COUNCIL ACTION
Item Type: Consent Calendar
Approved for September 9, 2025 calendar
EXECUTIVE SUMMARY
On May 20, 2025, the City Council approved an amendment to contract C106224 with David Volz Design Landscaping Architects (DVD) for project design services during the extended construction duration for the Fremont Park Renovation Project. Due to an error in the description of this contract in the staff report and approved motion, staff is unable to process this amendment. Therefore, a revised motion increasing the contract amount by $35,000 is needed with accurate financial terms of the existing contract stated, so that this PSA amendment may be processed and the associated project completed.
RECOMMENDATION
Pass a motion authorizing the City Manager to increase the amount of the PSA with DVD by $35,000 for additional project design consulting services related to the Fremont Park Renovation Project.
ANALYSIS
The Fremont Park Renovation Project is currently in the final stages of the construction phase and is expected to open in Fall 2025. The project includes a comprehensive renovation of this facility including the construction of a new community building, a new soccer field with LED lighting, new solar-covered parking canopies, and new irrigation and landscaping. DVD has been involved with this project throughout the design and construction phases providing project design support services.

services through the end of the construction phase. This amendment cannot be implemented because the staff report and motion both incorrectly indicated that the proposed amendment will increase the contract amount to a new not-to-exceed amount of $458,382. In actuality, the current amount of the PSA is $1,298,214, so the proposed amendment will increase the contract amount to $1,333,214.
The PSA with DVD is an older contract that was entered into prior to the City’s implementation of the Tyler Munis financial system in 2018. This contract was initiated by the Community Services and Parks Department for preliminary design services related to the project and eventually passed on to the Public Works Department when the construction phase was imminent. When contracts were transitioned from the City’s old financial system, the amounts of contracts entered at that time were only available balances and not the total contract amounts. Thus, the amount of this contract shown in the new financial system is less than its actual amount. When the May 20, 2025, staff report was prepared, staff referenced the contract amount shown in the new system.
There are still a few contracts more than seven years old that were transitioned from Peoplesoft to Tyler Munis. These contracts have distinct project numbers, which allows staff to differentiate them from contracts that were originally entered into the Tyler Munis system. Staff will be more aware of the peculiarity of older contract balances moving forward.
STAKEHOLDERS/OUTREACH
None.
FISCAL IMPACT
The additional project design services for the Fremont Park Renovation Project will cost $35,000, which was approved as a part of the FY 2025-26 budget. No new appropriation is being requested at this time. The City Council approved funding is outlined below:
