RESOLUTION NO. ______

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE,

CALIFORNIA ADOPTING FINDINGS OF VIOLATION OF GLENDALE
MUNICIPAL CODE CHAPTERS 15.20 AND 30.25 AS A RESULT OF THE

UNPERMITTED DEMOLITION OF A HISTORIC RESOURCE LOCATED
AT 1239 N. EVERETT STREET AND IMPOSING PENALTIES IN

CONNECTION THEREWITH
WHEREAS, GMC section 15.20.090(C) authorizes the City Council to conduct a public hearing to consider evidence of unpermitted complete or partial demolition of a historic resource in violation of Chapter 15.20, to impose penalties stemming from the violation(s), and to authorize recordation of an instrument imposing covenants on a property where the complete or partial demolition of a contributing or non-contributing building occurred in a designated or pending historic district overlay zone occurred without approval of a demolition clearance and issuance of a demolition permit pursuant to GMC Chapter 15.22; and
WHEREAS, the 1925 Spanish Colonial Revival-style single-family residence (“House”) located at 1239 N. Everett Street (“Property”) was identified as a contributor in the draft historic resource survey for the pending Bellehurst Historic District dated July 2023 and is therefore determined to be an historic resource; and WHEREAS, in October 2023, the House at the Property was demolished without the City-approved demolition clearance or demolition permit required by Glendale Municipal Code (GMC) Sections 15.22.040 and 30.25.060); and WHEREAS, on April 2, 2024, the City Council conducted a hearing, and received testimony, reviewed documentary records, including but not limited to the April 2, 2024 staff report and all its exhibits, and materials presented at the hearing documenting the unpermitted demolition of the House, an historic resource; and WHEREAS, based on hearing and reviewing all the evidence in connection with the demolition of the House at 1239 N. Everett, and following deliberation, the City Council finds and determines that the demolition of the House at the Property was complete and that such demolition violated GMC sections 15.22.040 and 30.25.060.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA THAT:

1. The recitals herein above are findings incorporated herein and are relied upon as factual support for the determination that the House at the Property was a complete demolished in violation of GMC sections 15.22.040 and

30.25.060.

2. The Council’s determination that the demolition on the Property was complete is also based on the following facts:

Page 2 of 3 ends

a. The photographic record presented at the hearing established that on October 19, 2023, the roof and roof framing were demolished and that only a portion of the chimney, on the south side façade, that a few framing studs remained at the north side façade, and that the entire front (east) façade and almost all of the side facades were removed down to the floor deck.
b. That on November 14, 2023, based on inspection by City staff, the demolition materials from the House that were alleged to remain at the Property in a dumpster had been in fact removed, and that only a scant amount of demolition material remained on the Property. c. That due to the extent of demolition and removal of original demolition materials, reconstruction as a penalty option for a partial demolition outlined in GMC section 15.20.090(F) cannot be realistically considered, and on that basis the demolition is considered complete.

3. Based on the findings of violation, Council hereby imposes the following penalties pursuant to GMC section 15.20.090:
a. GMC §15.20.090(C): Imposition of a Three-Year Construction Moratorium: No building or construction related permits shall be issued for the Property upon which the demolition took place for a period of three years commencing on October 19, 2023 (“Construction Prohibition Period”), which is the date Community Development staff visited the site, documented the demolition, and obtained actual knowledge of the demolition.
b. GMC §15.20.090(C): Recordation of an Instrument Imposing Covenants. In connection with the Construction Prohibition Period the City shall record an instrument imposing covenants on the Property with the County of Los Angeles that memorializes the time period during which permit issuance is prohibited.
c. GMC §15.20.090(D): Property Maintenance Required: During the Construction Prohibition Period, the Property shall be maintained so as to not constitute a public or private nuisance, or otherwise violate Chapter 15.20. Specifically, the Property shall be maintained:
i. In a clean and orderly manner free of junk, trash, debris, litter, abandoned or inoperable vehicles, stagnant water, abandoned excavations, appliances and furniture, storage containers, vegetation that is not in a healthy or living state, and overgrown vegetation.
ii. With living vegetation, including trees and shrubs, which living vegetation shall be retained and fully maintained, including receiving necessary watering and trimming, during the
construction prohibition period.

iii. With living grasses and groundcovers and new grass and/or groundcover shall be planted at any areas of bare soil to control dust and erosion. All grasses and groundcovers shall not exceed an overall height of six inches. Additionally, vehicles of any type shall not be parked or stored on the property and no
remunerative use of any kind shall be allowed.

