EXECUTIVE SUMMARY
The Fire Department Vegetation Management Program includes 9,667 parcels within the very high fire hazard area that receive an annual inspection. Of those, 609 are unimproved, vacant properties. The City has an agreement with Los Angeles County Agricultural Commissioner for weed abatement services on those unimproved properties.

The City Council annually reviews and approves the resolution declaring noxious weeds on unimproved properties can constitute a public nuisance in order to permit the County Agricultural Commissioner to work within the City. This action also sets a public hearing date to allow affected property owners to voice their concerns. 4 of 76

COUNCIL PRIORITIES
Safe and Healthy Community: Inspecting for and removing noxious weeds that present an actual or potential fire hazard within 100 feet of a structure will allow the City to be more prepared to prevent a destructive wildfire.

RECOMMENDATION
That the City Council approve the resolution declaring that certain noxious weeds located on property within City jurisdictional areas constitute a public nuisance; that the City intends to cause abatement; and that the City establish a public hearing date of March 22, 2022.

BACKGROUND
The City of Glendale has a five-year agreement (2017-2022) with the County of Los Angeles for weed abatement services. The Los Angeles County Agricultural Commissioner carries out the services. The Commissioner develops a list each year of properties in the City of Glendale that contain noxious weeds considered to be a public nuisance. All unimproved parcels in the city are inspected annually and placed on the list if they present an actual or potential fire hazard that is within 100 feet of a structure. This year’s list includes 609 properties. The list is submitted to the City along with a resolution, declaring the weeds a hazard and public nuisance. After passing the resolution, the County Agricultural Commissioner is thereby designated to act on behalf of the City to abate the hazards. The City is required to provide notice of the abatement action and the date which affected property owners may address concerns to the City Council. The notices will be mailed by the County at least ten days prior to March 8, 2022. By approving the resolution, the date of March 22, 2022 is set for a public hearing whereby property owners may be heard to voice their concerns regarding the Declaration List. This program is a part of the ongoing Vegetation Management Program administered by the Fire Department that includes a combination of hazard abatement conducted by private landowners, contractors, and the County Agricultural Commissioner’s Office. It is understood that all costs related to abatement will be charged to the property owner affected and will become a part of their tax liability.

The stakeholders include the owners of the 609 properties identified in the declaration list attached to the accompanying resolution. A notice will be mailed to the property owners informing them of the program.

ALTERNATIVES
Alternative 1: Private hazard abatement vendors may be contracted with by the City of Glendale to provide the aforementioned services. This alternative would require the City to assume the lead role in key program tasks including notification, inspection and cost recovery, thereby increasing the direct cost for the City.

Alternative 2: The City Council may consider any other alternative not proposed by staff.

CALIFORNIA DECLARING THAT WEEDS, BRUSH, RUBBISH, REFUSE,

AND DIRT UPON OR IN FRONT OF SPECIFIED PROPERTY IN THE CITY

ARE A SEASONAL AND RECURRENT PUBLIC NUISANCE, AND

DECLARING ITS INTENTION TO PROVIDE FOR THE ABATEMENT

THEREOF

THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA RESOLVES AS FOLLOWS:

Pursuant to the provisions of Title 4, Division 3, Part 2, Chapter 13, Article 2, of the California Government Code, Sections 39560 to 39588, inclusive, and evidence received by it, the City Council of the City of Glendale specifically finds:

SECTION 1. That the weeds, brush, or rubbish growing or existing upon the streets, sidewalks, or private property in the city attain such large growth as to become, when dry, a fire menace to adjacent improved property, or which are otherwise noxious or dangerous, or a public nuisance;
SECTION 2. That the presence of dry grass, stubble, refuse, or other flammable materials are conditions which endanger the public safety by creating a fire hazard; SECTION 3. That by reason of the foregoing fact, the weeds, brush, rubbish, or dry grass, stubble, refuse, or other flammable material growing or existing upon the private property hereinafter described, and upon the streets and sidewalks in front of said property constitute a seasonal and recurrent public nuisance and should be abated as such.

SECTION 4. That the private property, together with the streets and sidewalks in front of same herein referred to, is more particularly described as follows, to-wit: That certain property described in the attached list hereto and incorporated herein by this reference made a part hereof as though set forth in full at this point.

