APPROVAL BY THE CITY ATTORNEY -AS DESCRIBED IN THE REPORT TO THE CITY COUNCIL DATED APRIL 30, 2024, FOR A FIVE-YEAR TERM FOR $17,297,535, WITH THE OPTION TO RENEW ONE-TIME FOR AN ADDITIONAL PERIOD OF TWO YEARS FOR $7,933,025, FOR A TOTAL NOT TO EXCEED AMOUNT OF $25,230,560 FOR SEVEN YEARS, FOR

PARKING MANAGEMENT SERVICES FOR FOUR CITY OWNED PARKING

FACILITIES
WHEREAS, the City of Glendale owns four downtown parking structures that have historically been operated by and maintained by an outside contractor who's expertise is required to handle a wide range of operational issues including the collection and processing of fees, monitoring and issuing monthly keycards, assisting customer service, financial reporting, security, janitorial and facility maintenance; and
WHEREAS, the current contract for these services with Modern Parking, Inc., will expire on June 30, 2024; and
WHEREAS, procurement of the parking management services contractor does not readily lend itself to a formal competitive bidding process and a contract award to the lowest responsible bidder, as required by the City's Charter and the Glendale Municipal Code, because of the distinctive nature of operating and maintaining public parking management services - which requires consideration of additional important factors, such as service quality, technical expertise, innovation and variation in customer service programs; and
WHEREAS, issuance of a competitive Request for Proposal (RFP) procurement process is better suited for obtaining a qualified parking management services contractor, as it allows for an evaluation of proposals based on important criteria that cannot be considered if the traditional competitive bidding/lowest responsible bidder procurement process was used;
WHEREAS, on December 28, 2023, the city released a Request for Proposals (RFP) for parking management services that was posted on the city's website; and
WHEREAS, on January 11, 2024, the city hosted a mandatory pre-proposal meeting that was attended by 11 parking management firms; and 1 8a1
WHEREAS, on February 15, 2014, the city received 8 proposals from parking management firms in response to the RFP; and
WHEREAS, an evaluation team of staff from the Public Works Department reviewed and evaluated all 8 proposals and ranked the proposals based on the following criteria: company background and experience, operational plan, best value, innovation/recommendation, references and responsiveness to RFP requirements; and WHEREAS, the evaluation team then interviewed the firms with the highest ranked proposals; and
WHEREAS, the evaluation teams determined that based on the proposals received and results of the interviews, that the parking management firm LAZ Parking California LLC submitted the highest ranked proposal and that they are the top ranked firm to provide parking management services for four City owned parking facilities; and
WHEREAS, LAZ Parking California LLC has optimal parking management experience as well as local experience operating over 1.3 million parking spaces nationwide for over 450 cities earning 2.1 billion dollars in annually revenue with a large presence in the greater Los Angeles area including the Americana at Brand, City of Burbank, City of Inglewood, City of Long Beach and Los Angeles Beaches and Harbors; and
WHEREAS, LAZ Parking California LLC is PCI-DDS Level 1 certified and an Accredited Parking Organization through the International Parking and Mobility Institute; and
WHEREAS, LAZ Parking California LLC submitted a proposal rooted in innovation, sustainability and excellent customer service and an ability to seamlessly transition parking management services from another operator; and WHEREAS, the pricing in the proposal from LAZ Parking California LLC was determined by staff to be fair and commensurate with the scope of work; and WHEREAS, Glendale Charter Art. VI Section 9 provides an exception to competitive bidding where City Council determines that ii is in the best interest of the City to dispense with competitive bidding; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GLENDALE:

1. The foregoing facts are deemed to be true and correct and are a basis for dispensing with competitive bidding and authorizing the execution of a general services agreement with Laz Parking California LLC, and that the 2 City Council finds that it is the City's best interest for a new general services agreement.