4. (GMC §15.20.090(E): Limitations on New Development (Complete Demolition): Any new construction following the expiration of the Construction Prohibition Period be within the same footprint, height, and square footage as the house that was demolished.

§ 15.20.090. Enforcement and penalties.

A. A violation of any provision of this chapter is expressly prohibited and is punishable as a misdemeanor pursuant to Section 1.20.010 of this code.

B. In addition to any other remedies provided herein, any violation of this chapter may be enforced by civil action brought by the city. Remedies under this chapter are in addition to, and do not supersede or limit, any and all other civil or criminal remedies. The remedies provided for herein are cumulative and not exclusive. In any such action, the city may seek as appropriate, any or all of the following remedies:

1. A temporary or permanent injunction, or both;

2. Assessment of the violator for the costs of any investigation, inspection or monitoring survey that led to the establishment of the violation, and for the reasonable costs of preparing and bringing legal action under this subsection; and

3. Assessment of the violator of civil penalties pursuant to Chapter 1.24.

C. In addition to any other remedies provided herein, in the event a designated historic resource, a resource pending designation as a historic resource, a potential historic resource, or a protected interior is completely or partially demolished in violation of this chapter, as a penalty no building or construction related permits shall be issued for the property upon which the demolition took place for a period of three years from the date of demolition. Said penalty shall be issued and enforced either by the city council following a public hearing, or by a civil action filed by the city attorney and adjudicated by a court of competent jurisdiction. The city shall also record an instrument imposing covenants on real property with the county of Los Angeles that memorializes the time period during which permit issuance is prohibited. A demolition shall be presumed to have occurred on the date the city had actual knowledge of the demolition.

D. In addition to any other remedies provided herein, any property that remains undeveloped pursuant to subsection C shall be maintained in such a manner so as to not constitute a public or private nuisance, or otherwise violate the chapter. The property shall be maintained in a clean and orderly manner free of junk, trash, debris, litter, abandoned or inoperable vehicles, stagnant water, abandoned excavations, appliances and furniture, storage containers, vegetation that is not in a healthy or living state, and overgrown vegetation. Living vegetation, including trees and shrubs, shall be retained and fully maintained, including necessary watering and trimming, during the construction prohibition period. Living grasses and groundcovers shall also be retained and fully maintained and new grass and/or groundcover shall be planted at any areas of bare soil to control dust and erosion.

All grasses and groundcovers shall not exceed an overall height of six inches.

Additionally, vehicles of any type shall not be parked or stored on the property and no remunerative use of any kind shall be allowed.

I am writing to encourage all of you to enforce the penalties under Ordinance 5931 regarding the illegal demolition in October 2023 of 1239 N. Everett.

I have lived in Glendale for 78 years and have seen the repeated "rape" of so many of our Glendale character homes. If we don't enforce this first eligible case, it leaves all of Glendale vulnerable to this type of "thumbing your nose" at the Glendale laws.

Thank you.

Dear Mr. Kassakhian,,

My family and I have lived in Glendale for 21 wonderful years. We chose our neighborhood because of the charming and historical homes in the area. We are strong supporters of preserving these homes which represent the best of California architecture and years of American history. These homes are priceless treasures, that must be preserved in our opinion.

Our family of five voted for you in the last elections city council election partially because of your support of historical districts in Glendale. Tonight we urge you to vote for the harshest penalties on the new owners of 1239 N. Everett, who illegally demolished parts of the home which they wanted to turn into a modern large home. I myself was actually interested in buying it and restoring the home but at the one million dollar asking price, I knew it would not make sense. I did my due diligence and decided because of the historical nature and condition of the house, I would not be able to make money. I followed the rules! If the owners realtor did not disclose this they should take it up with their broker.

Over the years we have sadly noticed a decline in civility and following the laws. Young men speeding down our small streets in sports cars, like our neighborhood is a speedway.

Drivers constantly ignoring stop signs and even traffic lights! Groups of people smoking where no smoking signs are clearly posted. People walking down the streets not the sidewalk or double parking for conversations with friends.