NOW THEREFORE BE IT RESOLVED that pursuant to the findings of fact, by this Council heretofore made, that the seeds or dry grass, stubble, refuse, or other flammable material in and upon and in front of the real property hereinbefore described constitute and are hereby declared to be a seasonal and recurrent public nuisance which should be abated.

The Agricultural Commissioner/Director of Weights and Measures, County of Los Angeles, is hereby designated the person to give notice to destroy said weeds or dry grass, stubble, refuse, or other flammable material and shall cause notices to be given to each property owner by United States Mail and said notice shall be substantially in the following form to-wit:

NOTICE TO DESTROY WEEDS,

REMOVE BRUSH, RUBBISH, REFUSE, AND DIRT
Notice is hereby given that on March 8, 2022, the City Council of the City of Glendale passed or will pass a resolution declaring noxious or dangerous weeds, brush, tumbleweeds, sagebrush, chaparral, rubbish, refuse, and dirt were growing or occurring upon or in front of said property of certain streets in said city or unincorporated area of the County of Los Angeles, and more particularly described in the resolution, and that they constitute a fire hazard or public nuisance which must be abated by the removal of said weeds, brush, tumbleweeds, sagebrush, chaparral, rubbish, refuse and dirt, otherwise they may be removed, and the nuisance abated by County authorities and the cost of removal assessed upon the land from or in front of which the weeds, brush, tumbleweeds, sagebrush, chaparral, rubbish, refuse and dirt are removed and such cost will constitute a special assessment against such lots or lands. In addition, the Board of Supervisors authorized and directed the Agricultural Commissioner to recover its costs of details. All property owners having any objections to the proposed removal of weeds, brush, rubbish, refuse and dirt, and the recovery of inspection costs, are hereby notified that they may attend a hearing of the City Council of said city to be held at 613 E. Broadway, Glendale, CA 91206-4393, in the Council Chambers on March 22, 2022 at 6:00 p.m. where their objections will be heard and given due consideration. If the property owner does not want to present objections to the proposed removal of the weeds, brush, tumbleweeds, sagebrush, chaparral, rubbish, refuse and dirt, or the recovery of inspection costs, the owner need not appear at the above mentioned hearings.

BE IT THEREFORE RESOLVED, that the Agricultural Commissioner is hereby authorized and directed to recover its costs of inspection of the properties hereinabove described in a manner consistent with prior action of the Board adopting a fee schedule for such inspections. The recovery of these costs is vital to the ongoing operation governing the identification and abatement of those properties that constitute a seasonal and recurrent public nuisance and endanger the public safety.

BE IT FURTHER RESOLVED that the 22nd day of March, 2021, at the hour of 6:00 p.m. of said day is the day and hour, and the Chambers of the City Council of the City of Glendale in the City Hall in the City of Glendale is fixed by this City Council as the place when and where any and all property owners having any objections to the aforesaid proposed removal of weeds or dry grass, stubble, refuse, or other flammable material may appear before the City Council and show cause why said weeds or dry grass, stubble, refuse, or other flammable material should not be removed in accordance with this resolution, and said objections will then and there be heard and given due consideration; and 8 of 76

BE IT FURTHER RESOLVED that the notices to destroy weeds or dry grass, stubble, refuse or other flammable material hereinbefore referred to shall be mailed by said Agricultural Commissioner/Director of Weights and Measures at least ten days prior to March 22, 2022.

Transmitted herewith is the Declaration List of properties which have been found by inspection to have weeds, brush and/or rubbish growing or occurring upon them and which constitute an existing or potential hazard to the health and safety of adjacent property owners.

EXECUTIVE SUMMARY
The scope of work for the Corporation Yard Exterior Painting Project, includes the materials, preparation, and application of a protective coating system to the entire exterior of the municipal structure at 541 W. Chevy Chase. The municipal structure is a 73,000 square feet single story, concrete building with rooftop parking deck. The current tenants include Public Works Street Maintenance, Public Works Fleet Services and Warehouse, and Community Services and Parks field services The structure was last painted over 18 years ago and is currently in need of a new protective coating. Maintaining the exterior surfaces of this facility is essential to maintaining the integrity of the structure and aesthetics of the overall property.

COUNCIL PRIORITIES
Infrastructures and Facilities: The Corporation Yard is primarily a concrete and masonry structure. Without protective coating, these materials deteriorate and the longevity of the structure is lessened.

