RECOMMENDATION
That the Council designate City Manager, Director of Finance & Information Technology and Deputy Director of Finance as the authorized representatives to apply and obtain disaster assistance from FEMA and Cal OES when major disasters strike.

BACKGROUND
The City applies for assistance from FEMA and Cal OES when major disasters strike.

FEMA administers federal disaster assistance programs, and Cal OES administer state disaster assistance programs. A designation of the City of Glendale’s authorized agents is required to be on file with Cal OES to be eligible to receive funding. According to the instruction of Cal OES form 130, a new designation of the City’s agents via Council resolution is required if the previously submitted document is older than three years from the last date of Council approval, is invalid or has not been submitted.

The last Glendale resolution approved by Council was dated June 8, 2021, and authorized City Manager, Director of Finance and Deputy Director of Finance to engage with FEMA and Cal OES. Due to the retirement of the prior Finance Director and appointment of a new Director of Finance & Information Technology in 2022, and the recent proclamation of the local emergency for winter storms in Glendale, a new designation is required now. By approving the attached resolution, the City Council designates the following individuals to be the City’s representatives to FEMA and Cal OES: City Manager Roubik Golanian, Director of Finance & Information Technology Jason Bradford, and Deputy Director of Finance Shu-Jun Li.

Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted.

When completing the Cal OES F
orm 130, Applicants should fill in the blanks on pages 1 and 2. The blanks are to be filled in as follows:

Resolution Section:

Governing Body: This is the group resp
onsible for appointing and approving the
Authorized Agents.

Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.

Name of Applicant: The public entity establis
hed under the laws of the
State of California.

Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.

Authorized Agent: These are the individuals th
at are authorized by the Governing Body
to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Services regarding grants for which they have applied.

There are two ways of completing this section:

1. Titles Only: The titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by either a cover letter naming the Authorized Agents by name and title, or the Cal OES AA Names document. The supporting document can be completed by any authorized person within the Agency (e.g., administrative assistant, the Authorized Agent, secretary to the Director). It d
oes not require the Governing Body’s signature.

2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document, or their title changes.

Checking Universal or Disaster-Specific Box: A Universal resolution is effective for all past disasters and for those declared up to three (3) years following the date of approval. Upon expiration it is no longer effective for new disasters, but it remains in effect for disasters declared prior to expiration. It remains effective until the disaster goes through closeout unless it is superseded by a newer resolution.

Governing Body Representative: These are the names and titles of the approving Board Members.

Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. A minimum of three (3) approving board members must be listed. If less than three are present, meeting minutes must be attached in order to verify a quorum was met.

Certification Section:

Name and Title: This is the individual in attendance who recorded the creation and approval of this resolution.

Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member. If a person holds two positions (such as City Manager and Secretary to the Board) and the City Manager is to be listed as an Authorized Agent, then that person could sign the document as Secretary to the Board (not City Manager) to eliminate “Self-Certification.”

COUNCIL PRIORITIES
Infrastructure: This project will deliver a Broadband Strategy which details components including how and when the City of Glendale will deploy communal initiatives for better quality broadband access.

RECOMMENDATION
Information Technology recommends that the City Council approve the Motion accepting $497,638 in Local Agency Technical Assistance grant funds and adopt a Resolution of appropriation for those funds.

BACKGROUND
COVID-19 highlighted the persistent lack of broadband access facing many communities throughout California and the nation. In an effort to close the digital divide, the state legislature passed AB/SB 156 and on July 20, 2021, Governor Newsom signed the bill into law.

At $6 billion ($5.2 billion from federal dollars), AB/SB 156 is the largest public broadband infrastructure investment in the country. Supported by extensive research, the bill prioritizes the construction of broadband networks in unserved areas, as well as those with lower speeds unconducive to education, commerce, and video conferencing.

Specifically, AB/SB 156 provides:
• $2 billion for last-mile broadband infrastructure, which will increase connectivity and affordability for underserved and unserved rural and urban communities • $3.25 billion for a statewide, open-access, middle-mile network, an essential first step that will make it easier for internet providers to provide faster, cheaper service throughout the state
• $750 million to establish a new loan loss reserve account to provide collateral (and better borrowing terms and terms) to local governments issuing bonds for municipal broadband deployment
• Several important reforms to the California Advanced Services Fund (CASF) program to help make sure the funds are spent quickly and efficiently where needed most. • Important accountability and oversight provisions, including a nine-member council with broad representation
Local Agency Technical Assistance grants support tribes and local agencies in their efforts to expand broadband service to unserved and underserved Californians.