2. The City Council hereby:

A Dispenses with competitive bidding;
B. Authorizes the City Manager or his designee to execute a general services agreement with LAZ Parking California LLC, subject to approval by the City Attorney , for a five-year term for $17,297,535, with the option to renew for one additional two-year period for $7,933,025, for a total not to exceed amount of $25,230,560 for seven years, for parking

ALLAN COMPANY, FOR THE OPERATION OF THE GLENDALE

WHEREAS, Cedarwood-Young Company dba Allan Company (Allan Company) has been operating the Glendale Recycling Center since 2006; and WHEREAS, following multiple extensions, the agreement with the City is set to expire March 31, 2024; and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE FINDING AND DECLARING CERTAIN CITY-OWNED PROPERTY (APN 5636-007-903) LOCATED ADJACENT TO 1015 N. CENTRAL AVENUE, AS EXEMPT FROM THE

SURPLUS LAND ACT, EXEMPT FROM THE CITY'S COMPETITIVE BIDDING

REQUIREMENT, AND EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15061 (8)(3) THE COUNCIL OF THE CITY OF GLENDALE FINDS AS FOLLOWS:

A. The City of Glendale owns a small, irregularly-shaped, remnant parcel of land ("Property") that totals 3,720 square feet and is located between private property owned by a church and the right-of-way for Glenoaks Boulevard; assessor parcel number is 5636-007-903, as further depicted on Exhibits "A" and "A-1" (Site Maps) and Exhibit "B" (Parcel Map).

8. On or about October 26, 2023, the adjacent property owner the Western Diocese of the Armenian Church of North America located at 1015 N. Central Avenue expressed a desire to purchase the Property, which consists of a landscaped area historically maintained by the adjacent property owner.

C. Upon the request to purchase, City staff ascertained that there is no specific use for the Property which was acquired by the City in 1936 in order to widen and straighten Glenoaks Boulevard and is no longer needed for that purpose, and based on this investigation subsequently ordered a property valuation.

D. In reviewing the Department of Housing and Community Development ("HCD") Guidelines and the Surplus Land Act ("SLA"), the future sale of the Property meets the following exemption status as set forth within the guidelines if sold to the adjacent property owner: (A) Small Surplus Land Parcels sold to an owner of contiguous land that is: (i) less than 5,000 square feet in area; (ii) less than the minimum legal residential building lot size for the jurisdiction in which the parcel is located, or 5,000 square feet in area, whichever is less; or (iii) has no record access, is less than 10,000 square feet in area, and is not contiguous to land owned by a state or local agency that is used for open-space or low and moderate income housing purposes." Government Code section 54221 (f)(1)(8) and SLA Guidelines, section 103(b)(3)(8).

E. This declaration of exempt surplus property is exempt from the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that this activity may have a significant effect on the environment 8c1
pursuant to CEQA Guidelines Section 15061 (b)(3). The future sale of the Property, if approved by the City Council, would be exempt from CEQA pursuant to CEQA Guidelines Section 15312 (Surplus Government Property Sales) because the Property would be declared exempt surplus property pursuant to the Surplus Land Act and is not located in an area of statewide, regional, or areawide concern identified in CEQA Guidelines Section 15206(b)(4).

F. Glendale Municipal Code (GMC) section 4.52.010 provides that "Any real property, or interest therein owned by the city, may be sold only after competitive bidding to the highest bidder, except as provided in Section 4.52.040." GMC Section

4.52.040 excepts certain sales, conveyances and other dispositions of real property, including, a sale of real property or interest therein having a reasonable market value of less than $25,000 as estimated by the city manager (GMC §4.52.040.A.2); and, including a sale of real property or interest therein which is incapable of development by itself and can only be developed if sold to an adjacent property owner. (GMC §4.52.040.A.5).

G. The proposed Property disposition is exempt from the competitive bidding requirements contained in GMC section 4.52.010 under the two exceptions set forth in section F herein above because the Property has a fair market value of less than $25,000 based on a recent MAI appraisal obtained by staff, and because the Property's size, configuration and location render it incapable of development by itself.