Laws must be enforced or they are useless and encourage others it is alright to break the rules and get away with it! This is also happening in construction and remodeling projects where new owners think they can do whatever they want when they want without following the building codes. This must stop or our city will rapidly decline into a poor developing country

I may want to build a 30 story condo on a lot zoned for one single family home in a neigborhood of homes because it is my land and I can do whatever I want. But his is selfishness and breaking the law!

We have found Glendale as one of the most well run cities we ever have lived in! The services, upkeep, programs are very well run.

The new owners need to be made an example to all Glendale that they must follow codes, rules and laws or receive punishments and fees for deliberating ignoring what they new was illegal for not following city codes and laws approved by the City Council on May 14, 2019,
the adopted Ordinance No. 5931 provides strong penalties intended to deter nonpermitted destruction of historic resources. This is the first case where those penalties could be utilized and we the people of this amazing city strongly urge you to do so tonight!

Sincerely,

Sincerely,

RE: Agenda 9b: Community Development, re: Unpermitted Demolition of a Historic Resource at 1239 N. Everett Street, to Consider Issuance of Penalties, and to Authorize Recordation of Instrument Imposing Covenants Memorializing the Penalties Dear Mayor Brotman and Glendale City Council Members,
The Glendale Historical Society (TGHS) strongly advocates for Glendale’s historic re- sources and historic districts. As such, it is important that property owners of historic re- sources work with the City to ensure that the historic integrity is maintained with any proposed changes.

TGHS was saddened to see the willful illegal demolition of 1239 N Everett, a contributor to the pending Bellehurst Historic District.

On May 14, 2019, City Council adopted Ordinance No. 5931 to provide robust penalties intended to deter unpermitted demolition of historic resources. This is the first case brought before you to assess these enhanced penalties.

TGHS strongly recommends that all of the enhanced penalties as outlined in the staff re- port be assessed.

The Glendale Historical Society (TGHS) advocates for the preservation of important Glendale landmarks, supports maintaining the historic character of Glendale’s neighborhoods, educates the public about and engages the community in celebrating and preserving Glendale’s history and architectural heritage, and operates the Doctors House Museum. TGHS is a tax-exempt, not-for-profit 501(c)(3) organization, and do- nations to TGHS are tax-deductible to the extent permitted by law. 213 of 230

These include:
- Three year construction moratorium
- Mandate that property be cleared and kept in a clean and orderly manner during this period
- Any new construction after this period must either match the demolished property or be within the same footprint, height, and square footage as the house that was demolished
Also, since the demolition was willful and evidence exists that efforts were made after demolition to conceal the extent of their actions, we recommend that misdemeanor charges be filed.

TGHS believes that our historic districts are only as strong as the City’s will to enforce penalties for illegal work and/or demolition.

Unfortunately, some homeowners believe that the fine that may be assessed for illegal work is a “cost of doing business” and isn’t a strong deterrent. The enhanced penalty of not being able to build on the lot for three years and that any subsequent structure must match or follow the footprint, height, and square footage of the illegally demolished structure could be more effective in deterring this activity in future.

Respectfully,
John Schwab-Sims

City Council members,

I'm writing to ask that you impose all available legal penalties on the owners of 1239 N Everett for its illegal demolition. I particularly ask that you impose the requirement that new construction match the demolished property. Of course, such precedent would considerably reduce the incentive for other homeowners to demolish houses that contribute to historic districts. And it's especially important to set precedent because this is the first case since Ordinance No. 5931 was passed.

My wife (copied) and I moved from San Francisco to the Rossmoyne neighborhood in 2020 because we were attracted to the neighborhood's historical character. We initially rented, but bought our house in the same neighborhood in 2021 for the same reason (after considering other cities between Toluca Lake and Monrovia for nearly a year).

Every contributing house that is demolished is gone forever and its neighborhood is diminished in appeal as a result. Please help keep Glendale special by imposing maximum penalties to discourage future illegal demolitions.

Thank-you,
Steve Schurman (711 East Mountain)

Dear Mayor Brotman and City Council Members,

You know how I feel about preservation of historic structures.

But what happened to the 1925 Spanish bungalow at 1239 N Everett is exactly what the ordinance and all of the penalties were created for! This is flying in the face of any preservation interest Glendale claims to have. If this person does not receive the maximum penalties then anyone will know they can get away with whatever they want with Glendale's cultural and historical resources without any recourse.

