A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE,
CALIFORNIA, DISPENSING WITH COMPETITIVE BIDDING, AND AUTHORIZING
THE CITY MANAGER OR A DESIGNEE TO NEGOTIATE AND AMEND TO EXTEND
FOR ONE-YEAR THE BEELINE FIXED ROUTE OPERATION AND MAINTENANCE
CONTRACT AND THE DIAL-A-RIDE DEMAND RESPONSE OPERATION AND
MAINTENANCE CONTRACT
WHEREAS, the City of Glendale has provided Beeline fixed-route bus service since 1984 and Dial-A-Ride paratransit service since 1988 for the community; WHEREAS, since their inception, both transit services have been operated by professional contractors whose expertise is required in providing high quality, efficient, reliable Beeline and Dial-A-Ride transit services to the public that meet federal, state and local regulations and safety laws;
WHEREAS, the contracts with the City’s current Beeline and Dial-A-Ride transit operations and maintenance contractor, MV Transportation, Inc., expire on June 30, 2023;
WHEREAS, MV Transportation, Inc. has the experience, personnel, resources, and desire to operate and maintain the City’s transit services; WHEREAS, MV Transportation, Inc., has proven that as the incumbent contractor, operating the Beeline transit service for 22 years and the Dial-A-Ride paratransit service for 7 years, it possesses the ability to reliably and efficiently operate and maintain the City’s transit services;
WHEREAS, the City desires to extend the two contracts for one-year from July 1, 2023 to June 30, 2024,
WHEREAS, procurement of the transit services contractor does not readily lend itself to a formal competitive bidding process and a contract award to the lowest responsible bidder, as required by the City’s Charter and the Glendale Municipal Code, because of the distinctive nature of operating and maintaining public transit services—- which requires consideration of additional important factors, such as service quality and technical expertise;
WHEREAS, the Council finds that sufficient budgetary funds exist to authorize the City Manager to negotiate and execute one-year contract amendments with MV Transportation, Inc., to operate and maintain the City’s transit services; 1 WHEREAS, Glendale City Charter, Article VI, Sec. 9 provides an exemption to competitive bidding when the Council determines it is in the best interest of the City to dispense with competitive bidding; and
WHEREAS, given the need to continue providing transit services to the public, it appears that adequate justification exists and it is in the City’s best interest to dispense with competitive bidding and to authorize the City Manager or a designee to negotiate and execute contract amendments to extend the transit services contracts for an additional year.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GLENDALE:
Le The foregoing facts are deemed to be true and correct, and are a basis for dispensing with competitive bidding, and authorizing the contract amendments to extend the transit services contracts by one-year.
2. The Council hereby:
A. Dispenses with competitive bidding;
B: Authorizes the City Manager or a designee to negotiate and amend the Beeline service operation and maintenance agreement with MV Transportation, Inc. to extend the contract for a one-year period from July 1, 2023 to June 30, 2024, for a not to exceed amount of $12,234,395 and to amend the Dial-A-Ride service operation and maintenance contract with MV Transportation, Inc. for a one-year period from July 1, 2023 to June 30, 2024, for a not to exceed amount of $1,205,578, for a total not to exceed amount of $13,259,973— subject to approvat by the City Attorney.
