RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA, ADOPTING THE REVISED SPECIFICATION NO. 3893R,

REJECTING ALL BIDS, DISPENSING WITH COMPETITIVE BIDDING,

AUTHORIZING THE DIRECTOR OF PUBLIC WORKS OR HIS

DESIGNEE TO NEGOTIATE WITH THE QUALIFIED BIDDERS, FOR THE

GLENDALE ARTS AND ENTERTAINMENT DISTRICT IMPROVEMENTS
ON ARTSAKH AVENUE PROJECT, SPECIFICATION NO. 3893R.

WHEREAS, on April 15, 2025, Council approved and adopted Specification No. 3893R for the Glendale Arts and Entertainment District Improvements on Artsakh Avenue Project (“Project”); and
WHEREAS, this Project’s specifications were revised from the previous Specification No. 3893, wherein no bids were received; and
WHEREAS, Specification No. 3893R was revised to garner competitive bids for the Project; and
WHEREAS, the Public Works Department received 3 bids for the Project; and WHEREAS, a detailed review of the bids revealed that lowest bid was non- responsive; and did not meet the mandatory minimum qualifications with respect to contractor’s references and previously completed projects, and two bids were significantly higher than engineer’s estimate; and
WHEREAS, given that this Project has been advertised twice without receiving any responsive bids from responsible bidders that were below the engineer’s estimate; and
WHEREAS, Public Works Department staff believes a collaborative negotiation with the qualified contractors that submitted bids would allow the contractor(s) to better understand the Project requirements and eliminate excessive contingencies that the contractor(s) may have included in their initial submittal; and WHEREAS, the Project currently has significant momentum due to the Public Works Department staff’s efforts and in order to maintain the progress of this Project and funding, staff believes it is in the City’s best interest to negotiate with the qualified contractors that submitted bids on January 15, 2025; and WHEREAS, Glendale City Charter, Article IV, Section 9 authorizes the City Council, after rejecting bids, to have the contract negotiated without further bidding; and 2{{section.number}}2