Established by the CPUC according to Senate Bill 156, the program has a $50 million budget for grants including a $5 million set-aside for tribes. Technical assistance funding is for planning work that will facilitate high-speed broadband infrastructure projects. Funds will reimburse pre-construction expenses to provide broadband connections to unserved and underserved areas. Examples of expenses that may be reimbursed:
• Consultant or staff time for environmental studies, network design, engineering studies, needs assessments, and broadband strategic plans. • Costs incurred in forming a joint powers authority for bringing broadband to communities in need.

ANALYSIS
On November 30, 2022, the City of Glendale submitted a Local Agency Technical Assistance Application to the California Public Utilities Commission requesting $497,638 of grant funds. Utilizing a ministerial review process, awards to qualifying local agencies and tribal governments in amounts not to exceed $500,000 per local agency or tribal government, per fiscal year are allowed. Grant requests that would cause an applicant to exceed $500,000 in technical assistance, if authorized, may be approved by Commission resolution, up to $1 million, per local agency, per fiscal year.

As of December 31, 2022, seven (7) municipalities in Los Angeles County had submitted LATA grant applications. Amongst these, the average request is $336,437. At $497,638, Glendale’s LATA request is the largest amongst the municipalities. The following table provides a summary comparison of LATA grant applications submitted by Glendale along with other municipalities in Los Angeles County:

Application
Submission
Cycle
Status Applicant Funding
Requested
September 2022 Awarded City of Lancaster $ 339,920
September 2022 Awarded City of Los Angeles Bureau of Street Lighting $ 150,000 September 2022 Awarded City of Palmdale $ 325,000
October 2022 In Review City of Pasadena $ 325,000
October 2022 In Review City of Pomona $ 315,000
November 2022 Awarded City of Glendale $ 497,638
November 2022 In Review City of Monrovia $ 402,500
To qualify for the grant award, staff reviewed the grant program eligibility criteria as defined in the “Local Agency Technical Assistance Grant Program - Grantee Administrative Manual”. Grant program eligibility criteria is comprised of the following three (3) categories:

A. Who is Eligible to Apply
B. What is Eligible for Funding
C. Areas Eligible for Funding
A determination was made that the City of Glendale met the following “Who is Eligible to Apply” criterion as delineated in the Grantee Administrative Manual:

A.Who is Eligible to Apply
For the purpose of this program, local agency has the same meaning as that provided in Government Code section 53167 (e), as amended by SB 156, wherein “local agency” means any agency of local government authorized by law to provide broadband internet access service, including the following:
•A city
•A county, including a county service area
14 of 97

44b
3 9
9 0
•A community services district
•A public utility district
•A municipal utility district
•A joint powers authority
•A local educational agency, as defined in section 47640 of the Education Code
•A sovereign tribal government
•An electrical cooperative, as defined in section 2776 of the Public Utilities Code
Additionally, staff reviewed the following “What is Eligible for Funding” criteria as delineated in the Grantee Administrative Manual and determined that the associated project being considered for proposal would indeed meet the requirements of the program:

B.What is Eligible for Funding
Technical assistance grants must support developing broadband service to unserved communities. Technical assistance projects may include but are not limited to:
• Environmental, feasibility, engineering design studies or reports • Needs assessments, market studies, broadband strategic plans, business plans
• Forming a joint powers authority
• Consultant and community-based organization services
Subsequently, staff reviewed the “Areas Eligible for Funding” criteria as indicated in the Grantee Administrative Manual and determined that the associated project area being considered for proposal would indeed meet the requirements of the program:

C.Areas Eligible for Funding
Applicants must provide a description of the areas for which they are considering funding. Cities that are applying should include as much geographic information as possible about the area of their proposed project and should identify city and county names as well as the census blocks in their application. Multiple jurisdictions, census designated places, joint powers authorities, utility district or county areas should describe the area and include census blocks in the application.