THE CITY COUNCIL OF THE CITY OF GLENDALE HEREBY RESOLVES AS FOLLOWS:

1. Incorporation of Findings. The City Council hereby incorporates by this reference the findings set forth above as true and correct.

2. Declaration of Exemption (Surplus Land Act). The City Council finds and declares that the Property is "exempt surplus property" under the SLA because the sale of the Property to the neighboring property owner located at 1015 N. Central Avenue, contingent on HCD's 30-day review and approval of this resolution, meets the criteria of the "Small Surplus Land" exemption as specifically set forth under Government Code section 54221 (f)(1 )(G) and HCD's SLA Guidelines, section 103(b)(3)(G), because the prospective purchaser is an owner of land that is contiguous to the Property and the Property is less than 5,000 square feet in area,

3. Declaration of Exemption (Glendale Municipal Code). The City Council finds and declares that the Property is exempt from Glendale Municipal Code (GMC) section 4.52.010, which provides that "Any real property, or interest therein owned by the city, may be sold only after competitive bidding to the highest bidder, except as provided in Section 4.52.040", because GMC Section 4.52.040 excepts certain sales, conveyances and other dispositions of real property, including, a sale of real property or interest therein having a reasonable market value of less than $25,000 as estimated by the city manager (GMC §4.52.040.A.2); and, including a sale of real property or interest therein which is incapable of development by itself and can only be developed if sold to an adjacent property owner. (GMC §4.52.040.A.5). Here, the property is worth less than $25,000 and is incapable of development by itself and can only be developed if sold to the adjacent property owner.

4. This declaration is exempt from the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that this activity may have a significant effect on the environment pursuant to CEQA Guidelines Section 15061 (b)(3).

RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA

URGING CONGRESSIONAL ACTION FOR ARMENIAN GENOCIDE RECOGNITION, RELIEF

FOR ARTSAKH, AND HOLDING AZERBAIJAN AND TURKEY RESPONSIBLE FOR ACTS

OF GENOCIDE
Whereas, Armenians have inhabited the Armenian Highland for over four millennia and have developed a unique, rich civilization in the region with a long and continuous history, including the establishment of many kingdoms in their indigenous land; and Whereas, Ottoman Turkish political leaders, succeeded by the leaders of the Young Turk genocidal government, promoted a pan-Turkic agenda to unite the Turkic populations of the Ottoman Empire and the Russian Empire by annihilating the non-Turkic Armenian, Greek and Assyrian minorities in the region, a campaign which continues to this day; and Whereas, the Armenian people were victims of a series of massacres at the hands of both Ottoman Turkey and the Republic of Azerbaijan, namely the Hamidi an Massacres between 1894 and 1896 and the Adana Massacre of 1909 by Ottoman Turkey and the massacres in Shushi, Baku, Ghaibalishen, Jamilli, Karkijahan, and Pahlul between 1918 and 1920 by the Republic of Azerbaijan; and
Whereas, the Armenian people were victims of a systematic and premeditated genocide in their ancestral homeland, which began on April 24, 1915, at the hands of the Ottoman Turkish government from 1915-1919, and which continued at the hands of the Kem a list government of the Republic of Turkey from 1920-1923, whereby more than 1.5 million Armenian men, women, children and elderly were slaughtered or marched to their deaths in an effort to annihilate the Armenian Nation. while thousands of surviving Armenians were forcibly converted and lslamized, and hundreds of thousands more were subjected to ethnic cleansing during the period of the modern Republic of Turkey from 1924-1937; and Whereas, during the same time period, the Ottoman Turkish authorities massacred over one million Greeks, Assyrians, and other Christian minorities as part of the premeditated attempt at the complete eradication and genocide of these indigenous communities; and Whereas, these international crimes against humanity resulted in the permanent removal of all traces of the Armenians and other targeted peoples from their ancestral historic homelands, implementing a strategy of deliberate and ongoing erasure and enriching the perpetrators with the lands and confiscation of other property of the victims, including usurpation of several thousand churches; and
Whereas, in response to the Genocide and at the behest of President Woodrow Wilson and the U.S. State Department, the Near East Relief organization-as the first Congressionally sanctioned American philanthropic effort created to rescue the Armenian genocide survivors was founded and provided unprecedented relief, delivering more than $117 million in humanitarian assistance between 1915 and 1930, and saving approximately one million refugees, including 132,000 orphans of the genocide; and Whereas, in 1923, Soviet leader Josef Stalin, utilizing a strategy to divide-and-conquer ethnic minorities in the former Russian Empire, proclaimed the ancient Armenian region of Artsakh, ',·
populated almost entirely by ethnic Armenians, as the Nagorno-Karabakh Autonomous Ob last within the Azerbaijan Soviet Socialist Republic; and
Whereas, in 1924, Stalin, in furtherance of the same strategy, created an Azerbaijani exclave on the ancient Armenian land of Nakhichevan, which was subsequently ethnically cleansed of all Armenians and rendered devoid of Armenian cultural presence with the deliberate destruction of Armenian heritage sites, antiquities, and artifacts; and Whereas, prior to the implementation of the Holocaust, in order to garner support from his followers, Adolf Hitler asked "Who, after all, speaks today of the annihilation of the Armenians?"; and
Whereas, the Republic of Turkey continues its genocidal policy by showing no remorse for the crime and engages in the final stage of genocide by denying the veracity of the crimes perpetrated against the Armenian, Greek, and Assyrian nations, while continuing a deliberate project of cultural erasure; and
Whereas, Artsakh, also known as Nagorno-Karabakh, having proclaimed its independence by a democratic referendum of the People before the fall of the Soviet Union and well-before Azerbaijan declared independence, has never been a part of the independent Republic of Azerbaijan; and
Whereas, the Armenian Genocide has been officially recognized by the U.S. Congress in 2019 and U.S. President Joseph R. Biden on April 24, 2021, which solidified full, unequivocal and indisputable recognition of the Armenian Genocide by the legislative and executive branches of the US government; and
