RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA, DISPENSING WITH COMPETITIVE BIDDING AND AUTHORIZING THE PURCHASING MANAGER TO EXECUTE A PURCHASE ORDER/ SERVICE AUTHORIZATION WITH CALIFA LIBRARY GROUP TO PURCHASE LIBRARY MATERIALS, EQUIPMENT, AND ELECTRONIC RESOURCES WHEREAS, the Library, Arts and Culture Department ("the Library") purchases books, materials, equipment, and electronic resources from a large number of vendors. A main resource for the Library is Califa Library Group (“CALIFA’), which is a not-for-profit membership cooperative serving member libraries in California, with the bulk its of membership made up of public libraries; and
WHEREAS, CALIFA acts as a single approved vendor from whom libraries can purchase multiple vendor products; and
WHEREAS, CALIFA negotiates pricing agreements and group purchases with more than 60 CALIFA-approved vendors, thereby providing cost effective delivery of services, programs, and products; and
WHEREAS, as a CALIFA member, the Library receives CALIFA group purchasing product discounts, which enables the City to receive lower, more favorable prices; and ‘WHEREAS, the Library purchases books, materials, equipment, and electronic resources through CALIFA, including Mango Languages, GALE/CENAGE databases, and EBSCO subscriptions; and
WHEREAS, GALE/CENAGE and EBSCO sell their own products directly or through CALIFA, so the City’s Purchasing Manager cannot competitively bid them. However, CALIFA offers these products at a discounted price to CALIFA member libraries; and WHEREAS, CALIFA has a successful track record with the Library in providing books, materials, equipment, databases, and subscriptions; and WHEREAS, CALIFA has the capacity, resources, and desire to provide the products and services that the Library needs; and

WHEREAS, the Council finds that by using CALIFA for books, materials, equipment, databases, and subscriptions, the Library can ensure that it delivers cost effective services and programs; and
WHEREAS, sufficient budgetary funds exist to authorize the City’s Purchasing Manager to execute and issue a Purchase Order/Service Authorization to CALIFA to purchase products and services for a 5 year period; and
WHEREAS, Glendale City Charter, Article VI, Sec. 9 provides an exemption to competitive bidding where the Council determines it is in the best interest of the City to dispense with competitive bidding; and

WHEREAS, given the need for the Library books, materials, equipment, databases, and subscriptions through CALIFA, it appears that adequate justification exists and it is in the City’s best interest— upon recommendation of the Director of Library, Arts and Culture— to dispense with competitive bidding and to authorize the Purchasing Manager, or his designee, to issue and execute a Purchase Order/Service Authorization with CALIFA to provide those products and services.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GLENDALE:
ie The foregoing facts are deemed to be true and correct, and are a basis for dispensing with competitive bidding and authorizing the execution of an agreement with a single source.

2. The Council hereby dispenses with competitive bidding and authorizes the Purchasing Manager, or his designee, to issue and execute a Purchase Order/Service Authorization with Califa Library Group, San Mateo, California, for a 5 year period, to purchase books, materials, equipment, databases, and subscriptions in an amount not fo-exceed $1,250,000.00.

. A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE,

CALIFORNIA, ADOPTING A REVISED POLICY REGARDING COUNCILMEMBER _ REQUESTS TO PLACE MATTERS ON FUTURE AGENDAS
WHEREAS, the Council of the City of Glendale (“Council”) adopted Resolution No. 08-229 on December 16, 2008 to document its policy and practice regarding individual councilmember requests to place matters on future agendas, as well as items for reconsideration/rescission, and timing of placement of matters on future agendas; and WHEREAS, the Council desires to revise its policy regarding councilmember requests to place matters on future agendas.
’ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Glendale, California that:

A. The Council hereby modifies Section 1 of the “Policy Regarding Placing Matters on the Agenda’ as follows:
“4. General Policy
An individual Council Member may request at a meeting of the Council that a matter be placed on a future agenda. Said matter shall be placed on the next regular meeting agenda under “New Business” or “Discussion of Councilmember Future Agenda Requests” (if such an agenda category or similar agenda category is created after the adoption of this Resolution). At said regular Council meeting, Council will discuss whether to have staff prepare a report and place said matter on a future agenda. Substantive discussion may occur at this initial point, but the staff will not prepare a report on the item. At the subsequent regular meeting, the Council may, with three affirmative votes, direct staff to prepare a report on the matter for Council consideration and action. The timing of the placement of that matter on a future agenda shall be in accordance with Section 3 of this Policy. The Council may, in its sole discretion, deviate from the Policy set forth herein in any instance. Failure to comply with this Policy shall not void or otherwise affect the validity of an action lawfully taken in compliance with the Brown Act and any applicable public hearing procedures.”
B. Sections 2, 3 and 4 of the Policy (per Resolution No. 08-229) shall remain in effect as follows: ,
“2. Items for Reconsideration and Rescission
Under Glendale Municipal Code Section 2.04.150, a motion to reconsider may be made only at the meeting at which the vote to be reconsidered is taken. However, the Council may rescind an action taken at a meeting that has been completed by rescinding that action at a subsequent meeting. A motion to rescind an action taken by the Council at a prior meeting, and take further or alternative action on the matter, shall only be placed on an agenda if a Council Member that voted with the majority at the prior meeting requests that said matter be placed on a future 8f2

agenda. The Council shall not rescind any action for which it is legally impossible to undo.
3: Timing of Placement of Matters on an Agenda
The Mayor shall have the discretion to control the timing of the placement on future agendas. The Mayor shall work with the City Manager regarding the timing of the placement of matters on future agendas taking into account the need to act on a matter within a certain timeframe and the overall workload of City staff. The Council may direct the timing of the placement of an item on a future agenda only by a majority vote of the membership of the Council (three affirmative votes).

4. City Manager Role
This policy pertains to the ability of individual Council Members to place matters on future agendas. The City Manager is authorized to place matters on the agenda after consultation with the Mayor. Other than with respect to timing, this policy does not govern matters that the Council is legally required to consider at a Council meeting. The City Manager shall also have the authority to place a report on a Council agenda to provide basic information regarding a matter and seek Council input and direction as to whether to prepare a more detailed and/or substantive report on the matter for future Council consideration.” Adopted this 148th day of April , 2023.
