ANALYSIS
On June 29, 1972, a permanent easement and right-of-way for public street purposes was granted to the City of Glendale by easements at the northeasterly corner of Lot 2, Block 6, Town of Glendale, as recorded in Book 14, Pages 95 and 96 of Miscellaneous Records. This easement was recorded on July 6, 1972, as Instrument No. 2255, in Book D5520, Pages 963 and 964 of Official Records, County of Los Angeles, State of California.

On November 2, 2022, the Planning Commission sustained the Planning Hearing Officer’s decision granting with conditions the requested Density Bonus Review application as set forth in the Planning Hearing Officer’s decision letter of July 7, 2022 (PHO Decision Letter – Exhibit “2”). In addition to the conditions of approval set forth in the PHO Decision Letter, the Planning Commission’s approval of the Density Bonus Review application (PC Motion – Exhibit “3”) is also subject to the following condition:

Applicant must apply for and complete the conditional vacation of the existing street easement (Instrument No. 2255, recorded on July 6, 1972, in Book D5520 Pages 963 and 964) and record a new street easement covering the area of the existing street easement (to be vacated) together with any additional area required for the construction of a new curb ramp in compliance with current Americans with Disabilities Act (ADA) requirements.

The subject street corner is improved with a non-ADA compliant curb ramp. Upon vacation, the applicant will record a new street easement and construct a new curb ramp in compliance with current ADA requirements.

The street easement required for the new ADA compliant curb ramp will be included as a condition in the Resolution Ordering the Vacation.
