4 ORDINANCE NO. _______

AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA, AMENDING SECTION 10.24.020 OF THE GLENDALE MUNICIPAL CODE, 1995,

RELATING TO PRIMA FACIE SPEED LIMITS ON NON-LOCAL CITY STREETS WHEREAS, Title 10 of the Glendale Municipal Code, 1995, provides standards for vehicle and traffic regulation within the City of Glendale; and WHEREAS, such standards include prima facie speed limits on non-local city streets under section 10.24.020; and
WHEREAS, based upon the California Vehicle Code and California Manual on Uniform Traffic Control Devices, the prima face speed limits on certain street segments within the City of Glendale are eligible for revision due to recent Engineering and Traffic Surveys; and
WHEREAS, the revisions in this Ordinance are consistent therewith and in the best interest of the City of Glendale.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GLENDALE:

SECTION 1. The above recitals are true and correct.

SECTION 2. Section 10.24.020 of the Glendale Municipal Code, 1995, is hereby amended to read as follows:

10.24.020 Prima facie speed limits on non-local city streets.

A. It is determined that upon the basis of an engineering and traffic survey that a speed limit greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic and would be reasonable and safe upon the following non-local city streets, other than state highways, which streets would otherwise be subject to a prima facie speed limit permitted by state law of 25 miles per hour and maximum speed limit of 65 miles per hour. Upon the erection of appropriate signs giving notice thereof on streets or parts of streets, the prima facie speed limits shall be as set forth herein. This section does not apply to any 25 mile per hour prima facie limit which is applicable when passing a school building or the grounds thereof or when passing a senior center or other facility primarily used by senior citizens.

SECTION 3. Compliance with California Environmental Quality Act. The City Council finds and determines that this Ordinance is not subject to the California Environmental Quality Act (“CEQA”) because it is not a “project” within the meaning of CEQA. Pursuant to section 15378, subdivision (b)(2), of Division 6 of Title 14 of the California Code of Regulations (the “CEQA Guidelines”), the term “project” does not include continuing administrative or maintenance activities, including general policy or procedure making (except as applied to specific instances not germane to this Ordinance).

Even if it is a “project,” the City Council finds and determines that this Ordinance is categorically exempt from CEQA pursuant to CEQA Guidelines section 15301 in that it consists of the operation, maintenance, or minor alteration of existing public facilities or topographical features, namely, existing streets, involving negligible or no expansion of existing or former use. Moreover, the City Council finds and determines with certainty that there is no possibility that the activity in question may have a significant effect on the environment; thus, it is exempt from CEQA pursuant to CEQA Guidelines section 15061, subdivision (b)(3).

SECTION 4. Severability. This Ordinance is adopted under the authority of the Charter of the City of Glendale and state law. If any section, subsection, clause or phrase is declared invalid or otherwise void by a court of competent jurisdiction, it shall not affect any remaining provisions hereof. In this regard, the City Council finds and declares that it would have adopted this measure notwithstanding any partial invalidity hereof.

SECTION 5. Effective Date. This Ordinance shall take effect and be in force thirty (30) days after the date of its passage.

Passed and adopted by the Council of the City of Glendale on the _____ day of _______________, 2025.