If multiple agencies are applying for technical assistance funding in the same area, they should coordinate. Applicants are required to submit a letter of support demonstrating this coordination. Separate local agencies operating in the same geographic area may be considered for grants through a Commission resolution process and need to demonstrate collaboration with any overlapping jurisdictions for the efficient use of resources. For the purposes of this program, cities do not have overlapping jurisdictions with the county or counties in which the city is located, nor are tribal governments considered to have overlapped jurisdictions with other eligible local agencies. 15 of 97

Relying upon the definitions of “Unserved and underserved households or businesses” being one or more households or businesses that are not currently served by a wireline connection that reliably delivers at least 25 Mbps download speed and 3 Mbps of upload speed, staff utilized the FCC National Broadband Map to identify census tracts within the City of Glendale that met the criteria. Twenty-one (21) census tracts were identified which met the criteria. The FCC National Broadband Map does not identify the underlying reason why locations are unserved or underserved, rather it reports whether service which provides at least 25 Mbps download speed and 3 Mbps of upload speed is offered by an Internet Service Provider at each service location. Individual service locations (i.e., addresses) are identified on the map with the corresponding service indicator from the following list: Coverage Available, Coverage Not Available, Not a mass market location
Therefore, staff created the Project Proposal to meet the grant requirements. The estimated costs for this project were based on conversations with engineering advisors and with input from internal sources. The conceptual design price is an estimate based on the anticipated linear footage needed to connect the top 9 census tracts of need which represent 198,425.5 linear feet. The price point for engineering is $1.50 per linear foot. This number has been calculated based upon the distances between key census tracts and anchor institutions, the proposed project area map submitted with the application is attached as Exhibit 1. Exhibit 2 contains a table listing the nine (9) census tracts along with the respective total population and total households within each as reported in the 2020 American Community Survey. Cumulatively these census tracts contain a total population of 43,783 and 16,491 total households.

The proposed technical assistance grant will fund development of design engineering for the City of Glendale. This plan will provide a comprehensive conceptual design plan to provide broadband service to the unserved and underserved households and businesses that are designed to, upon completion, reliably meet or exceed symmetrical 100 Mbps download and upload speeds. This project will be completed within the 24 month timeline stipulated in the LATA grant program rulemaking.

The $497,638.00 in LATA funding awarded to the City of Glendale will be utilized to hire a broadband advisement and engineering firm to assess the current broadband infrastructure and make improvements to join California’s middle mile efforts. This engineering study will determine the ‘broadband access gap’ within the city boundaries of Glendale and be composed of the following tasks:

Task 1: Needs Assessment
Task 2: Inventory Assessment
Task 3: Gap Analysis
Task 4: Design Engineering

64b
3 9
9 0
Task 5: Deployment Plan
Task 6: Final Report
Task 7: Project Management
Task 8: Community Engagement
At the conclusion of the design engineering project staff and the selected engineering firm will return to Council to present the final report, associated findings and a suggested plan of action. In alignment with the LATA grant requirements the final report will provide a comprehensive conceptual design plan to provide service to the unserved and underserved households and businesses that are designed to, upon completion, reliably meet or exceed symmetrical 100 Mbps download and upload speeds. While the LATA grant program requires that the proposed design engineering project be completed within a 24 month timeline, following the City’s authorization, procurement and contracting policies and procedures along with successful execution of a professional services agreement, Glendale aims to have the elements in this project completed within 6 months.

On January 26, 2023, the California Public Utilities Commission, issued a letter to the City awarding the full amount of requested Local Agency Technical Assistance grants funds.

As a condition of the award, within thirty (30) days the City must sign and submit to the State a consent form acknowledging and accepting the terms of the Local Agency Technical Assistance Program and a Government Agency Taxpayer ID Form.

STAKEHOLDERS/OUTREACH
Outreach for this grant will be extensive and comprehensive and has been incorporated within the City’s approved LATA grant application. As stated in the application, the engineering firm that will be hired will be tasked with community engagement.

BACKGROUND
PWD provides project planning and development, surveying, design, bid and award processing, utility coordination, construction inspection, and construction management of various Capital Improvement Program projects.

PWD currently manages more than $13M projects in construction, $125M in pre- construction and design phases, and more than $100M in future planning phases.

PWD has received an average of $9.5 Million in Highway Users Tax Account (HUTA) and Road Maintenance and Rehabilitation Account (RMRA), funds also known as Gas Tax Funds in the last three years and is forecasted to receive increased funds in the upcoming years, for improvements in the public right-of-way.

The city’s share of Measure R Sub-regional funds for Highway Operational Improvements is approximately $98.5 million. PWD has pursued and received several Measure R transportation-related grants from the Los Angeles County Transportation Authority (Metro) to improve traffic congestion and safety within the city.

