Report: Approval of Revisions to the Executive Benefits and Compensation Resolution for CalPERS Compliance
1. Resolution Providing for Supplementary Benefits and Compensation of Certain Officers and Executive Employees
COUNCIL ACTION
Item Type: Action
Approved for March 3, 2026 calendar
EXECUTIVE SUMMARY
Revisions to the Executive Benefits and Compensation Resolution are needed to clarify the eligibility criteria and conditions of payment related to compensation used in pension calculations and to conform with the Public Employees’ Retirement Law (PERL).
RECOMMENDATION
That the Council approve the Revised Executive Benefits and Compensation Resolution.
ANALYSIS
As a contracting agency of the California Public Employees’ Retirement System (CalPERS), the City of Glendale is subject to statutory and regulatory requirements that govern whether compensation is reportable for pension calculation purposes. The PERL, the Public Employees’ Pension Reform Act of 2013 (PEPRA), and the California Code of Regulations (CCR) require that contracting agencies must accurately reflect information related to compensation items in publicly available documentation approved by the City Council. For compensation paid in addition to base salary, this must include the relevant intent, eligibility criteria, and conditions of payment.
Specifically, all items of compensation which are reportable to CalPERS aside from salary are delineated and defined in the exclusive list of special compensation items under Title 2 California Code Regulations (CCR) sections 571(a), for classic members, and 571.1(b), for PEPRA members. All special compensation items must also meet the requirements of CCR sections 571(b) and 571.1(a), which require that every special compensation item is included in a publicly available document that:

Has been duly approved and adopted by an employer's governing body in accordance with requirements of applicable public meetings laws; Indicates the conditions for payment of the item of special compensation, including, but not limited to, eligibility for, and amount of, the special compensation; Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website;
Indicates an effective date and date of any revisions
Is retained by the employer and available for public inspection for not less than five years; and
Does not reference another document in lieu of disclosing the item of special compensation.
For base salary, there are also specific requirements related to those in single-incumbent positions under Government Code Section 20636(e) and CCR section 571.1(a)(2), which limit pensionable compensation during a pension calculation period to that which is received by a “group or class of employment.” Consistent salary increase practices must therefore be included in approved documentation in order to show that executives are eligible for the same type of compensation increases.
As such, clarifications were added to the Executive Benefits and Compensation Resolution were necessary for base salary, specific types of special compensation, and for updating the employee CalPERS contribution rates.