RECOMMENDATION
Approve the Resolution Adopting Specification’s No. 3915 for the Corporation Yard Exterior Painting Project and directing the City Clerk to advertise for bids.

BACKGROUND
The Corporation Yard is located on 541 W. Chevy Chase Drive. The primary structure includes a rooftop parking deck and is the primary office and shops for Community Services and Parks and Public Works field divisions. Records show that the structure, which is concrete and masonry, was constructed circa 1960 and is located on a 6.5-acre property. Nearly 150 employees report to the Corporation Yard on a daily basis and field operations resources are stored and deployed from this site.

The process will consist of two phases; preparation and application. Prior to application of prime/finish exterior coating systems, the contractor will provide a clean, sound surface free of dust, dirt containments, mildew and efflorescence by use of a power wash and scraping by hand and/or machine. The application will require two coats of special primer and paint; however, additional coats shall be applied as needed to produce satisfactory finish results. The exterior paint on a facility such as the Public Works Corporation Yard is expected to last up to 15 years with proper maintenance, including building washing and touch-ups.

STAKEHOLDERS/OUTREACH
The Corporation Yard is the hub of Public Works and Community Services and Parks field operations. While the onsite administration office is open to the public, most requests for services are received via telephone or online. The Project Manager will work with onsite staff to minimize any interruptions to municipal operations. In terms of outreach, staff will utilize the City’s website, eBidBoard, issue a press release and directly invite potential vendors in order to obtain as many bids as possible for this project.

FISCAL IMPACT
The original budget and engineer’s estimate for the Corporation Yard Exterior Painting Project is $250,000. Due to inflation and other economic factors, staff believes the cost of this project may exceed $300,000. Following the competitive bidding process, and depending on the bid results, staff may return to Council with a resolution of appropriation to cover any funding shortfall.

BACKGROUND
Since March of 2020, because of the COVID-19 pandemic, the Council and all boards and commissions have been meeting remotely pursuant to the Governor's Executive Order N-29-20, which suspended certain teleconference meeting requirements of the Brown Act. On June 11, 2021, the Governor issued Executive Order N-08-21, which rescinds these suspensions effective September 30, 2021. In recognition of the fact that the pandemic is ongoing, on September 16, 2021, the Governor signed AB 361, which amends the Brown Act and authorizes teleconferenced public meetings at remote locations under a state of emergency declared by the Governor under the Emergency Services Act. The Council adopted resolutions on October 19, 2021, November 16 2021, December 14, 2021, January 11, 2022 and February 8, 2022 allowing continued remote teleconference meetings under A.B. 361 for a period of 30 days.

ANALYSIS
AB 361 allows local agencies to continue having remote teleconference meetings when the Governor has declared and a state of emergency, if the local agency can make certain findings and complies with several procedural safeguards to protect public participation during a remote meeting. The public must have the ability to address the legislative body directly, and must be given information on how to address the body. The public must be provided either a call-in or internet-based service option. The body must stop the meeting if the call-in or internet-based option fails. The legislative body cannot require that public comments be submitted in advance (although this can be provided as an option).

Speakers cannot be required to pre-register (except as required by an independent call- in or internet platform). Members of the public must be given a reasonable time to register to provide public comment.

Accordingly, the Council adopted resolutions on October 19, 2021, November 16, 2021 December 14, 2021, January 11, 2022, and February 8, 2022 to authorize the Council and all boards, commissions, and committees, including ad hoc committees subject to the Brown Act, to continue to be able to meet remotely during the current declared state of emergency for a period of 30 days. In adopting the resolutions, the Council found that state or local health measures continue to promote social distancing by state or local officials. With the recent surge caused by the Omicron variant, there is a need to continue remote teleconference meetings under AB 361. To continue remote teleconference meetings, the Council must confirm the circumstances of the state of emergency and make the required findings every 30 days. A proposed resolution is presented for Council consideration.

