1 RESOLUTION NO. _____________

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

GLENDALE, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO

ENTER INTO A MILLS ACT HISTORICAL PROPERTY CONTRACT
WITH THE OWNER OF 2535 E. CHEVY CHASE DRIVE (DERBY
HOUSE, GLENDALE REGISTER NO. 22)
WHEREAS, the residential property located at 2535 E. Chevy Chase Drive (the “Property”), known as the Derby House, was listed on the Glendale Register of Historic Resources in 1997 (GR No. 22) as one of the first thirty-seven properties included at the time of the Register’s initial adoption; and
WHEREAS, the owner of record of the Property requests to enter into a Mills Act contract with the City of Glendale for the benefit of property tax savings in exchange for continued preservation of the property; and
WHEREAS, the Historic Preservation Commission, at a regularly scheduled meeting on September 19, 2024, voted unanimously (3-0) to recommend that the City Council authorize the City Manager to enter into a Mills Act contract with the Property owner, subject to six conditions, primarily focused on waterproofing the house and the repair of several deteriorated features; and
WHEREAS, the City Council has conducted a duly noticed public hearing pursuant to the provisions of Section 15.20.070(A) of the Glendale Municipal Code; and WHEREAS, the City Council of the City of Glendale, pursuant to Section

15.20.070(A), finds that the Derby House is eligible for a Mills Act contract because it was previously listed in the Glendale Register of Historic Resources in 1997; it was one of the first thirty-seven properties included at the time of the Register’s initial adoption in that year, and the Property retains a high level of historic integrity and remains one of the finest examples of Modern architecture in the city; and WHEREAS, the City Council of the City of Glendale further finds that because the Property is listed in the Glendale Register of Historic Resources that entering into a Mills Act contract with the Property owner is appropriate based on all of the information in the record.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE AS FOLLOWS:

Section 1. The recitals above are incorporated herein by this reference.

Section 2. That the City Manager is authorized to enter into a Mills Act historical property contract with the Property owner subject to the following conditions:

1. Provide waterproofing of exterior walls and foundations. 2 2. Regrade hillside areas as needed to direct runoff away from the house through construction of low retaining walls, swales, and other appropriate methods.

3. Replacement and repair of roof areas as required.

4. Repair and waterproof exterior floor and stair surfaces and provide or repair floor drains as required.

5. Repair wood doors and windows as required.

6. Repair and restore textile blocks as required.

Section 3. That entering into a Mills Act contract with the Property owner is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Title 14 CCR Sections 15331 (preservation of historic resources) and 15308 (actions by regulatory agencies for protection of the environment).
