3 RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE,

CALIFORNIA, REJECTING ALL BIDS, DISPENSING WITH COMPETITIVE

BIDDING, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS OR HIS

DESIGNEE TO NEGOTIATE WITH ONE OR MORE BIDDERS,

AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION
CONTRACT IN AN AMOUNT “NOT-TO-EXCEED” $14,750,000, AND
APPROVING A 10% RESERVE CONTINGENCY IN THE AMOUNT NOT-
TO-EXCEED $1,475,000, FOR THE LA CRESCENTA AVENUE
REHABILITATION PROJECT, SPECIFICATION NO. 3829R.

WHEREAS, on May 21, 2024, Council approved and adopted Specification No. 3829R for the La Crescenta Avenue Rehabilitation Project (“Project”); and WHEREAS, the Public Works Department received 3 bids for the Project; and WHEREAS, a detailed review of the bids revealed that all bids were non- responsive; and did not meet the mandatory minimum qualifications with respect to contractor’s references and previously completed projects, which required at least three different projects to be completed in the last five years as a prime contractor that have a minimum of three traffic signal improvements, a minimum total contract amount of $5,000,000, work related to sewer improvements, and work related to street improvements; and
WHEREAS, Public Works Department staff believes a collaborative negotiation with one or more of the bidders would allow the bidder(s) to better understand the project requirements and eliminate excessive contingencies that the contractor(s) may have included in their initial submittal; and
WHEREAS, the Project currently has significant momentum due to the Public Works Department staff’s efforts and in order to maintain the progress of this project and funding, staff believes it is in the City’s best interest to negotiate with one or more of the contractors that submitted bids; and
WHEREAS, Glendale City Charter, Article IV, Section 9 authorizes the City Council, after rejecting bids, to have the contract negotiated without further bidding; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GLENDALE:

1. The foregoing facts are deemed to be true and correct, and are a basis for rejecting the bids.