CALIFORNIA AUTHORIZING CONTINUED REMOTE TELECONFERENCE

MEETINGS OF ALL CITY OF GLENDALE LEGISLATIVE BODIES
FOR AN ADDITIONAL THIRTY DAYS IN ACCORDANCE WITH AB 361 WHEREAS, the Council of the City of Glendale is committed to preserving and fostering public access and participation in meetings of the Council, and all City of Glendale “legislative bodies” as required by the Ralph M. Brown Act (Cal. Gov. Code §§ 54950 – 54963), so that any member of the public may attend and participate as the bodies conduct the public’s business; and
WHEREAS, the Brown Act, as amended by Assembly Bill No. 361 (“AB 361”), makes special provisions for remote teleconferencing participation in meetings when the Governor has declared a state of emergency pursuant to Government Code section 8625, and either state or local officials have imposed or recommended measures to promote social distancing, or the state of emergency directly impacts the ability of legislative body members to meet safely in person; and
WHEREAS, such conditions now exist in the City of Glendale. Specifically, on March 4, 2020, Governor Gavin Newsom issued a Proclamation of a State of Emergency with regard to the COVID-19 pandemic (“State of Emergency”). Los Angeles County Health Officer has issued numerous Health Orders regarding safety protocols during the COVID-19 pandemic, most recently dated September 28, 2021.

Pasadena’s Health Officer has also issued numerous Health Orders regarding safety protocols during the COVID-19 pandemic, including a June 14, 2021 Order To Comply With California Department Of Public Health Guidance For The Use Of Face Coverings 47 of 76

These latest orders were made necessary by the rise in the more contagious and easily spread Delta variant of the COVID-19 virus throughout the nation, and specifically in the Los Angeles County region. State and local health orders also continue to promote social distancing and outdoor activity to the extent feasible; and
WHEREAS, the Council finds that the current situation with regard to COVID-19, and particularly the Delta and Omicron variants, is causing, and will continue to cause, risks to the safety of persons within the City of Glendale and finds that the Council and all City of Glendale legislative bodies, including the Council, Successor Agency, Housing Authority, all boards, commissions and committees, and all legislative bodies established by the Council shall conduct their meetings with remote participation in the manner authorized by Government Code § 54953(e), and such legislative bodies shall comply with the requirements to provide the public with access to the meetings as prescribed in Government Code § 54953(e)(2);
WHEREAS, the Council adopted resolutions on October 19, 2021, November 16, 2021, December 14, 2021 January 11, 2022, and February 8, 2022 making the findings set forth above and authorizing remote teleconference meetings for the Council and the City’s boards, commissions and committees in accordance with AB 361 for a period of 30 days.

C. State and local officials continue to recommend measures to promote social distancing.

Section 2. Remote Teleconference Meetings. The Council and all City of Glendale legislative bodies, including the Council, Successor Agency, Housing Authority, all boards, commissions and committees, and all legislative bodies established by the Council, shall conduct their meetings with remote participation in the manner authorized by Government Code § 54953(e), and such legislative bodies shall comply with the requirements to provide the public with access to the meetings as prescribed in Government Code § 54953(e)(2).

Section 3. Effective Date of Resolution. This Resolution shall take effect immediately upon its adoption and shall be effective until the earlier of April 7, 2022, or such time as the Council adopts a subsequent resolution in accordance with Government Code § 54953(e)(3) to extend the time during which meetings may continue to be held remotely by teleconference in compliance with that section. 49 of 76

COUNCIL PRIORITIES
Safe & Healthy Community: Properly set speed limits provide a safe, consistent, and reasonable speed to protect drivers, pedestrians, and bicyclists along the roadway.

Speed limits are put in place to notify drivers to the maximum speed that they are permitted to travel on the roadway. Speed limits are designed to enhance safety by reducing the risks created by drivers selecting the speed they wish to drive.

RECOMMENDATION

BACKGROUND
Speed limits are set in accordance to the guidelines outlined in the California Manual on Uniform Traffic Control Devices (CAMUTCD) and California Vehicle Code (CVC).

An E&TS is required to set and enforce the legal speed limit on roads where the prima facie speed may not apply, typically on streets wider than 40 feet.

The E&TS measures prevailing vehicular speeds and establishes the speed limit at or near the 85 th percentile speed that statistically represents one standard deviation above the average speed and establishes the upper limit of what is considered reasonable and prudent.

The CAMUTCD specifies that when a speed limit is to be posted, it shall be established at the nearest 5 mph increment of the 85th-percentile speed of free-flowing traffic.

However, it does allow for two options as described below:

1. The posted speed may be reduced by 5 mph from the nearest 5 mph increment of the 85th-percentile speed, in compliance with California Vehicle Code (CVC) Sections 627 and 22358.5. This allowance is for safety-related factors such as accident data, highway, traffic and roadway conditions that are not readily apparent to drivers, residential density, and pedestrian and bicycle safety.

