REPORT TO THE CITY COUNCIL
AGENDA ITEM
Report: Fire Department request to revise and amend the Comprehensive Citywide Fee Schedule
1. Resolution amending the Comprehensive Citywide Fee Schedule for the Fiscal Year 2025-26 to modify fees that are in relation to the Fire Prevention Bureau.
COUNCIL ACTION
Item Type: Consent Calendar
Approved for October 21, 2025 calendar
EXECUTIVE SUMMARY
The Fire Department has identified a small subset of fees contained within the Fire Prevention Bureau that require amendment. In the first instance, a single set of Fire Sprinkler Fees were inadvertently transposed and require correction to accurately depict the cost of each specific permit. In the second instance, there are four pass-through State Certified Unified Program Agency (CUPA) surcharges that need to be revised by removing the fixed dollar amounts and instead refer to the California Environmental Protection Agency (CalEPA) State Surcharges, which is the agency that establishes the fees imposed. Therefore, when the State makes future adjustments to these fees, the City will charge the most current amount and transmit those fees to the state as a passthrough.

RECOMMENDATION
Staff recommends that the City Council amend the Citywide Fee Schedule by adopt a Resolution to modify the transposed sprinkler inspection fees as well as revise the CUPA fees to cite the CalEPA State Surcharges and.
ANALYSIS
The Fire Department has identified a small subset of fees contained within the Fire Prevention Bureau that warrant attention. The fees located in the Citywide Fee Schedule are found within VIII – Fire, Section 1: Miscellaneous Fire Fees and are listed below:
1. Fire Sprinkler Fees:
oThese fees were incorrectly transposed, and the correction of the fees is needed to properly align with the accurate cost structure. Fee #39 Inspection Per Head:
oIt should be $6, not the current $32
Fee #40 Plan Check Per Inlet/Outlet:
oIt should be $32, not the current $6
2. CUPA State Surcharge Fees:
oCurrent fee schedule lists four separate State pass-through surcharges with a dollar amount, which is incorrect as these are not City Fees, but rather mandated pass-through State Surcharges imposed by CalEPA. To correct this Staff recommends removing the posted dollar amounts listed below and instead the fees should state, “Reference the CalEPA State Surcharges.” These fees need to be corrected prior to customer billing scheduled in November 2025.
Fee #167 State CUPA Regulated Facility Oversight Surcharge:
oRemove $97.00
Fee #174 State CUPA Program Oversight Surcharge -
Aboveground Storage Tank Program (ST-AST):
oRemove $26.00
Fee #175 State CUPA Program Oversight Surcharge – California Accidental Release Program (ST-CalARP):
oRemove $382.00
Fee #176 State CUPA Program Oversight Surcharge -
Underground Storage Tank Program (ST-UST):
oRemove $20.00

FISCAL IMPACT
The amendment of the two transposed Fire Sprinkler Fees will result in a projected revenue loss of $326,820 to the General Fund (34630-1010-GFD-4003-P0000). This is because the revenue calculations depend on how often the fee is imposed and the fee amount itself. The revenue from the CUPA State Surcharges is pass-through income, meaning it’s collected but then paid directly to CalEPA, so it doesn’t affect net revenue.
