RECOMMENDATION
Approve the motion authorizing a construction contract with Izurieta Fence Company, Inc., for the Scholl Canyon Perimeter Fencing Replacement Project, in the amount of $153,664, plus a 10% contingency of $15,366.

ANALYSIS
The existing chain-link fence and gates at Scholl Canyon Ballpark exhibit significant signs of wear and tear and is significantly beyond repair. The existing fencing is original to the field construction and is in poor condition due to rust, poor gate hinges, and tree damage.

Replacing the entire 2,500 lineal feet of fence including gates will improve the overall aesthetics of the property and maintain the intended security for many years.

The new fence will be a like-for-like replacement of the existing six-foot tall chain-link fence around the perimeter of the park. The removal and installation will be executed in phases to maintain the safety and security of the facility.

On November 14, 2023, Council adopted plans and specifications and directed the City Clerk to advertise for bids. In addition, Public Works staff directly invited seven fencing contractors that have previously and successfully completed work for the city.

Public Works staff along with GYA participation, spent several months clearing dirt, brush and trees at the site in preparation for the project.

On March 5, 2024, the Public Works Department hosted a mandatory job walk, and five contractors attended.

On March 20, 2024, the city received four bids as follows:

1. EverFence $142,140 (Non-Responsive)

2. Izurieta Fence Co., Inc. $153,664

3. Quality Fence Co., Inc. $158,545

4. Gold Coast Fence, Inc. $166,790
The lowest bid, submitted by EverFence was deemed incomplete and non-responsive due to three factors; 1) they did not provide a breakdown of the project cost as shown on the schedule of values page, only a lump sum amount, 2) the numerical amount did not match the written amount on pages F6 and F7 of the Bid Form, and 3) the Bid Form was a copy, lacking a wet signature and corporate seal.

The second lowest bid submitted by Izurieta Fence Company, Inc., is responsive and they are a responsible bidder. They have satisfactorily performed work on similar projects for public agencies throughout Southern California, as confirmed by the references. Izurieta Fence Company, Inc. bid price is consistent with unit prices experienced on other recently completed projects. Staff has verified that Izurieta Fence Company, Inc., has the correct State of California Contractors License to perform the work and it is in good standing. 3{{section.number}}b

The fencing installation is anticipated to be completed within 60 days after receiving the materials on-site. All work will be coordinated with the Parks Department operations to minimize impacts to the site and daily activities.

STAKEHOLDERS/OUTREACH
The Public Works Department will coordinate with Community Services and Parks to minimize disruption to operations and the public.

FISCAL IMPACT
The Scholl Canyon Perimeter Fencing Replacement Project will cost $169,030, which was approved as a part of the FY 2023-24 budget. No new appropriation is being requested at this time. The City Council approved funding is outlined below:

ENVIRONMENTAL REVIEW (CEQA/NEPA)
This project is Categorically Exempt under the provisions of the California Environmental Quality Act (CEQA) as a Class 1., Section 15301.

CAMPAIGN DISCLOSURE
This item is exempt from campaign disclosure requirements.

ALTERNATIVES TO STAFF RECOMMENDATION
Alternative 1: Continue to commit excessive resources to repair the existing fence. The repair cost will soon exceed the replacement cost.

Alternative 2: Install another type of perimeter protect such as masonry wall. The cost of other types of materials would cost significantly more than chain link fencing.

Alternative 3: Consider any other alternative not proposed by staff.