2. For cases in which the nearest 5 mph increment of the 85th-percentile speed would require a rounding up, then the speed limit may be rounded down to the nearest 5 mph increment below the 85th percentile speed, if no further reduction is used. Refer to CVC Section 21400(b). These could apply in cases where there is not a direct nexus to pedestrian or motorist safety related concerns, but there are other concerns such as equestrian safety.

As specified in CVC Section 40802, prima facie speed limits are provided by this code or by local ordinance. City of Glendale Municipal Code 10.24.020 provides ordinances:

Ord. 5367 § 1, 2003; Ord. 5298, 2001; and prior code §§ 27-64—67-70 that define the prima facie speed limits set by local ordinance within City of Glendale. The city is required to conduct E&TS every seven or up to fourteen years, depending on changes in roadway or traffic conditions, land use, roadway width, or traffic volume. Any changes in speed limits require an amendment to the respective local ordinance(s) outlined above.

A typical E&TS is shown in Exhibit A. The survey shows recorded speed data, historical collision data, and traffic volume. It may also include roadway configuration and conditions that may affect the traffic speed or safety.

ANALYSIS
There are 95 roadway segments in the City of Glendale that require E&TS for speed enforcement. 63 E&TS were scheduled to lapse in 2020 and were surveyed to confirm that the existing speed limits were in conformance with the CVC, CAMUTCD and existing local ordinance. The majority of the E&TS remained the same 85th percentile speed as previous surveys; however, the 85 th percentile speed on nine streets were lower than the previous E&TS and must be amended by ordinance to allow speed enforcement by radar or laser.

In addition, three street segments that were previously surveyed in 2013 and 2015, and inadvertently not updated in the last ordinance amendment, has also been included in this ordinance amendment.

The proposed ordinance shows roadway segments that are recommended to be changed based on the latest E&TS studies. Those roadway segments are:

1. Broadway between Central Ave and Glendale Ave. The new E&TS changes the speed limit from 35 mph to 30 mph.

2. Broadway between Glendale Ave and Wilson Ave. The new E&TS changes the speed limit from 35 mph to 30 mph.

4. Chevy Chase Dr between Leith Rd (W) and Charing Cross Rd. The new E&TS changes the speed limit from 30 mph to 25 mph.

5. Concord St between Broadway and Doran. The new E&TS changes the speed limit from 30 mph to 25 mph.

6. Lowell Ave, between Foothill Blvd and Santa Carlotta St. The new E&TS changes the speed limit from 30 mph to 25 mph.

7. Montrose Ave between Raymond Ave and Ramsdell Ave. The new E&TS changes the speed limit from 35 mph to 30 mph.

8. Oceanview Blvd between Verdugo Rd and N City Limits. The new E&TS changes the speed limit from 35 mph to 30 mph.

9.Verdugo Rd between La Crescenta Ave and Honolulu Ave. The new E&TS changes the speed limit from 40 mph to 35 mph.

STAKEHOLDERS/OUTREACH
On October 25, 2021, the Glendale Transportation and Parking Commission (TPC) had a public meeting to discuss the proposed posted speed limit changes. There was no public opposition and the TPC approved a motion recommending the City Council to adopt an ordinance amending Glendale Municipal Code Section 10.24.020, as shown on Exhibit B.

The Public Works Department will coordinate with the Glendale Police Department – Traffic Bureau for the proposed posted speed limit changes.

FISCAL IMPACT
There will be a one-time estimated cost of $6,000 to purchase and install 38 new speed limit signs, which was approved as a part of the FY 2021-22 budget. No new appropriation is being requested at this time. The City Council approved funding is outlined below:

WHEREAS, Title 10 of the Glendale Municipal Code, 1995, provides standards and statutes for Vehicle and Traffic regulations within the City of Glendale; WHEREAS, such standards include prima facie speed limits on non-local city streets under section 10.24.020;
WHEREAS, based on the standards of the California Manual on Uniform Traffic Control Devices and the California Vehicle Code, a number of street segments within the City of Glendale are candidates for changes in their prima facie speed limits based on recent Engineering and Traffic Surveys;
WHEREAS, the changes in this ordinance are consistent with those goals and in the best interest of the City of Glendale;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA, DOES ORDAIN AS FOLLOWS:

SECTION 1. Recitals. The City Council finds that all of the facts, findings, and conclusions set forth above in this Ordinance are true and correct and hereby incorporate them by this reference.