On November 6, 2018, Glendale voters have approved Measure S, an additional 0.75% sales tax, to improve the Glendale Quality of Life & Essential Services. The revenue from Measure S can be used to preserve and enhance our neighborhoods, including repairing and upgrading local streets, providing affordable housing, maintaining local parks and community centers and other expenses.

PWD is also actively pursuing and receiving numerous Federal and State grants and funds such as Highway Safety Improvement Plan (HSIP), Active Transportation Plan (ATP), Clean California Local Grant Program (CCLGP).

In addition, PWD receives approximately $1.7M annually from the Sewer Fund for the maintenance, repair, and upsizing of the existing sewer and storm drain lines throughout the city.

Furthermore, PWD receives approximately $1.4M from Measure W regional fund to be used to construct storm water improvements to capture, treat, and infiltrate storm water runoff.

The selected pre-qualified consultants will provide their professional engineering services in their disciplines selected on an “As-Needed” basis.

CITY OF GLENDALE, CALIFORNIA

REPORT TO THE CITY COUNCIL

AGENDA ITEM
Report: Rectangular Rapid Flashing Beacon (RRFB) Installation Phase 2 Project 1) Motion awarding a construction contract to Elecnor Belco Electric, Inc., in the amount of $1,568,775, approving a 15 percent contingency in the amount of $235,316, rejecting all other bids, and authorizing the City Manager or his designee to execute the contract.
2) Resolution of appropriation to appropriate funds in the amount of $1,960,969 for the Rectangular Rapid Flashing Beacon (RRFB) Installation Phase 2 Project

COUNCIL ACTION
Item Type: Consent Item
Approved for February 14, 2023 calendar

EXECUTIVE SUMMARY
On January 18, 2023, two bids were received for the Rectangular Rapid Flashing Beacon (RRFB) Installation Phase 2 Project, and after a thorough review, staff found Elecnor Belco Electric, Inc.’s bid to be the lowest responsive bid from a responsible bidder. The recommended contract with Elecnor Belco Electric, Inc. will cost $1,568,775 with 15 percent contingency of $235,316, totaling $1,804,091.

Additionally, a resolution of appropriation is needed to appropriate and shift Gas Tax Funds, CIP Reimbursement Funds, Measure M Local Return Funds, and Measure S CIP Funds for these pedestrian and infrastructure improvements. 88 of 97

COUNCIL PRIORITIES
Mobility/Connectivity/Safety: This project will significantly improve uncontrolled pedestrian crossing locations and improve pedestrian and intersection safety.

Infrastructure: This project will improve the roadway infrastructure, sidewalks, and curb ramps at the project locations.

RECOMMENDATION
Approve the motion authorizing the City Manager to enter into and execute a construction contract with Elecnor Belco Electric, Inc. for the RRFB Installation Phase 2 Project in the amount of $1,568,775 plus a 15 percent contingency of $235,316; and approve the resolution of appropriation to appropriate funds in the amount of $249,975 from the CIP Reimbursement Fund, $1,100,994 from the Gas Tax Fund, $310,000 from the Measure S CIP Fund, and $300,000 in Measure M Local Return funds.

BACKGROUND
A major part of road safety challenges involves addressing uncontrolled pedestrian crossing locations, which occur where sidewalks or designated walkways intersect a roadway at a location where no traffic control (i.e. traffic signal or STOP sign) is present.

These crossing types occur at intersections (where they may be marked or unmarked) and at non-intersection or midblock locations.

The Public Works Department is addressing uncontrolled pedestrian crossing challenges by implementing the Federal Highway Administration (FHWA) guidelines.

These include a variety of safety improvements including, crosswalk visibility enhancements, Pedestrian Hybrid Beacon (PHB), and Rectangular Rapid-Flashing Beacon (RRFB), etc.

Staff conducted an analysis of the current inventory of uncontrolled crossing locations within the City and elected four critical and priority locations that countermeasures could be applied.

Project Location
•Wilson Avenue at Belmont Street (RRFB);
•Colorado Street at Porter Street (PHB);
•Colorado Street at Lincoln Avenue (PHB); and,
•Colorado Street at Jackson Street (RRFB)
Project Scope of Work
•Installation of PHBs and RRFBs;
•Installation of new curb ramps to meet current Americans with Disabilities Act (ADA) requirements;
89 of 97

38a
3 9
9 5
•Installation of Curb Extensions and pedestrian refuge islands; and •Installation of new striping and pavement markings, including high visibility crosswalks and signage.

