2 EXECUTIVE SUMMARY
A FY 2019-2020 Annual Action Plan Substantial Amendment for Community Development Block Grant (CDBG), Emergency Solutions Grant (ESG), and HOME Investment Partnerships Act (HOME) is required by the U.S. Housing and Urban Development Department (HUD) in order to reprogram CARES Act funding from one program to another.
Small Business Grant Program received $572,500 in CARES Act Round 1 funds (CDBG- CV1) as a business recovery measure administered through the Community Development Department – Economic Development Division to assist small businesses experiencing hardships due to the COVID-19 pandemic. A total of 63 businesses received grant funding totaling $315,000, with $257,500 being returned due to businesses being disqualified for not meeting the grant guidelines. Staff is proposing to reprogram returned CDBG-CV1 funding from the Small Business Grant Program in the amount of $257,500 to the Senior Nutrition/Services Program to serve an additional 59,060 meals to seniors through June 30, 2026, as demand for the Elderly Nutrition Program (ENP) continues to remain at current higher levels due to the pandemic.
The City contracts with Bateman Community Living, LLC dba Trio Community Meals to provide the senior meals. Bateman recently notified staff that the price of meals will be increasing by 10%, effective February 1, 2022. Thus, the City must also process Amendment Eight with Bateman Community Living, LLC dba Trio Community Meals, to increase the price per meal by 10% and add an additional $45,628, to provide the additional meals to seniors through the ENP, for a total contract price, including past and future increases, not to exceed $2,095,484.
COUNCIL PRIORITIES

The Housing Authority adopt the following:
1) The Motion approving the reprogramming of $257,500 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant–Coronavirus Round 1 (CDBG-CV1) funds received under the Coronavirus Aid, Relief, and Economic Security (CARES) Act of 2020, returned from the Small Business Grant Program, to the Senior Nutrition/Services Program, as recommended by the Director of Community Services and Parks; and authorizing submission of the FY 2019-2020 Annual Action Plan Substantial Amendment to HUD.
BACKGROUND
The Coronavirus Aid, Relief, and Economic Security Act (CARES Act) made available a total of $5 billion in Community Development Block Grant–Coronavirus (CDBG-CV) funds to be used, provided they follow the “PPR Tieback” to prevent, prepare for, and respond to coronavirus and to support additional activities to mitigate the impacts of COVID-19.
The funds were distributed to states and cities in various rounds. For CDBG-CV, the first $2 billion was allocated to entitlements (cities) based on the FY 2020 CDBG formula, $1 billion was allocated to states only, and the remaining $2 billon allocated to states and local governments. In total, the City of Glendale (City) received $2,790,867 in CDBG-CV funds through U.S. Department of Housing and Urban Development (HUD) in Round 1 and Round 3.
CDBG-CV1 (Round 1)
On April 2, 2020, HUD awarded the City Round 1 of CARES Act funding for CDBG (CDBG-CV1) in the amount of $1,175,049. On June 9, 2020, the City Council and Housing Authority adopted a motion approving FY 2019-2020 CDBG, ESG, and HOME Annual Action Plan Substantial Amendment for CDBG-CV1 to fund the following three City sponsored Public Social Services projects:
$572,500 for Rental Assistance Program
$572,500 for Small Business Grant Program
$ 30,049 for Senior Nutrition/Services Program

