STAFF REPORT
TO: MAYOR AND COUNCIL MEMBERS DATE: SEPTEMBER 9, 2022
FROM: CITY CLERK DISTRICT(S): NOT APPLICABLE
SUBJECT: ADOPT RESOLUTION DECLARING INTENT TO TERMINATE PARTICIPATION FROM
THE CALPERS MEDICAL PLANS FOR CERTAIN GLENDORA LABOR GROUPS (STRATEGIC PLAN ITEM 21-EEDR)
RECOMMENDATION
That the City Council:
1. Adopt a City Council Resolution entitled, "A RESOLUTION OF THE CITY COUNCIL DECLARING
INTENT TO TERMINATE THE CALPERS MEDICAL CONTRACT AGREEMENT TO
PARTICIPATE IN THE PUBLIC EMPLOYEE MEDICAL AND HOSPITAL CARE ACT FOR CERTAIN GLENDORA LABOR GROUPS."
EXECUTIVE SUMMARY
The City has been evaluating and considering other alternatives to CalPERS medical plans. A recent analysis has identified FDAC-EBA as a viable option that will afford the City more control over plan design and offer a competitive health benefit program with favorable rates to active and retired employees, including their dependents.
LEGISLATIVE HISTORY / PREVIOUS ACTIONS
On July 26, 1994, the City Council adopted the following Resolutions to provide medical insurance coverage effective October 1, 1994 under the Public Employees’ Medical and Hospital Care Act (PEHMCA):
1. Resolution 94-64: all active and retired employees who were full-time MidManagement/Confidential employees (now Glendora Management Association)
2. Resolution 94-63: all active and retired employees who were considered General Employees (now American Federation of State County Municipal Employees Local 3915) through the California Public Employee’s Retirement System (CalPERS)
3. Resolution 94-65: to all active and retired employees who are full-time City Manager and Department Head employees
4. Resolution 94-66: all active and retired members of the City Council On November 22, 2016, the City Council approved Resolution 2016-49 for the Glendora Municipal Employees Association (now AFSCME Local 3915), which established a monthly contribution amount of $200 per month for active and retired employees through the CalPERS PEHMCA healthcare system. The current Memorandum of Understanding reflects this amount.
In 2020, the City presented the opportunity to withdraw from CalPERS to all bargaining units noting all units must be in agreement to break away from CalPERS to proceed. At the time, COVID-19 and the Item #1. Page 1

volatile medical landscape played a large factor in the decision by the units not to move forward with the break away.
DISCUSSION
MOU Side Letters from 2019 state:
“City and Union agree to establish a Medical Task Force to explore other medical benefit options outside of CalPERS Health.”
*In a continued effort to provide enhanced and affordable medical care to the City employees, staff reevaluated options to withdraw from CalPERS since March 2022. The City utilized Keenan & Associates to conduct another survey of the pricing of the current market. After reviewing the survey results, the recommendation was to withdraw from CalPERS and move to the Fire Districts Association of CaliforniaEmployment Benefits Authority (FDAC- EBA). FDAC-EBA is a Joint Powers Authority that has over 2,000 members in California.
Several factors were considered prior to making a recommendation. Staff reviewed the historical information of both CalPERS Medical and FDAC medical. Staff reviewed the medical plans in depth and did side by side comparisons to ensure continued level of service. Staff reviewed medical providers and prescriptions with staff members who had questions about the proposed plans. Although a short period of time, much work and research went into this decision.
The table below provides some comparison of historical increases for CalPERS versus FDACEBA. Overall, the FDAC-EBA renewal history has been lower and stable than CalPERS.
There are several advantages to exiting CalPERS healthcare. First and foremost, the City would have more stability and control over the costs and flexibility in benefit offerings for employee and retirees. There is no room for negotiation or deployment of strategies under CalPERS Medical, along with unstable rate increases and renewals.
CalPERS offers one HMO design, two PPO plans, and one Association plan. The City has no control in the CalPERS plan designs offered. By breaking away from CalPERS, the City will have the ability to provide other plans such as a high/low HMO offering, High Deductible Health Plan with Health Savings Account (HDHP with HSA), and additional options for early retiree coverage out of state.

Moving to FDAC-EBA would ensure that the City would be reviewed individually, on an annual basis, and rates would be underwritten based on the experiences of our members and NOT of the pool, as is the case with what is reflected in CalPERS annual rate increases. The ability to be reviewed and underwritten based on the City’s experience as an individual entity, rather than being reviewed as part of the whole pool for the State of California, would give the City more stability with rate increases due to the City’s current demographics of our member population. However, risk would still be spread among the entire pool.
The process of sending an exit letter to CalPERS and to enter a contract with a new medical carrier requires a Council approved resolution. In any year that this happens, the resolution must be approved and submitted before the CalPERS deadline to withdraw and to enter contract with new carrier for open enrollment in the Fall. The City has 60 days from the date CalPERS publishes their medical rates for the new year.
Based on current enrollment, many employees will not experience a disruption in care because they will be able to maintain their current health providers. Further, withdrawing from CalPERS medical will not impact an employee’s pension in any way.
Once the Council approves the attached resolution, the City will send the exit letter and will enter into a contract agreement with the new medical insurance carriers.
FISCAL IMPACT
There is no impact on the budget because medical premiums are passed through to the employee. On an individual basis, employees will experience more favorable rates and plans that fit their personal needs.
