COUNCIL ACTION
Item Type: Consent Item
Approved for August 11, 2026 calendar
EXECUTIVE SUMMARY
TRC and Worley have and continue to provide exceptional OE services. Delays encountered during the design and construction of the Scholl Biogas Project (Project) have made it necessary to extend these services to ensure the continuity and integrity of the Project, as well as to ensure the eventual realization of the Power Plant.
RECOMMENDATION
Authorize the City Manager to extend the Term of the existing PSAs with TRC and Worley until the final completion of the Scholl Biogas Project and to add $250,000, and $2,000,000 to each PSA, respectively.

While starting a new Request for Proposal (RFP) process to solicit proposals and hire new OE is possible, it is very implausible given the amount of time it would take to bring new consultants up to speed on the Project. This would have a detrimental impact to the Project schedule not to mention draw into question the integrity of the overall Project design and implementation.
ANALYSIS
With City Council’s approval in January of 2023, Worley was retained as GWP’s OE to manage the Scholl Biogas Project as well as monitor project design, provide equipment procurement supervision, assist with permits, address some environmental compliance activities, and assist with the Project commissioning. GWP also entered into a contract with TRC to provide biological construction monitoring for the Project as part of the Mitigation Monitoring and Reporting Program, adopted by City Council on November 11, 2021.
In July of 2024, City Council approved amendments to increase the not-to-exceed amounts as well as to extend the terms of the TRC and Worley PSAs for an additional two years.
Currently, the Scholl Biogas Project remains ongoing, and continued assistance from both Worley and TRC is necessary to support Project completion. TRC and Worley have been responsive to GWP’s needs, have provided and continue to provide valuable technical support, and have demonstrated a continued commitment to the Project’s success. Worley and TRC have consistently demonstrated their commitment to excellence and have proven to be invaluable partners with GWP in the Scholl Biogas Project. Therefore, it is respectfully requested and recommended that the City Council authorize the extension of the Term of each PSA until the Project’s final completion and increase the not-to-exceed amounts of each PSA.

ENVIRONMENTAL REVIEW (CEQA/NEPA)
The action herein to authorize the extension of the two consultant PSAs and add funds is not a project as defined under the California Environmental Quality Act (CEQA) and as such not subject to CEQA. Additionally, the Scholl Biogas Project underwent the required CEQA review as required by the CEQA Guidelines (14 Cal Code Regs §15082(a)(1)), the City issued a Notice of Preparation of the Draft Environmental Impact Report (DEIR) for the Proposed Project on March 21, 2019. The Project DEIR was circulated for public review and comment from July 1, 2020, through September 30, 2020, for a 90-day period. Numerous public comments were received and responses to each public comment were drafted and incorporated into the Final Environmental Impact Report (FEIR), which was prepared pursuant to the City of Glendale’s adopted Procedures for Preparation and Processing of Environmental Documents (Glendale CEQA Guidelines, 2016) and Public Resources Code §§21000 et seq., and the CEQA Guidelines (15 Cal Code Regs §15000 et. seq.). The FEIR was published on the City’s website on August 2, 2021. On November 30, 2021, the EIR was certified by the City Council.
CAMPAIGN DISCLOSURE
In accordance with the City Campaign Finance Ordinance No. 5744, Exhibits 1 and 2 contain the names and business addresses of the members of the board of directors, the chairperson, CEO, COO, CFO, Subcontractors and any person or entity with more than ten percent (10%) or more in the company proposed for contract.
ALTERNATIVE TO STAFF RECOMMENDATION
: Do not approve amending the existing PSAs with TRC and Worley, requiring staff to prepare new RFPs and solicit proposals, evaluate, and recommend the award of new PSAs to new consultants. The process, which normally takes four to six months, will result in significant delays in the Scholl Biogas Project, in turn resulting in change orders to adjust the schedule of the contractors and increase the contractual amounts due to City-caused delays. Additionally, the delays will require City to purchase power from outside resources during the time that Project is not available.