2 CDBG-CV2 (Round 2)
Round 2 of the CARES Act funding for CDBG (CDBG-CV2) was allocated to states and was not distributed to cities. Thus, the City did not get any funds from CDBG-CV2.
CDBG-CV3 (Round 3)
In September 2020, HUD awarded the City Round 3 of CARES Act funding for CDBG (CDBG-CV3) in the amount of $1,615,818. On December 15, 2020, the City Council and Housing Authority adopted a motion approving FY 2019-2020 CDBG, ESG, and HOME Annual Action Plan Substantial Amendment for CDBG-CV3 to fund the following three City sponsored Public Social Services projects:
$950,000 for Education Connection Program (Ed Camp)
$608,000 for Medical Point of Dispensing (MPOD)
$57,818 for Program Administration
Two of the City sponsored projects returned a total of $1,083,000 ($475,000 from Ed Camp and $608,000 from MPOD program) in CDBG-CV3 funds. On June 29, 2021, the City Council and Housing Authority approved reprogramming the returned funds to twelve (12) community agencies for various public social services programs totaling $1,083,000.
CDBG-CV funds are not limited to the 15% cap for public social services as traditional HUD entitlement requires. One of the flexibilities provided by HUD through the CARES Act is the elimination of the 15% cap, allowing cities the flexibility to spend more money on funding public social services to help address challenges facing the community related to COVID-19.
The CDBG-CV1 Small Business Grant Program received $572,500 as a business recovery measure administered through the Community Development Department – Economic Development Division to assist small businesses experiencing hardships due to the COVID-19 pandemic. Qualifying businesses were awarded a one-time payment of $5,000 to help pay for rent/mortgage, payroll, and/or other business expenses. The program was set up to assist up to 114 Glendale businesses as a layoff aversion to help small businesses who employ low income individuals and have no more than 25 employees working at their establishment. The selection of businesses was based on a computerized lottery system that was conducted in three rounds:
Round One- July 1 – 15, 2020
Round Two- November 2 – 6, 2020
Round Three-June 1 – 11, 2021.
Total applications submitted: 387
Total grants available: 114

2 Reasons for disqualifications included: previous federal funding received (duplication of benefits), 51% low income requirement not met, businesses not having a business registration certificate, businesses not being located in a commercial space, multiple grants being submitted by members of the same household, applicants not actually owning a business, and applicants not being responsive to multiple document verification requests. In subsequent rounds, some of the criteria was revised in order to make it easier for businesses to qualify for the grant, but staff encountered similar issues when attempting to verify eligibility. The biggest stumbling block was that as the pandemic continued, it became increasingly difficult to find individuals who had not previously received some sort of Federal funding.
The Community Services & Parks Department (CSP) has been providing meal service to seniors 60 years and older in the Greater Glendale area since 1979 with grant funding administered from County of Los Angeles Workforce Development, Aging and Community Services (WDACS) through the federal Older Americans Act. The Elderly Nutrition Program (ENP) provides an important opportunity for social contact and is the only meal many seniors receive in a day. When the pandemic started, seniors were the most vulnerable population and the most in need for services, especially nutrition services since they were not supposed to leave the house. Along with the additional County funds and Meals on Wheels grants, Council also allocated $30,049 in CDBG-CV1 funds to the Senior Nutrition/Services Program for COVID related direct assistance purchases, which included the following: Ice Coolers, 4 freezers to hold additional meals, cooling fans for seniors to use during summer months, meal storage containers, utensils, bags, and various supplies used for ENP. Currently the program has exhausted all available funding.
With the virus continuing to spread and positive cases continuing to rise, the pandemic does not seem to have an end in near and the demand for senior meals/services continues at the increased rates. Thus, staff is proposing to allocate the returned CDBG- CV1 funds to continue to provide additional senior meals.
ANALYSIS
Staff is recommending to reallocate the returned $257,500 in CDBG-CV1 funds from the Small Business Grant Program to the CDBG-CV1 Senior Nutrition/Services Program to help serve/deliver an additional 59,060 meals to seniors 60 years and older in the Elderly Nutrition Program’s (ENP) congregate and home delivered meals programs.
Traditionally, the ENP serves 40,000 meals to congregate clients (in-person dine-in) annually and 11,000 meals to home delivered meals clients annually to over 700 unduplicated seniors. Meals are served out of 3 congregate meal sites: Adult Recreation Center, Sparr Heights Community Center, and Pacific Community Center.
Since the onset of the pandemic on March 13, 2020, CSP has adjusted operations to pick-up or delivery only, no more in-person dining. CSP has been providing “Grab and Go” meal service 7 days per week from the Adult Recreation Center and 5 days per week from the Sparr Heights Community Center. Pacific Community Center will remain closed until LA COUNTY issues a reopening plan. Seniors unable to pick up daily “Grab and Go” meals have the option of picking up 7 frozen meals from the ARC once per week or get it delivered to their homes for seniors unable to pick-up in person. In addition, the traditional 7 of 16
61 3
0 5
2 Home Delivered Meals program offers weekly meal deliveries to seniors who are homebound due to physical and health ailments unrelated to COVID-19.
In the current FY 2021-2022, the City was awarded $425,578 in funding from WDACS for the ENP program. Currently, due to the increased demand, the ENP program is serving 126,000 meals to congregate clients annually and 15,000 meals to home delivered meal clients annually. This is an increase of 315% and 27%, respectively, from traditional levels. Last fiscal year the County provided additional funding to meet increased demand, but this fiscal year, the City has not yet received notice of additional funding being awarded, but the demand for meals has remained the same. The program is using remaining Meals on Wheels Round 1 funds and Meals on Wheels Go Further grant funds totaling $42,398 to provide meals through January 2022. If left unfunded, the ENP will cease to provide senior meal service from February 1, 2022 through June 30, 2022 until LA COUNTY WDACS informs the City of new funding for FY2022-2023.
As the demand for senior meals continues to remain at the higher levels and regular LA COUNTY WDACS funding has been exhausted, CARES Act funding used as gap funding to prevent, prepare for, and respond to coronavirus and to support additional activities to mitigate the impacts of COVID-19 is the only realistic alternative. Eligible costs incurred as a result of the pandemic can be charged to the CARES Act from March 2020. Staff is recommending reallocating the returned CARES Act funding in the amount of $257,500 to the CDBG-CV1 Senior Nutrition/Services Program through June 30, 2026. The CARES Act funds must be fully expended or returned to HUD by June 30, 2026.
The City has a catering contract for the ENP program with Bateman Community Living, LLC dba Trio Community Meals. The contract is from December 1, 2016 through November 30, 2022. Staff received a letter notifying the City that the price per meal unit rate will be increased by 10% on February 1, 2022 due to rising costs related to wages, food costs, gas, etc. The new fees for meals will be as follows:
Meal Type Current Price Per
Meal
New Price Per Meal –
Eff 2/1/2022
Hot Meals/Boxes Lunches Prepared $3.96 $4.36
Frozen, Home Delivered Meals $3.87 $4.26
The additional $257,500 would cover the cost of 59,060 meals. If approved, the additional CARES Act funding would allow the program to continue operating at the current level until June 30, 2022, assuming no additional funding is secured from another source. Staff is also requesting approval to increase the contract with Bateman Community Living, LLC dba Trio Community Meals by $45,628, for a total contract amount not to exceed $2,095,484.
If LA COUNTY WDACS should provide additional funding for the ENP program in the current fiscal year, then the CARES Act funding would be used in FY2022-2023 and possibly through 2026 as gap funding until the ENP program returns to pre-pandemic traditional meal service levels.

