CITY OF GLENDALE, CALIFORNIA

REPORT TO THE CITY COUNCIL

AGENDA ITEM
Report: Declaration of Certain City-owned properties as “Exempt Surplus” from the Surplus Land Act (“SLA”) – revised resolution

1. Resolution finding and declaring certain City-owned properties are exempt from the Surplus Land Act

COUNCIL ACTION
Item Type: Consent Calendar
Approved for April 15, 2025 calendar

EXECUTIVE SUMMARY
On March 4, 2025, the City Council adopted Resolution No. 25-31 making findings and declaring ten City-owned properties exempt from the Surplus Land Act (SLA) using the “Small Surplus Land Parcel” exemption. Staff submitted the Resolution to the State Housing and Community Development Department (HCD) for review and HCD noted that one assessor parcel number (APN) for Downtown Lot 7 (300 E. Broadway) was misidentified. The HCD requests the resolution be readopted with the corrected APN and resubmitted. The HCD has indicated they concur with the City’s exemption findings, however issuing an approval is contingent upon submitting the revised resolution with the corrected APN for Lot 7.

RECOMMENDATION
Adopt the revised resolution declaring certain City-owned properties exempt from the Surplus Land Act and authorize submission to HCD for review and approval.

ANALYSIS
On March 4, 2025, the City Council adopted Resolution No. 25-31 making findings and declaring the following ten City-owned properties exempt from the Surplus Land Act (SLA) using the “Small Surplus Land Parcel” exemption for properties less than one-half acre (21,780 SF):

10) 805 Fairmont** - 5635-019-902 18,956
*Note – This APN was misidentified as -913 instead of -911. **Note- Site is an irregular shaped remnant from the Fairmont Avenue Overpass project and is developed with a 7,113 SF building.

During HCD’s review of Resolution No. 25-31 they noted that the Lot 7 APN referenced above, was misidentified (one digit was off). HCD requests the resolution be readopted with the corrected APN so they have a complete and correct record of the City’s request.

The revised resolution restates the appropriate findings for the ten “Small Surplus Land Parcel” properties and if adopted will be submitted directly to the HCD representative per HCD’s request. As previously noted and restated, these properties qualify as “exempt surplus land” under Government Code Section 54221(f)(1)(B) because each property is less than one-half acre (21,780 SF) and are not contiguous to land owned by a State or local agency that is used for open-space or low- and moderate-income housing purposes.

FISCAL IMPACT
There is no fiscal impact associated with this report.

ENVIRONMENTAL REVIEW (CEQA/NEPA)
The proposed resolution declaring the properties exempt surplus property is itself exempt from the California Environmental Quality Act (CEQA) because the requested action is for purposes of property characterization under the SLA for purposes of potential future disposition by sale or lease, and provides no entitlement or agreement to develop the properties. Based on these facts, it can be seen with certainty that there 3{{section.number}}{{item.number}}

is no possibility that this activity may have a significant effect on the environment pursuant to CEQA Guidelines Section 15061(b)(3).

CAMPAIGN DISCLOSURE
This item is exempt from campaign disclosure requirements.

ALTERNATIVES TO STAFF RECOMMENDATION

1. Not adopt the revised resolution. This would leave the exemption status unresolved because the HCD will not approve the City’s requested exemption without the revised resolution.

2. Any other alternative not proposed by staff.