Whereas, from 1988 to 1990, the Armenian population in Soviet Azerbaijan was the target of racially-motivated massacres and mass deportations in the cities of Sumgait (February 27-29, 1988), Kirovabad (November 21-27, 1988), and Baku (January 13-19, 1990); and Whereas, in a further deliberate act of cultural genocide, 89 churches, 5,840 ornate cross stones (khachkars) and 22,000 tombstones, constituting more than 98% of tangible Armenian cultural history in the formerly Armenian region of Nakhichevan, were systematically and covertly eradicated by the Azerbaijani government from 1997 to 2006 in order to erase the region's indigenous Armenian past; and
Whereas, having suffered massacres, racial and economic discrimination under the Soviet Azerbaijani occupation, the citizens of the Nagorno Karabakh Autonomous Region declared their independence from the USSR in 1991 and established the free, independent, and democratic Republic of Artsakh; and
Whereas, the republics of Armenia and Artsakh are bastions of freedom, liberty, and democracy in the region; and
Whereas, the governments of Turkey and Azerbaijan openly promote a policy of "One Nation, Two States," and indoctrinate their populations with Armenophobic hatred toward all Armenians as the obstacle to the unification of the two Turkic states within every cross-section of their societies, including primary schools, government institutions, and public political discourse, thereby explicitly encouraging racial hatred toward and ethnic cleansing of Armenians from the region; and
Whereas, the Republic of Turkey has long served as a destabilizing force in the region by illegally blockading the Republic of Armenia, targeting minority groups in Turkey, and destructively pursuing a foreign policy of occupation and targeted violence which has undermined security and peace in the region, marred by gross violations of international law; and
Whereas, on September 27, 2020, Azerbaijan, backed by Turkey, launched an unprovoked attack on Armenia and Artsakh (Nagorno-Karabakh) with large-caliber weapons and thousands of mercenaries recruited from Syria, targeting not only military personnel, but civilian-populated centers, schools, churches, hospitals, and forests, while killing and injuring women, children, the elderly, and journalists, in violation of international law, thereby committing war crimes; and despite Azerbaijan's obligations under the Geneva Conventions and its commitments in signing the ceasefire statement of November 9, Azerbaijan continued to detain approximately 200 Armenian POWs and civilian hostages, some of whom have been tortured and beheaded per Human Rights Watch reports and independent international media; Whereas, these international crimes against humanity must still be prosecuted by international legal institutions; and
Whereas, Azerbaijan has continuously invaded and occupied the sovereign territories of the Republic of Armenia since May 2021, harming or killing civilians and destroying critical, non military infrastructure; and
Whereas, the Republic of Artsakh functioned as a democratically-governed state since its declaration of independence but was landlocked with the sole means of ingress and egress being the road through the Lachin Corridor which connected it to the Republic of Armenia; and Whereas, Azerbaijan began an illegal, genocidal blockade on the Lachin Corridor, the road of life connecting Artsakh to the world through Armenia, on December 12, 2022 that deprived 120,000 Armenians of food, medicine, gas, electricity, internet connectivity, and basic necessities; and
Whereas, Azerbaijan's illegal blockade resulted in the complete incapacitation of hospitals as a result of scarce or depleted medications and equipment necessary to render care to critically-ill patients, as well as increased levels of stress, malnutrition, and anemia in more than 90% of pregnant women, tripling miscarriage rates; and
Whereas, On September 19, 2023, after more than 9 months of illegal blockade of Artsakh, Azerbaijan launched a full-scale invasion which devastated civilian infrastructure such as hospitals, schools, and homes, claiming the lives of countless civilians, forcing the ethnic cleansing of the more than 100,000 ethnic Armenians of Artsakh, and desecrated sacred Armenian sites as a continuation of Turkey's and Azerbaijan's joint policy of genocide of the Armenian People; and
Whereas, in the aftermath of Azerbaijan's ethnic cleansing of Artsakh, it has illegally held Artsakh's political and military leadership hostage, as well as dozens of civilian non-combatants, where they will face fabricated charges in Azerbaijan's notoriously corrupt judicial system, as well as Armenian POWs, who are still held in Azerbaijani detention, in clear violation of the Third Geneva Convention; and
Whereas, Azerbaijani political leaders, including President llham Aliyev continuously threaten the sovereignty of Armenia and the survival of the Armenian Nation with their rhetoric and actions designed to incite hatred against all Armenians and to erase the Armenian presence from the South Caucasus region; and
Whereas, Armenians despite having endured all of these atrocities and more have demonstrated their remarkable resilience and determination to persevere against all odds.