2 On December 1, 2021, LA COUNTY WDACS informed the City that due to the evolving situation around COVID-19, authorization to transition back to in-person dining is postponed until further notice. The transition to in-person dining has been delayed due to various factors, most importantly the vulnerability of the senior population served. The Grab 'N Go model is considered most effective option in safeguarding seniors.

As part of the Citizen Participation Plan, HUD requires the City to conduct a public hearing to receive public comment on the CDBG, ESG Home funding plan and publish funding recommendations. Due to the expedited nature of the CARES Act funding, HUD provided waivers reducing the comment period from 30 days to a 5-Day comment period. The City sent a Public Notice on January 13, 2022 to receive public comment until January 19, 2022. An opportunity to call in or email City Council on January 25, 2022 also meets the virtual public hearing requirement.
The revised FY 2019-2020 Annual Action Plan Substantial Amendment for CDBG, ESG, and HOME is available for review on the City of Glendale’s website at:

The additional funds will help serve meals to eligible seniors in our community.
FISCAL IMPACT
Funding in the amount of $257,500 will provide 59,060 meals to seniors 60 years and older in the Elderly Nutrition Program’s (ENP) congregate and home delivered meals programs by June 2026. Therefore, staff is requesting a resolution of appropriation shifting the unused portion of the CDBG-CV1 Small Business Grant Program funds in the amount of $257,500 to the CDBG-CV1 Senior Nutrition/Services Program. 2 on June 29, 2021 for the CDBG-CV CARES Act projects as part of the FY 2019-2020 Annual Action Plan Substantial Amendment CDBG, ESG and HOME programs. Because reallocating $257,500 in CDBG-CV1 funds returned from the Small Business Grant Program to the CDBG-CV1 Senior Nutrition/Services Program does not have a significant effect on the environment, the activity is not subject to CEQA.
