shall include conditions requiring the transferee and its successors and assigns to either (i ) assume responsibility for maintenance of any existing structural or treatment control BMP, or (ii) to replace existing structural or treatment control BMPs with new control measures or BMPs meeting the then current standards of the city and the LID Plan.

Such requirement shall be included in any sale or lease agreement or deed for such property. The condition of transfer shall include a provision that the successor property owner or lessee conduct maintenance inspections of all structural or treatment control BMPs at least once a year and retain proof of inspection. b. For residential properties where the structural or treatment control BMPs are located within a common area which will be maintained by a homeowner's association, language regarding the responsibility for maintenance shall be included in the project's conditions, covenants and restrictions (CC&Rs). Printed educational material will be required to accompany the first deed transfer to highlight the existence of the requirement and to provide information on what stormwater management facilities are present, signs that maintenance is needed, and how the necessary maintenance can be performed. The transfer of this information shall also be required with any subsequent sale of the property. c. If structural or treatment control BMPs are located within an area proposed for dedication to a public agency, they will be the responsibility of the developer until the dedication is accepted.

SECTION 7. CEQA. The City Council finds that the adoption of the local amendments thereof is exempt from the California Environmental Quality Act (“CEQA”) under CEQA Guideline section 15061(b)(3) (the commonsense exemption). The action is largely administrative in nature and designed to improve and not degrade environmental quality such that there is no possibility that adopting this Ordinance would adversely affect the environment in any manner that could be significant. As such, staff is directed to file a Notice of Exemption pursuant to CEQA Guidelines sections 15061(b)(3).

SECTION 8. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance, or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared unconstitutional.

SECTION 9. Certification. The City Clerk shall certify the passage of this ordinance and shall cause the same to be entered in the book of original ordinances of said City; shall make a minute passage and adoption thereof in the records of the meeting at which time the same is passed and adopted; and shall, within fifteen (15) days after the passage and adoption thereof, cause the same to be published as required by law, in a publication of general circulation.

Ordinance No. 1891
5 SECTION 10. Effective Date. This ordinance shall not become effective or be in force until thirty (30) days from and after the date of its adoption.

Passed, approved, and adopted this 28 day of July, 2026.

Staff respectfully recommend that the City Council accept the work performed by Miramar General Engineering and order the recordation of the Notice of Completion for Acceptance and Notice of Completion for the Pedestrian Safety Improvement FY 2024-2025 Project (Phase 2), JN 545.

The first phase of the project consisted of analyzing and reviewing Maintenance District Zone 3 and various locations for sidewalk tripping hazards. Small displacements (trip hazards between 1/2" and 2-1/2") resulted in the cutting of the sidewalks, whereas the larger displacements were planned for remediation for phase two.

This project replaced approximately 6100 square feet of raised and damaged sidewalk, 270 linear feet of curb and gutter, replaced 2 curb ramps within the City's Maintenance District Zone 3 and various locations. Sufficient funds to complete this project were appropriated by the City Council during the fiscal year 2024-2025 Capital Improvement Budget using Measure M and SB 821 funds. Upon completion, 3% ($6,232.00) of the awarded contract ($213,260.80) were expended as part of the 20% ($43,000.00) contingency, and the remaining saving will be returned to the original funding sources.

ITEMS - PUBLIC WORKS
Meeting Date: July 28,
2026
TO: THE HONORABLE MAYOR AND MEMBERS OF THE GARDENA CITY COUNCIL AGENDA TITLE: Approve a Contract Change Order to the Engineering Staff Augmentation Services Agreement with DCCM Consultant, Inc., an Additional Amount not to Exceed $124,800.00 COUNCIL ACTION REQUIRED:

Staff Recommendation: Approve a Contract Change Order to the Engineering Staff Augmentation Services Agreement with DCCM Consultant Inc.

RECOMMENDATION AND STAFF SUMMARY:

The Public Works Engineering Division is responsible for delivering Capital Improvement Program (CIP) projects and overseeing all private improvements within the public right-of-way. During FY 2025-2026, the Division managed 42 CIP projects with a combined value of approximately $72 million. In addition, Engineering staff processed 483 plan check reviews and issued 591 encroachment permits during the previous fiscal year.

For FY 2026-2027, the Engineering Division is budgeted for six (6) Engineering positions: Public Works Director/City Engineer, Assistant Public Works Director/City Engineer, newly established Senior Civil Engineer, Civil Engineer, Associate Engineer, and Assistant Engineer. Of these six positions, three (3) are currently vacant, and recruitment is underway for the vacant positions.

In April 2026, the Engineering Division experienced an unexpected staffing shortage due to the extended unavailability of the Civil Engineer position. Subsequently, in May 2026, the Public Works Director/City Engineer position also became vacant. As a result, the Assistant Public Works Director/City Engineer has assumed the responsibilities of both vacant positions while continuing to perform the duties of his existing position.

To assist the Engineering Division during this staffing shortage, in June 2026, the City Manager authorized Engineering staff augmentation services from DCCM Consultants Inc. for an amount not to exceed $50,000. This authorization was necessary to address immediate staffing needs and ensure continued oversight of active CIP projects, particularly those with regional funding requirements.