SECTION 2. Section 10.24.020 of the Glendale Municipal Code, 1995, is amended to read as follows:

10.24.020 Prima facie speed limits on non-local city streets.

A. It is determined that upon the basis of an engineering and traffic survey that a speed limit greater than twenty-five (25) miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon the following non- local city streets, other than state highways, which streets would otherwise be subject to a prima facie speed limit permitted by state law of twenty-five (25) miles per hour and maximum speed limit of sixty-five (65) miles per hour. Upon the erection of appropriate signs giving notice thereof on streets or parts of streets, the prima facie speed limits shall be as set forth herein. This section does not apply to any twenty-five (25) mile per hour prima facie limit which is applicable when passing a school building or the grounds thereof or when passing a senior center or other facility primarily used by senior citizens. 56 of 76

EXECUTIVE SUMMARY
The Community Services & Parks (CSP) Department is seeking direction from Council on whether the City should authorize the installation of a Filipino American Friendship Monument, by the Filipino American Business Association of Glendale-Greater Los Angeles County (FABAG-GLAC), adjacent to the Adult Recreation Center at Central Park. This would be a temporary installation until the construction of the newly master planned Central Park is completed, at which time, the monument will be relocated to the Sister Cities Plaza in the park. FABAG-GLAC will pay all costs associated with fabrication, installation and future relocation. Ongoing routine maintenance costs of the monument, will be the responsibility of the City and FABAG-GLAC will be responsible for the cost of more extreme maintenance needs and repairs beyond that.

Arts & Culture: The monument celebrates the community’s diverse cultures, values, and heritage, in alignment with the City Council’s support of Arts and Culture in the community.

BACKGROUND
The Filipino American Business Association of Glendale-Greater Los Angeles County (FABAG-GLAC), proposes to install a Filipino-American Friendship Monument at the Adult Recreation Center (ARC), located at 201 E. Colorado Street. The proposed temporary location is on the north side of the ARC building, near the main entry. Once the Sister Cities Plaza at Central Park project has been completed, FABAG-GLAC proposes to relocate the monument to the Plaza without cost to the city. FABAG-GLAC will fund the initial fabrication, installation, and eventual relocation of the monument.

FABAG-GLAC will also provide for continued maintenance of the monument above and beyond basic maintenance provided by the City.

The monument is proposed to be constructed of black granite or other suitable stone and be approximately five feet tall, by four feet wide (Exhibit 1). It would rest on a plinth of the same type of stone. The face of the monument is proposed to display a pair of hands clasped in friendship, and memorialize the thirty-first anniversary of FABAG-GLAC’s founding. It would also display the names of the City of Glendale and FABAG-GLAC officials. On either side of the monument, would be flag holders for the display of the Philippine and American flags during future ceremonies to be held at the monument site.

FABAG was organized in September 1990 under the Cultural Exchange Committee of the Glendale Chamber of Commerce. Mary Hamilton, then President of the Glendale Chamber of Commerce, helped found the organization at the Glendale Chamber of Commerce Headquarters. It was Hamilton’s vision, that in order to improve intercultural relations among the many ethnic communities within the City of Glendale, the Chamber of Commerce needed to reach out to the diverse communities.

On July 16, 2021, FABAG-GLAC held its Installation of 2021-2022 Officers and Executive Board Members with President Jo Solomonson taking on a second term, with Mayor Paula Devine as Installing Officer at the residence of former President Edith M.

Fuentes. Fundraisings for the Friendship Monument continue on. Virtual meetings with City Officials and staff regarding the monument are ongoing.

ANALYSIS
Staff finds the request from the FABAG-GLAC) to be in line with the intent of the Sister Cities Plaza in Central Park as the ideal location for monument installation. FABAG- GLAC hopes that this Monument will symbolize their lasting Friendship with everyone and their wish to Cooperate, Communicate, and Collaborate with all and hopefully making this dream project a reality.

Furthermore, the proposed monument is consistent with the City’s Public Monument Policy, which the Council adopted by Resolution, No. 22-30, on March 1, 2022. This monument has an identifiable connection to the cultural makeup of the City by 65 of 76

acknowledging the involvement and contributions of Filipino Americans to the City of Glendale through:
The advancement of quality of life; civic pride and community involvement; diversity, equity, and inclusion; and culture and heritage; and The relief of those in need, particularly veterans.