ANALYSIS
Upon review of bid documents, staff finds the Elecnor Belco Electric, Inc.’s (Elecnor) bid to be the lowest responsive bid from a responsible bidder. The bid of Elecnor in the amount of $1,568,775 is within two percent of the Engineer’s estimate of $1,600,000.

In addition, staff recommends a reserve for contingencies in the amount of $235,316 or 15 percent of the bid amount. The contingency amount is based on previous experience and is commensurate with the nature of the project. This will allow us to account for any incidental work, unforeseen field conditions that could be encountered during construction, underground utilities issues that could arise because of the nature of the project, and any resulting field modifications that may be necessary, including repairing additional asphalt concrete pavement, sidewalks, curbs, gutters, and driveway aprons in the adjacent areas.

The State of California Contractor’s State License Board website confirms that the licenses of Elecnor and their subcontractors are current, active and in good standing.

Additionally, Staff contacted the references provided by Elecnor and found they had satisfactorily completed the projects. Elecnor has also worked with the City of Glendale on the Honolulu Avenue and Pennsylvania Avenue at Montrose Avenue Traffic Signal Modifications Project, Traffic Signal Installations and Modifications at Various Locations Phase 2 Project, and various other City of Glendale projects, and satisfactorily completed these projects.

Furthermore, staff has budgeted approximately 10 percent of the construction amount, or $156,878 for construction management and engineering support services such as project management, project engineering, and construction inspection.

A resolution of appropriation of $1,960,969 is needed to provide adequate funding for this project. $249,975 is recommended to be newly appropriated from the CIP Reimbursement Fund. This will allow grant funds received for highway safety improvements to be used in the project area. $690,000 is recommended to be newly appropriated from the Gas Tax Fund fund balance and $410,994 from shifting existing appropriations from other Gas Tax funded projects. $300,000 will be shifted from an existing appropriation from the Pedestrian Plan Implementation Project in the Measure M Local Return Fund. It is also requested to appropriate $140,000 from shifting an existing appropriation from the Ped and Bike Lane Plan Implementation Project in the Measure S CIP Fund. Finally, it is requested to appropriate $170,000 from the Measure S CIP Fund fund balance to fund the remainder of the project budget. It should be noted that to offset the $170,000 being requested from the Measure S CIP Fund balance, we will be reducing the already budgeted Ped and Bike Lane Improvement Program in the General Measure S Fund by the same amount of $170,000.

STAKEHOLDERS/OUTREACH
The PHB and RRFB installation benefits to the community will include the following:
•Improved safety for all users; and
•Increased sight distance of pedestrians and users of the crosswalks.

Furthermore, outreach on this project continues to occur through a dedicated website for the project. The website page introduces the public to the project and to the project team, explains the scope of work and project locations, highlights the project phase, and provides the public with Staff contact information for questions, discussion and/or input.

Citywide Pedestrian Plan
The project locations are also identified in the 2021 adopted Citywide Pedestrian Plan in the short-term phase as pedestrian safety corridors to be implemented within the first five years. Therefore, the project will enhance existing marked crossings to best practices to minimize turning-movement conflicts with motorists and will include the installation of high-visibility crosswalks, curb extensions, and median refuge islands. 91 of 97

FISCAL IMPACT
The Public Works Department was able to secure Cycle 10 Highway Safety Improvement Program Local (HSIPL) funds to fund a portion of the construction and construction management of the RRFB Installation Phase 2 Project. Caltrans obligated funds for the construction and construction contingency in the amount of $249,975. This obligation requires a minimum 11.47 percent local match. The City will construct the project and then invoice Caltrans for reimbursement. Caltrans has issued a Finance Letter (E-76) authorizing the City to proceed with the construction phase of the project.

The construction of the RRFB Installation Phase 2 Project will cost $1,804,091 and $156,878 for project management staff, totaling to $1,960,969, which was not approved as a part of the FY 2022-23 budget. Therefore, staff is requesting for an appropriation of $249,975 from State Grant Revenue, $170,000 from the Measure S CIP Fund Balance, $690,000 from the State Gas Tax Fund, State Gas Tax Mandates, a shift in appropriation of $300,000 from the Pedestrian Plan Implementation Project, $140,000 from the Pedestrian and Bike Plan Implementation Project, $280,994 from the Street Resurfacing Program, and $130,000 from the Construction Management and Inspection Project.