Please enforce the ordinance and apply all the enhanced penalties.

Thank you for all you do to keep Glendale unique and beautiful, Joanna Linkchorst

Dear Glendale City Council members
It has come to my attention that a contributor to the pending Bellehurst Historic District, 1239 N Everett, was illegally demolished in October 2023. It was a 1925 Spanish Colonial Revival bungalow and one of the earliest homes built in Bellehurst. Please apply enhanced penalties to this case.

On May 14, 2019, City Council adopted Ordinance No. 5931 to provide robust penalties intended to deter unpermitted demolition of historic resources. This is the first case where those penalties could be utilized.

They include:
- Three-year construction moratorium
- Mandate that property be kept in a clean and orderly manner during this period - Any new construction after this period must either match the demolished property or be within the same footprint, height, and square footage as the house that was demolished City Council may also apply the following penalties:
- The City Attorney’s Office may file misdemeanor charges against the violator pursuant to GMC 1.20.010. (GMC §15.20.090(A)), or
218 of 230

- The City Attorney’s Office may request authorization to commence civil litigation and seek issuance of civil penalties, costs of investigation, and/or a temporary or permanent injunction through a civil action. (GMC §15.20.090(B)(1-3)) I believe it is critical that the City apply the enhanced penalties in this case. It is important that a message be sent that the City of Glendale will not tolerate the willful demolition of historic resources. Our neighbors work tirelessly to establish historic districts, and not assessing enhanced penalties for illegal demolition puts our districts at risk.

Respectfully,
Debbie Gloria, Glendale resident

Dear Council Members,

It is my understanding that on May 14, 2019 the City Council adopted Ordinance No. 5931 to provide robust penalties intended to deter unpermitted demolition of historic resources. It is also my understanding that in October 2023, a contributor to the pending Bellehurst Historic District, 1239 N. Everett, was illegally demolished. Glendale should encourage historic preservation as it benefits the city in many ways including property values. Pasadena is a fine example. Please send a message that the City of Glendale values its historic resources and will not tolerate blatant violation of city ordinances and assess the enhanced penalties; otherwise, what is the point of having the ordinances.

If you believe that enhanced penalties are not in order with respect to this property, please explain the reasoning.

Thank you.

So sorry for the confusion.

This item is on the agenda for a public hearing at the April 2nd City Council regular meeting. I originally sent a copy of my email to the councilmembers to the City Clerk, but received an out of office reply. Consequently, I decided to send a copy to you, since I assume you will be substituting for her at the meeting, and may need to make a record of public comments.

Thanks for your assistance.

Dear Council Members.

As a 30 year resident of Glendale residing in the Rossmoyne Historic District and decades plus member of the Glendale Historical Society, I am truly saddened that the home at 139 N. Everett was illegally demolished. One of the reasons for designating historic districts is to preserve the charm of these unique and well constructed homes as well as increase the value of our homes. If someone can flagrantly disregard Glendale ordinances without penalties, what other ordinances will they think don’t apply to them. Please do the right thing by applying the enhanced penalties in this case.

Thank you.

Dear Glendale City Council Members

Me and my family live at 1209 N. Everett St. and I am writing about the illegal demolition of the 1925 Spanish Colonial Revival bungalow (one of the earliest homes built in Bellehurst) that happened on our street at 1239 N. Everett St. in October 2023.

Not only was it illegal, but it is now become an eyesore with green tarpaulin and a fence around it since the demolition six months ago. The entire way that the house was even bought from the previous owner was suspicious, immoral, if not illegal, but I’m not going to get into that now.

On May 14, 2019, City Council adopted Ordinance No. 5931 to provide robust penalties intended to deter unpermitted demolition of historic resources. This is the first case where those penalties could be utilized.

They include:

- Three-year construction moratorium

- Mandate that property be kept in a clean and orderly manner during this period

- Any new construction after this period must either match the demolished property or be within the 225 of 230

same footprint, height, and square footage as the house that was demolished

City Council may also apply the following penalties:

- The City Attorney’s Office may file misdemeanor charges against the violator pursuant to GMC

1.20.010. (GMC §15.20.090(A)), or

- The City Attorney’s Office may request authorization to commence civil litigation and seek issuance of civil penalties, costs of investigation, and/or a temporary or permanent injunction through a civil action. (GMC §15.20.090(B)(1-3))

I am urging you to take action on this issue so other instances don’t happen like this. Not only are all of us upset about the destruction of this historic home, but are also upset that there seems to be no plan in place to continue work on the house and whether the work will be done in a legal fashion.

