COUNCIL ACTION
Item Type: Consent Calendar
Approved for April 16, 2024 calendar
EXECUTIVE SUMMARY
The City of Glendale has an existing Professional Services Agreement (PSA) with Eurofins Eaton Analytical, LLC (Eurofins) to provide Glendale Water & Power (GWP) with water quality testing services in compliance with State and Federal regulations. The City Council authorized this three-year PSA for a not-to-exceed amount of $200,000 simultaneously with a PSA, with identical terms, with a second water quality testing laboratory. When the second laboratory cancelled their contract in early 2023, this created a financial shortfall for the remaining PSA with Eurofins. To ensure that GWP continues to meet State and Federal water quality standards and that the water served to customers is safe to drink, Staff requests approval for an amendment to the PSA with Eurofins, seeking additional funds of $179,000, the balance of the cancelled PSA with the second laboratory, for a new not-to-exceed total of $379,000.
RECOMMENDATION
Authorize the City Manager to execute Amendment No. 1 to the PSA with Eurofins to increase the contract amount by $179,000, for the new not-to-exceed amount of $379,000.
ANALYSIS
On December 8, 2022, City Council approved a Motion authorizing the City Manager to execute PSAs with two water quality testing laboratories, Weck Laboratories, Inc. and Eurofins Eaton Analytical, LLC. These laboratories were selected by GWP as the most qualified proposers pursuant to a competitive Request For Proposals (RFP) process. 2{{section.number}}d

The City of Glendale executed PSAs with each of the two laboratories for a period of three years from January 2023 through December 2025, each with a not-to-exceed amount of $200,000.
It is standard practice for water utilities to solicit the services of third-party laboratories to conduct testing mandated by State and Federal regulations and to ensure that the water served to customers is safe to drink. In March of 2023, Weck Laboratories notified the City that it would be unable to continue its services and asked to terminate their contract, with a remaining balance of $179,000, leaving Eurofins as the City’s sole provider of laboratory services. As the workload is no longer divided between two laboratories, the funds for the PSA with Eurofins have been used at an expedited rate.
GWP requests an additional $179,000 which will cover the amount remaining under Weck Laboratories’ contract prior to termination and ensure that there are no interruptions in its ability to continue the testing of water samples through December 31, 2025, utilizing the services of Eurofins Eaton Analytical.

ALTERNATIVES TO STAFF RECOMMENDATION
Alternative 1: Decline to approve Amendment No. 1 to the existing PSA with Eurofins to increase the contract amount by $179,000. Not approving the amendment will result in GWP not being able to maintain compliance with State and Federal regulations or guarantee safe drinking water to its customers.
