REPORT TO THE CITY COUNCIL

AGENDA ITEM
Report: The Memorandum of Agreement for the Coordinated Integrated Monitoring Program and the Enhanced Watershed Management Plan for the Upper Los Angeles River Watershed Area.

1. Motion ratifying the approval of the Memorandum of Agreement (MOA) between the City of Glendale, 18 public agencies, and the San Gabriel Valley Council of Governments (SGVCOG) regarding the administration and cost sharing for implementing the Coordinated Integrated Monitoring Program (CIMP) and the Enhanced Watershed Management Plan (EWMP) for the Upper Los Angeles River (ULAR) Watershed Management Area.

COUNCIL ACTION
Item Type: Consent Item
Approved for 07/09/2024 calendar

EXECUTIVE SUMMARY
The intent of this item is to ratify the approval of a MOA for the CIMP and EWMP for the ULAR Watershed Management Area to help the City comply with the State’s Municipal Separate Storm Sewer System (MS4) Permit requirements.

RECOMMENDATION
That the City Council ratify the approval of the MOA between the City of Glendale, 18 public agencies, and the SGVCOG regarding the administration and cost sharing for implementing the CIMP and EWMP for the ULAR Watershed Management Area.

ANALYSIS
On December 28, 2012, the Final Waste Discharge Requirements for the MS4 Permit became effective. The MS4 Permit covers the unincorporated areas of Los Angeles County, the Los Angeles County flood Control District and 84 cities within Los Angeles County, including the City of Glendale. Permittees are provided with various options for compliance including the option to develop an EWMP.

The City of Glendale drainage facilities drain into the ULAR. Therefore, the City joined the ULAR Watershed EWMP group, which is working together in the administration and development of the EWMP and CIMP to meet MS4 Permit requirements in a cost- effective and comprehensive approach.

The ULAR Watershed EWMP group includes cities of Glendale, Alhambra, Burbank, Calabasas, Hidden Hills, La Canada Flintridge, Los Angeles, Montebello, Monterey Park, Pasadena, Rosemead, San Fernando, San Gabriel, San Marino, South El Monte, South Pasadena, Temple City, the County of Los Angeles, and the Los Angeles County Flood Control District.

The total cost for the CIMP and EWMP is $5,358,422 for all the 19 participating agencies as shown on Table 1 of Exhibit A of the attached MOA (page 35 of 47). The cost breakdown for the City’s share for each fiscal year is as follows:

FISCAL YEAR COST
2023-2024 $101,385
2024-2025 $ 98,139
2025-2026 $117,135
TOTAL $316,659
The purpose of the CIMP and EWMP MOA is to allow all 19 agencies to collaborate on and cooperatively fund the implementation of water quality monitoring, which was approved by the Water Quality Control Board on August 5, 2015 pursuant to the MS4 Permit. The City of Los Angeles is the lead agency and the SGVCOG is the entity providing the following services:

1. Invoicing and collecting funds to cover the costs of monitoring services and EWMP related tasks;

2. Administering this MOA

3. Negotiating and entering into agreements with, and collecting funds from individual National Pollutant Discharge Elimination System permit holders for cost-sharing of monitoring services; and

4. Negotiating and entering into agreements with consultant(s) to execute services to uphold tasks of this MOA.

The scope of work for CIMP and EWMP include but not limited to:
a. Monitoring of receiving waters
b. Monitoring of storm water outfall
c. Monitoring of non-storm water outfall
d. Data management
e. Processing of capital expenses
f. Processing of operation and maintenance expenses
g. Contracted services
h. Project management
The City has been in a MOA regarding the administration and cost sharing for implementing the CIMP and EWMP for the upper Los Angeles River Watershed Management Area with SGVCOG and other public agencies since 2018. In 2023, a new MOA with SGVCO and 18 other public agencies was entered into, which now requires City Council ratification.

ALTERNATIVES TO STAFF RECOMMENDATION
Alternative 1: Do not approve the attached motion. City of Glendale will not be able to participate in the administration and cost sharing of the CIMP and EWMP for the Upper Los Angeles River watershed with 18 other agencies. The cost to the City of Glendale will substantially increase as Glendale will have to create its own integrated monitoring program to comply with the monitoring requirements.

Alternative 2: The City Council may consider any other alternative not proposed by staff.