In order for the installation of the monument to move forward, FABAG-GLAC will need to comply with all of the requirements and conditions of the City’s Public Monument Policy, except that the monument will not have to undergo review by the Arts and Culture Commission, as allowed by Section 2 of the Resolution. On November 15, 2021, the Parks, Recreation and Community Services Commission reviewed the proposal and recommended that the Council approve the monument’s installation.

FABAG-GLAC will also need to enter into a written agreement with the City and provide financial security in the form of deposited funds, an irrevocable letter of credit or secure a performance bond in order to guarantee the organization’s performance of the obligations under the agreement and the City’s monument policy.

Ongoing routine maintenance costs of the monument will be the responsibility of the City, including debris clearance, litter control, weed abatement and graffiti removal. FABAG- GLAC will be responsible for the cost of repairs, restorations, and maintenance above and beyond the City’s obligations.

This monument meets or satisfies the City’s Public Monument Policy criteria and requirements in the following manner:

1. Appropriateness: The high quality polished stone construction of the monument will ensure a durable and long lasting tribute to Glendale’s Filipino American community. Additionally, the monument is sensitive to social, historical, and other relevant contexts, and is suitable for individuals of all ages.

2. Compatibility: The scale and design of the monument is compatible with the temporary location near the Adult Recreation Center and the future, permanent location in Central Park.

3. Impact on Use of Public Space: The temporary and future permanent locations of the monument will not negatively impact existing park rights-of-ways, as it will be temporarily located in a turf area beside the Adult Recreation Center entry, and the future permanent location, will be in the planned site for the sister cities and other monuments.

4. Aesthetics: The monument will be constructed of high quality, polished stone, with a height and width of appropriate scale for the planned location of the piece.

5. Maintenance and Insurance: The organization will enter into a written agreement with the City and provide financial security in the form of deposited funds, an irrevocable letter of credit, or secure a performance bond in order to guarantee the organization’s performance of the obligations under the agreement and the City’s monument policy.

6. Safety: The design of the monument is a traditional vertical slab sitting on a rectangular base with no overhangs or projections and thus, presents no obvious safety hazards to park patrons.

SYMBOLISM AND PURPOSE OF THE MONUMENT
The monument is:

A TRIBUTE – Remembering and in Honor of a strong and dedicated leader not only in Glendale, but in LA County, RUBY DE VERA. She was one of the founders and past Presidents of FABAG who dedicated her life to community service and helping the veterans. This monument will also be a tribute to other departed past members.

A COMMEMORATION – This monument will be part of Filipino-American History in Los Angeles County. It will serve to commemorate FABAG’s more than 30+ years of community service and collaboration with the City of Glendale, businesses and inter- cultural relations with other groups and organizations throughout LA County.

IN GRATITUDE AND FRIENDSHIP – To the City of Glendale for its many years of unwavering help and support to FABAG-GLAC. To the residents of Glendale who have warmly welcomed FABAG-GLAC and to this day fully embracing their heritage and culture, and to the adjacent communities for helping them maintain their highest levels of service, trust and integrity.

FISCAL IMPACT
FABAG-GLAC will fund the initial fabrication, installation, and eventual relocation of the monument. The City will be responsible for the cost of routine maintenance. COUNCIL PRIORITIES
Informed and Engaged Community: The City Clerk’s Office plays a vital role in informing and engaging the community, including by coordinating Council agenda information, coordinating responses to Public Records Act requests, and providing information to the public. The Clerk’s Office also has an essential function of administering Glendale elections in coordination with Los Angeles County.

Fiscal Responsibility: An effective City Clerk’s operation serves the City’s fiscal interests by ensuring the City’s legal requirements related to elections, public records act requests, and compliance with the Brown Act are satisfied in a timely manner.

BACKGROUND
At the February 8, 2022 City Council meeting, Councilmember Agajanian requested a report regarding the potential to make the elected City Clerk position a part-time or “ceremonial” position, while at the same time creating a professional, appointed Assistant City Clerk position. Councilmember Agajanian also requested a discussion of an adjustment of the City Clerk salary that would reflect a part-time or ceremonial position.