Whereas, Armenia possesses a rich cultural heritage that has withstood the test of time, encompassing ancient architecture, traditional music, dance, and art forms, serving as a testament to the resilience of its people in preserving their identity and heritage.

Whereas, following the Armenian Genocide of 1915, Armenians dispersed across the globe, forming a resilient diaspora community that has maintained strong bonds with their culture and heritage, contributing significantly to the societies in which they reside while upholding their Armenian identity.

Whereas, Glendale is home to one of the largest Armenian American populations per capita in the Diaspora, and Armenians living in Glendale have enriched our City through their leadership and contribution in business, academia, government, the arts and every sector, and Whereas, the City of Glendale has been at the forefront of encouraging and promoting a curriculum relating to human rights and genocide awareness to empower future generations to prevent the recurrence of genocide; and
Whereas, the City of Glendale and the Glendale City Council has committed itself to engaging in robust discussions about unity, solidarity, and support for victims of genocide, and the most effective methods of affirming the United States' commitment to combatting distortion and denial of the historic facts of the Armenian Genocide and the ongoing Genocide of Armenians to date; and
Whereas, every person should be made aware and educated about the Armenian Genocide and other genocides and crimes against humanity.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF

GLENDALE, CALIFORNIA, THAT

1. The City Council hereby finds the leaders of Azerbaijan and Turkey responsible for the international crime of Genocide; and

2. Calls upon Congress and the U.S. President to:
• Immediately provide $750 million in humanitarian aid to the more than 150,000 Armenians forcibly displaced as a result of Azerbaijan's genocidal campaign against the Armenians of Artsakh, which commenced during its illegal invasion of Artsakh in September 2020 and continued for the next 3 plus years; and • Ensure the right-of-return for all who were forcibly displaced by Azerbaijan's aggressions since September 27, 2020, the rights of the Armenians of Artsakh to extraterritorial self-determination (independence), in accordance with the principle of remedial secession and the global political commitment to Responsibility to Protect, and to hold Turkey and Azerbaijan accountable for their numerous and well documented concerted efforts to commit genocide against the Armenian People by way of sanctions , halting U.S. military assistance , fully enforcing Section 907 of the Freedom Support Act; and
• Engage with Azerbaijani authorities for the immediate return of Armenian POWs and hostages; and
• Work toward equitable , constructive , stable, and durable Armenian-Turkish and Armenia-Azerbaijan relations based upon the Republic of Turkey's and Republic of Azerbaijan 's full acknowledgement of the facts and ongoing consequences of the Armenian Genocide, and a fair, just, and comprehensive international resolution of this crime against humanity, including reparations to the Armenian Nation. • Support and vote in favor of the Azerbaijan Sanctions Review Act of 2024 authored by Congresswoman Dina Titus (D-NV) and co-led by Congressman Gus Bilirakis (R FL); and

All Ayes A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE,

CALIFORNIA ADOPTING FINDINGS OF VIOLATION OF GLENDALE
MUNICIPAL CODE CHAPTERS 15.20 AND 30.25 AS A RESULT OF THE

UNPERMITTED DEMOLITION OF A HISTORIC RESOURCE LOCATED
AT 1239 N. EVERETT STREET AND IMPOSING PENALTIES IN

CONNECTION THEREWITH
WHEREAS, GMC section 15.20.090(C) authorizes the City Council to conduct a public hearing to consider evidence of unpermitted complete or partial demolition of a historic resource in violation of Chapter 15.20, to impose penalties stemming from the violation(s), and to authorize recordation of an instrument imposing covenants on a property where the complete or partial demolition of a historic resource occurred without approval of a demolition clearance and issuance of a demolition permit pursuant to GMC Chapter 15.22; and
WHEREAS, GMC section 30.25.060(C) states that in the event any contributing or non-contributing building in a designated or pending historic district overlay zone is completely or partially demolished without approval of a demolition clearance and issuance of a demolition permit pursuant to GMC chapter 15.22, all provisions of GMC section 15.20.090 may apply; and
WHEREAS, the 1925 Spanish Colonial Revival-style single-family residence ("House") located at 1239 N. Everett Street ("Property") was identified as a contributor in the draft historic resource survey for the pending Bellehurst Historic District dated July 2023 and is therefore determined to be an historic resource; and WHEREAS, in or around October of 2023, the House at the Property was demolished without the City-approved demolition clearance or demolition permit required by Glendale Municipal Code (GMC) sections 15.22.040 and 30.25.060; and WHEREAS, on April 30, 2024, the City Council conducted a hearing, and received testimony, reviewed documentary records, including but not limited to the April 16, 2024 staff report and all its exhibits, and other materials presented at the hearing documenting the unpermitted demolition of the House, an historic resource; and WHEREAS, based on hearing and reviewing all of the evidence in connection with the demolition of the House at 1239 N. Everett, and following deliberation, the City Council finds and determines that the demolition of the House at the Property violated requirements for historic preservation, including GMC section 15.20.080, which requires obtaining a demolition clearance prior to the demolition of any potential historic resource, and GMC sections 15.22.040 and 30.25.060; and
WHEREAS, pursuant to GMC section 15.20.090, entitled Enforcement and Penalties, the Council has the authority to impose remedies which are cumulative and

