RESOLUTION NO. __________

A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, CALIFORNIA

AUTHORIZING THE ESTABLISHMENT AND RECORDATION OF PUBLIC STREET

EASEMENTS OVER CERTAIN PRIVATELY OWNED PARCELS HISTORICALLY

USED AS PUBLIC STREETS AND SIDEWALKS, AND WAIVING ALL

ASSOCIATEDDOCUMENTATION AND RECORDING FEES IN CONNECTION WITH

CURRENT AND FUTURE CAPITAL IMPROVEMENT PROGRAM PROJECTS WHEREAS, during the design phase for various Capital Improvement Program projects, the Public Works staff has and does discover portions of several privately owned parcels that have been historically and continuously utilized by the public as streets and sidewalks, without the benefit of formally recorded public street easements; and
WHEREAS, this condition creates a legal and administrative gap that could complicate the city’s ability to construct, maintain, and invest in sidewalks, streets, and utility infrastructure, including but not limited to the District 12 ADA Curb Ramp Installation and Sidewalk Repair Project and the Pavement management Program Implementation Project and any future CIP projects; and WHEREAS, the establishment and recordation of public street easements over these areas is necessary to ensure proper legal recognition, preserve continued public access, and support the orderly design, construction, operation, and maintenance of public infrastructure improvements; and
WHEREAS, City Council finds that the suspension of City-imposed fees associated with the preparation, review and recordation of such easements—including but not limited to, the Easement Preparation Fee (currently $805.00) and the Legal Description Review Fee (Varies; $400.00 minimum) and applicable recording fees—is appropriate and equitable, as the easements reflect existing public use rather than conferring a new or exclusive private benefit upon the affected property owners; and WHEREAS, the City Council further finds that waiving such fees will facilitate timely acquisition and recordation of necessary easements, thereby promoting the public health, safety, and welfare and ensuring the efficient delivery of critical infrastructure project.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE:

1. Good cause exists to suspend and waive all applicable City-imposed fees associated with the preparation, review, and recordation of public street easements required for Capital Improvement Projects; and 25a
