COUNCIL ACTION
Item Type: Consent Calendar
Approved for April 1, 2025 calendar

EXECUTIVE SUMMARY
Following a February 11, 2025, noticed public hearing to consider the appeal of the decision of the Design Review Board to approve with conditions Design Review Case No. PDR 002532-2023 for the construction of a new two-story, 5,067 SF single-family residence and an attached three-car garage on a 31,290 SF lot in the R1R, FAR District III zone (“Project”), the Council continued the hearing until March 11, 2025 to allow the parties time to discuss potential new or modified conditions that would be acceptable to both sides, so that the Council could further consider the appeal with such potential new conditions. At the March 11, 2025, continued hearing, both parties represented they were amenable to the Project’s approval with the addition of six new conditions.

Accordingly, the Council directed the City Attorney to prepare a motion to sustain the Design Review Board’s decision of April 25, 2024, to approve the Project with the original conditions, along with the 6 additional conditions agreed to by both sides (with some revisions for clarity); this motion is now before Council for its consideration and vote.

RECOMMENDATION
That the City Council adopt a motion to sustain the Design Review Board's approval of Case No. PDR 002532-2023 with the Design Review Board’s conditions, along with the 6 additional conditions presented at the continued hearing on March 11, 2025, and based on all of the evidence, testimony, reasoning and findings of the DRB articulated at the April 25, 2024 DRB hearing, and set forth in the DRB’s Record of Decision dated April 25, 2024, staff’s analysis of the appeal set forth in this and any previous staff reports, any additional testimony or evidence presented at the hearings, and the Project’s overall conformance with the Comprehensive Design Guidelines.

BACKGROUND
On February 11, 2025, the City Council held a noticed public hearing to consider the appeal of the decision of the Design Review Board to approve with conditions Design Review Case No. PDR 002532-2023 for the construction of a new two-story, 5,067 SF single-family residence and an attached three-car garage on a 31,290 SF lot in the R1R, FAR District III zone. The first floor will contain 2,880 SF and the second floor will contain 2,187 SF. A swimming pool and 1,400 SF basement (not counted as floor area due to ceiling height) are also proposed.

The Council voted to continue the February 11, 2025 hearing to the March 11, 2025 City Council meeting, and encouraged the parties to meet and discuss potential Project modifications or new or modified conditions that would be acceptable to both sides, so that the Council could further consider the appeal with such potential new conditions.

On March 11, 2025, the City Council held the continued public hearing for the Project, and heard from both the Project applicant and the appellant regarding 6 new conditions that were acceptable to both sides for the Project to be approved. The Council closed the hearing and, by a vote of 3-0 (with Mayor Asatryan not able to participate and Councilmember Najarian recused), directed the City Attorney to prepare a motion to sustain the Design Review Board’s decision of April 25, 2024, to approve the project with conditions, along with the 6 additional conditions agreed to by both sides (with some revisions for clarity).

The requested motion to sustain the Design Review Board approval for the Project, with all of the original conditions, along with the 6 additional conditions presented at the March 11, 2025 continued hearing, has been prepared for Council’s consideration and vote.