Page 1 of 4 ends

not exclusive, and may include authorizing the filing of a civil action or imposing other remedies based on the date of demolition; and
WHEREAS, based on Council authority, the Council further finds and determines that:
• The demolition of the House warrants imposition of a two-year construction moratorium (instead of a three-year construction moratorium authorized by the GMC) based on, among other factors, that the Owner was previously issued a stop work order halting construction; and • After the expiration of the construction permit ban, reconstruction of the new residence shall be limited to the same footprint, height, and square footage as the demolished House.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA THAT:

1. The recitals herein above are findings incorporated herein and are relied upon as factual support for the determination that the House at the Property was completely demolished in violation of GMC sections 15.22.040 and

30.25.060.

2. The Council's determination that the demolition on the Property violated GMC sections 15.22.040 and 30.25.060 and was complete is also based on the following facts:
a. The photographic record presented at the hearing established that on October 19, 2023, the roof and roof framing and all walls at the east (front) and north and south (side) facades were demolished (the west (rear) wall had been previously removed as part of a permitted rear addition that was under construction at the time of demolition). Only the chimney at the former south side fa9ade, and the raised wood foundation and floor joists remained on the Property.
b. On November 14, 2023, based on inspection by City staff, the demolition materials from the House that were alleged to remain at the Property in a dumpster had been in fact removed, and only a scant amount of demolition material remained on the Property.
c. Due to the extent of demolition and removal of original materials, reconstruction as a penalty option for a partial demolition outlined in GMC section 15.20.090(F) cannot be realistically considered, and on that basis the demolition is considered complete.

3. Based on the findings of violation, Council hereby imposes the following penalties pursuant to GMC section 15.20.090:
a. GMC §15.20.090(C): Imposition of a Two-Year Construction Moratorium: No building or construction related permits shall be issued for the Property upon which the demolition took place for a period of

Page 2 of 4 ends

4. two years commencing on October 19, 2023 and ending on October 18, 2025 ("Construction Prohibition Period"), which is the date the City was notified about the demolition by a community member and on which Community Development Department staff visited the site, documented the demolition, and obtained actual knowledge of the demolition.
b. GMC §15.20.090(C): Recordation of an Instrument Imposing Covenants. In connection with the Construction Prohibition Period, the City shall record an instrument imposing covenants on the Property with the County of Los Angeles that memorializes the time period during which permit issuance is prohibited.
c. GMC §15.20.090(0): Property Maintenance Required: During the Construction Prohibition Period, the Property shall be maintained so as to not constitute a public or private nuisance, or otherwise violate Chapter 15.20. Specifically, the Property shall be maintained:
i. In a clean and orderly manner free of junk, trash, debris, litter, abandoned or inoperable vehicles, stagnant water, abandoned excavations, appliances and furniture, storage containers, vegetation that is not in a healthy or living state, and overgrown vegetation.
ii. With living vegetation, including trees and shrubs, which living vegetation shall be retained and fully maintained, including receiving necessary watering and trimming, during the
Construction Prohibition Period.
iii. With living grasses and groundcovers, and new grass and/or groundcover shall be planted at any areas of bare soil to control dust and erosion. All grasses and groundcovers shall not exceed an overall height of six inches. Additionally, vehicles of any type shall not be parked or stored on the Property and no
remunerative use of any kind shall be allowed.

GMC §15.20.090(E): Limitations on New Development (Complete Demolition): Any new construction following the expiration of the Construction Prohibition Period shall be within the same footprint, height, and square footage as the House that was demolished, with the provision that, pursuant to GMC section 15.20.090(E), the Director of Community Development has the discretion to allow deviation(s) from this limitation to cure prior nonconforming conditions.