Thank you

Glendale Council Members:

In October 2023, the 1925 Spanish Colonial Revival bungalow at 1239 N Everett, and identified historic resource and one of the earliest homes built in the proposed Bellehurst Historic District, was illegally demolished.

I'm writing to encourage you to enforce the enhanced penalties already in place (City adopted Ordinance No. 5931) to protect against such abuses.

On May 14, 2019, City Council adopted Ordinance No. 5931 to provide robust penalties intended to deter unpermitted demolition of historic resources, including:

A 3-year construction moratorium.

A mandate that the property be kept in a clean and orderly manner during this period.

Any new construction after this period must either match the demolished property or be within the same footprint, height, and square footage as the house that was demolished.

Enhanced penalties may include the following:
227 of 230

The City Attorney’s Office may file misdemeanor charges against the violator pursuant to GMC 1.20.010. (GMC §15.20.090(A)), or
The City Attorney’s Office may request authorization to commence civil litigation and seek issuance of civil penalties, costs of investigation, and/or a temporary or permanent injunction through a civil action. (GMC §15.20.090(B)(1-3)).

The enhanced penalties are critical in this case. It is important to show that the City of Glendale will not tolerate the willful demolition of historic resources, and that the adopted Ordinance has teeth and will be enforced.

Thank you for your consideration.

Sincerely yours,

April 1, 2024
Dear City Council Members,
We are writing to express our heartache and outrage at the illegal demolition of the Spanish Colonial Revival bungalow at 1239 N. Everett.

Ongoing illegal demolition in the City of Glendale appears to occur because the imposed penalties do not fit the crime. It is clearly worth more to the perpetrator to illegally tear down property than to suffer the City's penalty.

Each character property illegally destroyed chips away at Glendale's amazing history, to the point that we will look like any other run-of-the- mill-cookie-cutter-community. We are but a handful of cities in California with the remaining "privilege" to preserve architecture that is almost impossible to replicate quality-and-character-wise. How amazing is that? We must not allow these gifts to be so callously stolen from right under our nose.

We own a home on Glendale’s historic registry and reside in a historic district, and could not be more proud. As we have written before, these character homes are not merely structures, but hold a Century’s-worth of Glendale history, familial stories and memories. People move to Glendale 229 of 230

specifically for these beautiful, quaint, hard-to-find period homes - which, by the way, typically garner top dollar. Glendale's architectural history should live on long after we are gone - a legacy which you hold in your hands for future generations to enjoy. Glendale should proudly set the historic preservation standard.

Distainful and illegal destruction of Glendale’s architectural history is a slap in the face to our City ordinances and historic preservation efforts. Said illegal demolitions show a gross disrespect for Glendale City Council. The perpetrators assume you will fail to impose stiff penalties for illegal demolitions occurring on your watch. They assume you are a "do-nothing" City Council. Don't you find this frustrating and upsetting? I know we do.

When my husband and I vote for City Council members, at the top of our list is which candidate will work hardest to protect historic preservation.

Your vote here will determine our vote in the next election. Council Member Asatryan, we specifically voted for you and proudly displayed your yard sign based on your personal commitment to us regarding historic preservation. We were so pleased that you had been elected. We feel you let us down, however, regarding the previous ordinance change attempt which would make historic districting more difficult. As I recall, you and Mr. Najaranian sponsored the proposed ordinance change. We feel our votes were taken for granted. We truly hope this will not be the case here.

We'd like to feel that our votes were not in vain.

The illegal demolition of 1239 N. Everett screams full penalty. We request that each member vote to apply the enhanced penalties passed in the May 14, 2019 City Council Ordinance No. 5931. Penalties must be imposed to the fullest extent of this ordinance. You, and we, need to be heard loud and clear. Please send a strong message to these perpetrators that you are not a "do-nothing" City Council, but, instead, a "proactive" City Council, and that you each have the pride of City and conviction to enforce the ordinances that you draft. No other remedy is acceptable. Not one more property should be illegally and callously demolished.

Thank you.