To maintain continuity of project delivery, staff recommends extending the agreement with DCCM Consultants Inc. to continue providing temporary Engineering staff augmentation services. Consultant staff will assist with the delivery of CIP projects and other engineering duties, as needed, averaging approximately 20 hours per week.

Based on the anticipated level of services, the additional requested amount is estimated to provide approximately six (6) months of Engineering staff augmentation. The actual duration of the extension will depend on the number of service hours utilized and the timing of the transition of project responsibilities back to in-house staff.

The cost of the staff augmentation services will be funded through various FY 2026-2027 CIP project budgets.

Given the significant increase in CIP projects and the growing complexity of the projects, continued Engineering staff augmentation is essential to ensure compliance with funding requirements, facilitate a smooth transition of projects to newly hired City Engineering staff, and support the timely delivery of projects.

Staff recommends that the City Council approve a Contract Change Order to the Engineering Staff Augmentation Services Agreement with DCCM Consultants Inc. in an additional amount not to exceed $124,800.00.

FISCAL IMPACT/COST:

Amount of Contract Change Order Expense: $124,800
Funding Source: FY 2026-2027 Various CIP Projects (Regional Measure M, Measure R, Prop C, and State Earmarks)

PROJECT UNDERSTANDING
DCCM understands that the City is seeking a part -time Project Manager to manage several grant- funded Capital Improvement Projects. We understand the City’s goal is to work with an experienced and reliable consultant team with strong leadership and grant funding expertise, administration, and closure experience to support the City through October 2026 and beyond. We understand the projects are in various stages and listed below (provided by K. Kwak via email on 4/27/2026). • JN 930 – Vermont Avenue Traffic Signal Improvements (at RBB and Rosecrans) Project: This project has been delayed for an extended period due to the time required to obtain permits from the City of Los Angeles, as well as the funding agreement. The Metro Board approved the supplemental budget for the project in January 2025, and the city recently received the funding agreement on 4/24/2026 which requires City Council Action and approval. Design is nearly ready for bid package lead by Psomas and Iteris as the traffic sub.
• JN 565 – Citywide Traffic Signal & Network Upgrade Project: This is a new project, and the LA Metro Board approved the $1.8M design phase in September 2025. The City is currently in active communication with LA Metro staff as they prepare the funding agreement (FA).
• JN 560 Fiber Infrastructure Upgrade Project. This project will need to be managed and coordinated with JN 565, as they will have overlapping scope. • JN 945 – Redondo Beach Blvd Street Improvements: The project scope consists of improving traffic flow along RBB from Crenshaw Blvd to Vermont Ave (west to east city limits), including new medians, signal improvements, signing and striping, and rehabilitation of concrete and pavement, among other related work. The project is currently at 95% PS&E, led by Cannon. Cannon is also finalizing the full CEQA environmental study, which is expected to be completed within the next month or two. In August 2020, the LA Metro Board approved $5.5M in Measure M regional funds. The Board subsequently approved an additional $5.6M in September 2023, and the City is awaiting execution of the funding agreement.

We have successfully managed and completed similar projects, including grant -funded transportation improvement projects, bridge construction projects, intersection improvements, traffic signal synchronization projects, active transportation projects, ADA upgrades, and traffic signal improvements. Our goal is to be a true partner with the City, and we share your commitment to provide your residents, businesses, and visitors with the highest level of quality service to successfully deliver these projects.

Dear Mr. Kwak:

It is with great enthusiasm that DCCM submits this letter proposal to provide part-time project management services to assist the City with managing several priority projects. We fully understand the importance of high-level project management, and we are committed to assisting the City.

Peace of mind through each phase of your project: Our professionals have years of experience managing a wide variety of public works projects—from scoping to design to construction to closeout and commissioning. Our time-tested, proactive approach will serve to anticipate and expeditiously address challenges to keep the projects moving forward. PROJECT UNDERSTANDING
DCCM understands that the City is seeking a part-time Project Manager to manage several grant- funded Capital Improvement Projects.  JN 930 – Vermont Avenue Traffic Signal Improvements (at RBB and Rosecrans) Project: This project has been delayed for an extended period due to the time required to obtain permits from the City of Los Angeles, as well as the funding agreement. The Metro Board approved the supplemental budget for the project in January 2025, and the city recently received the funding agreement on 4/24/2026 which requires City Council Action and approval. Design is nearly ready for bid package lead by Psomas and Iteris as the traffic sub.
 JN 565 – Citywide Traffic Signal & Network Upgrade Project: This is a new project, and the LA Metro Board approved the $1.8M design phase in September 2025. The City is currently in active communication with LA Metro staff as they prepare the funding agreement (FA).
 JN 560 Fiber Infrastructure Upgrade Project. This project will need to be managed and coordinated with JN 565, as they will have overlapping scope.  JN 945 – Redondo Beach Blvd Street Improvements: The project scope consists of improving traffic flow along RBB from Crenshaw Blvd to Vermont Ave (west to east city limits), including new medians, signal improvements, signing and striping, and rehabilitation of concrete and pavement, among other related work.

We have successfully managed and completed similar projects, including grant-funded transportation improvement projects, bridge construction projects, intersection improvements, traffic signal synchronization projects, active transportation projects, ADA upgrades, and traffic signal improvements. Our goal is to be a true partner with the City, and we share your commitment to provide your residents, businesses, and visitors with the highest level of quality service to successfully deliver these projects.
