RECOMMENDATION
That the Council appoint Mayor Brotman to write the argument in favor of the ballot measure.

ANALYSIS
The Council adopted Resolution No. 23-190 on December 5, 2023, which places a measure on the ballot that will, if adopted, amend Article VI, Section 9 of the City Charter pertaining to contracts. The measure would amend the Charter to read:

The council shall by ordinance establish standards, procedures, rules, or regulations relating to all aspects of the award and performance of contracts, including contracts for the construction of public improvements, including, but not limited to, compensation paid for performance of such work.”
Additionally, on December 5, 2023, the Council adopted a resolution calling for persons or associations desiring to write arguments for or against the adoption of the proposed measure to be submitted no later than December 11, 2023.

As of the writing of this report, the City has received a request from Mayor Brotman to write the argument in favor of the ballot measure. No persons or associations requested to write an argument against the ballot measure.

GMC Section 1.08.060 provides that the Council, in making such appointments, shall give preference in the order named as follows:

1. Officers of the city elected by the people;

2. Appointive officers of the city;

3. In the case of initiative charter amendment, the proponent of the petition;

4. Bona fide associations of citizens;

5. Individual voters.

Since Mayor Brotman requested to write the argument in favor of the measure, and no other individual or association request to write the argument in favor or against, it is recommended that the Council appoint Mayor Brotman to write the argument in favor of the ballot measure and no individuals or associations be appointed to write an argument against the measure. An argument in favor of the ballot measure would advocate to amend the Charter as set forth above.
