8 RESOLUTION NO. _____________________

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA, DISPENSING WITH COMPETITIVE BIDDING; AND AUTHORIZING THE DEPUTY DIRECTOR OF FINANCE – PURCHSAING OR DESIGNEE TO EXECUTE A PURCHASE ORDER/SERVICE AGREEMENT WITH KOMPAN INC.

FOR THE ADAMS SQUARE MINI PARK PLAYGROUND REPLACEMENT PROJECT IN AN AMOUNT NOT TO EXCEED $511,813.26, AND FOR THE MAYORS

BICENTENNIAL PARK PLAYGROUND REPLACEMENT PROJECT IN AN AMOUNT NOT TO EXCEED $701,087.26.

WHEREAS, the playground equipment at Adams Square Mini Park and Mayors Bicentennial Park was installed more than 16 and 19 years ago, respectively; and WHEREAS, the playground equipment at Adams Square Mini Park and Mayors Bicentennial Park has outlived its useful life and requires replacement to meet the growing needs of a diverse population and to comply with current safety and accessibility standards; and
WHEREAS, the Director of Community Services and Parks has recommended the purchase and installation of playground equipment manufactured by KOMPAN, Inc, which originally installed the playground equipment at Adams Square Mini Park; and WHEREAS, KOMPAN Inc. designs, manufactures, and installs commercial playground equipment for children of all ages and abilities; and WHEREAS, KOMPAN Inc. is well-qualified and has the capacity, resources, personnel, and desire to provide the City with playground equipment; and WHEREAS, KOMPAN Inc. is committed to sustainable practices with significant percentages of pre-consumer and post-consumer recycled products, the use of which further enhances the City’s efforts in sustainability; and WHEREAS, KOMPAN Inc. is a supplier registered with OMNIA Partners, a nationwide purchasing cooperative, of which the City of Glendale is a member, that enables public agencies to pool their purchasing power through competitively bid, nationally solicited contracts; and
WHEREAS, entering into a Purchase Order/Service Authorization with KOMPAN Inc. will enable the playground equipment manufacturer to furnish cost-effective playground equipment; and
WHEREAS, both playground replacement projects are funded by the Los Angeles County Safe, Clean Neighborhood Parks and Beaches Measure of 2016 (Measure A) through the Los Angeles County Regional Park and Open Space District; and

8 WHEREAS, sufficient funds exist to authorize the Deputy Director of Finance – Purchasing to execute a Purchase Order/Service Authorization with KOMPAN Inc. for the purchase of playground equipment for installation at Adams Square Mini Park and Mayors Bicentennial Park; and
WHEREAS, during a multiphase community engagement process, members of the public significantly favored playground designs by KOMPAN Inc.; and WHEREAS, the community-favored designs by KOMPAN Inc. were customized for Adams Square Mini Park and Mayors Bicentennial Park and cannot be replicated by other suppliers; and
WHEREAS, the playground equipment at Adams Square Mini Park and Mayors Bicentennial Park must be replaced with new playground equipment expeditiously; and WHEREAS, authorizing the Deputy Director of Finance – Purchasing to execute a Purchase Order/Service Authorization with KOMPAN Inc. for playground equipment and site improvements will result in the expeditious replacement of aging equipment with designs favored by the community; and
WHEREAS, given that outdated playground equipment must be replaced in a cost-effective manner and expeditiously to meet evolving needs and standards, it appears that adequate justification exists and it is in the City’s best interest—upon the recommendation of the Director of Community Services & Parks—to dispense with competitive bidding and authorize the Deputy Director of Finance – Purchasing to execute a Purchase Order/Service Authorization with KOMPAN Inc. for the Adams Square Mini Park Playground Replacement Project in an amount not to exceed $511,813.26, and for the Mayors Bicentennial Park Playground Replacement Project in an amount not to exceed $701,087.26.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA:

1. The foregoing facts are deemed to be true and correct and are a basis for dispensing with competitive bidding and authoring the execution of a contract with a single source for the purchase and installation of playground equipment.