ANALYSIS
The City Clerk is the Custodian of Records for the City of Glendale. The City Clerk is also the City's Election Official responsible for administering all General Municipal and Special Elections in conjunction with Los Angeles County. The City Clerk's primary responsibilities include: coordinating and preparing City Council and Housing Authority agenda packets: accurately recording the actions and proceedings of City Council and Housing Authority meetings; administering the City's Records Management Program and coordinating responses to Public Records Act requests; maintaining and updating the Municipal Code; administering regulations relating to the Fair Political Practices Commission, and; researching and providing information to the public and City personnel. A current directory of City Boards & Commissions, their vacancies, and the regular meeting dates, is also maintained by the City Clerk's office.

Consistent with the above, Article VI, Section 19 of the City Charter specifies the duties of the City Clerk as follows:
“Sec. 19. Duties of city clerk.

The city clerk shall:
(a) Attend all meetings of the council.
(b) Be responsible for recording and maintaining a full and true record of all the proceedings of the council.
(c) Maintain a permanent record of all ordinances and resolutions adopted by the council, including the certificate of the clerk stating that such document was duly adopted by the council with the date of adoption and, with respect to an ordinance, that it has been published in accordance with this Charter; all said records shall be properly indexed and open to public inspection when not in actual use.
(d) Maintain a permanent record of all written contracts and official bonds.
(e) Be custodian of the seal of the city.

(f) Administer oaths or affirmations, take affidavits and depositions pertaining to the affairs and business of the city, and certify copies of official records.
(g) Conduct all city elections.
(h) Perform such other duties connected with the office as may be prescribed by the council.”
Ceremonial/Part-Time City Clerk and Full-Time Professional Assistant City Clerk The City Clerk position is an elected position and is an officer of the City. The Council, as the legislative body of the City, is authorized to establish the salary of elected and appointed officers, including the City Clerk. The Council may also establish subordinate positions in any City department and establish the salary for such positions. City Charter, Article IV, §1. Thus, the Council has the legal authority to set the salary and staffing of the City Clerk, so long as such requirements do not interfere with the City Clerk’s Charter-prescribed duties.

The Council may establish an Assistant City Clerk position and authorize it by appropriation. Indeed, the City has a full-time Assistant City Clerk classification that has been vacant for a number of years. The Council could re-authorize the position by budget appropriation. The Assistant City Clerk position could be required to obtain and maintain requisite City Clerk training and certifications, such as the Certified Municipal Clerk (CMC) and Master Municipal Clerk (MMC) certification programs of the International Institute of Municipal Clerks.

Glendale’s neighboring cities, Pasadena and Burbank, employ an Assistant City Clerk although both of those City Clerk positions are full-time, salaried positions. Pasadena’s City Clerk is appointed by the City Council while Burbank’s City Clerk is an elected position. Staff performed a survey of other cities in the region. While most cities have a full-time salaried City Clerk, the cities of San Gabriel and Carson employ a model of a “ceremonial” or part-time elected City Clerk, with an Assistant or Chief Deputy City Clerk responsible for managing the day-to-day operations of the City Clerk’s office. In San Gabriel, the City Clerk is more of a “ceremonial” position, authorized to execute documents and perform oaths. In Glendale, a part-time elected Clerk position would still have ultimate decision-making authority over the matters set forth in the Charter, but the Council has the authority to establish positions in the Clerk’s office that would handle the day-to-day operations. The City Manager also has authority under the City Charter to appoint individuals to any department in the City, including the City Clerk’s Office.

Consideration of Salary Adjustment
The Council is authorized to establish salaries of all officers and employees of the City, including the City Clerk. If the Council desires to establish the hours and working conditions of the City Clerk position as a part-time position and assign day-to-day operations to the Assistant City Clerk position (subject to the authority of the Civil Service Commission to approve class specifications), the Council can establish a reduced salary for that position. The current salary of the City Clerk is $10,000 per month. Adjustments to the salaries or benefits of elected officials during their current term, except by a vote of the people, is likely impermissible.

FISCAL IMPACT
This report is to seek direction on options for future analysis and discussion regarding the management and operation of the City Clerk’s office. If the Council directs the re- establishment and funding of an Assistant City Clerk position (or similar management position), there will be a fiscal impact associated with that position as well as a potential reduction in costs associated with a reduction in the City Clerk’s salary if the Council chooses to move forward with such a reduction. Other fiscal impacts will be addressed in subsequent reports to Council.
