STAFF REPORT
TO: MAYOR AND COUNCIL MEMBERS DATE: OCTOBER 25, 2022
FROM: CITY CLERK DISTRICT(S): NOT APPLICABLE
SUBJECT: CONDUCT INTERVIEWS AND APPOINT APPLICANTS TO FILL UNSCHEDULED VACANCIES ON PLANNING COMMISSION (OFFICE NO. 4; TERM EXPIRE: JUNE 30, 2025) AND WATER COMMISSION (OFFICE NOS. 3 AND 4; TERMS EXPIRE: JUNE 30, 2025).
RECOMMENDATION
That the City Council:
1. Provide direction on appointing applicants to fill unscheduled vacancies on the Water Commission (Office Nos. 3 and 4; Terms Expire: June 30, 2025), and Planning Commission (Office No. 4; Term Expire: June 30, 2025).
EXECUTIVE SUMMARY
At the August 23, 2022, City Council meeting, a report was given on two Water Commission resignations from John Fields for Office No. 3 (Attachment A), and announced verbally at the July 28, 2022 Water Commission meeting by Ryan Shaw for Office No. 4, at which time the City Council directed staff to extend the filing deadline associated with the two vacancies on the Water Commission with direction to return to Council with an update on October 11, 2022.
A Notice of extended deadline (Attachment B) was prepared and posted to the City’s website, bulletin boards and City Hall marquee on August 26, 2022 with an application deadline of September 15, 2022 at 5:00 p.m.
The City Clerk’s Department then received two additional notices of resignation, one on August 31, 2022 from Business Improvement District (BID) member Janna Hirth which created a vacancy in Office No. 3 (Attachment C), and another on September 6, 2022 from Planning Commissioner Brian Ursettie which created a vacancy in Office No. 4 (Attachment D).
Notice of unscheduled vacancies on Planning Commission and Business Improvement District Advisory Board (Attachment E) was prepared and posted pursuant to Cal. Gov't Code § 54974 to the City’s website, bulletin boards and City Hall marquee on September 6, 2022 with an application deadline of September 22, 2022 at 5:00 p.m.
At the October 11, 2022, City Council meeting, options were considered to appoint eligible applicants to fill the unscheduled vacancies. Since the number of applicants was equal to the number of vacancies, the City Council appoint Business Improvement District (BID) Advisory Board applicant Matthew Davis to Office No. 3 (Unexpired term ending June 30, 2023). Then directed staff to schedule a Special Meeting for October 25, 2022 at 5:00 pm to conduct interviews with eligible applicants to fill the remaining unscheduled vacancies in the Water and Planning Commissions.

LEGISLATIVE HISTORY / PREVIOUS ACTIONS
CA Govt Code § 54974 regulates the process utilized by cities to fill unscheduled vacancies on the City Council appointed commissions and boards and requires the following:
(a) Whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, whether due to resignation, death, termination, or other causes, a special vacancy notice shall be posted in the office of the clerk of the local agency, on either the local agency’s Internet Web site or at the library designated pursuant to Section 54973, and in other places as directed by the legislative body, not earlier than 20 days before or not later than 20 days after the vacancy occurs. Final appointment to the board, commission, or committee shall not be made by the legislative body for at least 10 working days after the posting of the notice in the clerk’s office.
(b) Notwithstanding subdivision (a), the legislative body may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. A person appointed to fill the vacancy shall serve only on an acting basis until the final appointment is made pursuant to this section.
On October 11, 2022, the City Council received an update on unscheduled vacancies on the Water Commission, Planning Commission, and Business Improvement District (BID) Advisory Board. At that meeting, the City Council appointed Business Improvement District (BID) Advisory Board applicant Matthew Davis to Office No. 3 (Unexpired term ending June 30, 2023), since the number of applicants was equal to the number of vacancies. Since the number of applications exceeded the number of vacancies in the Water and Planning Commissions, the City Council directed staff to schedule a Special Meeting for October 25, 2022 at 5:00 pm to conduct interviews with eligible applicants to fill those unscheduled vacancies.

Good Afternoon Mayor Davis, Chair Nakano, fellow commissioners, and dedicated staff:
As some of you know, I'm still working full-time at Kaiser Permanente in the public affairs department and as we slowly emerge from the pandemic, there is an increasing number of evening events of which I'm required to attend. The last few meetings of the commission have coincided with two of these events and a health issue prevented me from attending one other meeting. In addition, our water commission is almost entirely composed of active or retired professionals in the water industry, which is a great benefit to the commission and the City. I believe 100% of the commission should be composed of such well informed and experienced individuals.
All this to say, I have made the decision to step down from the water commission, effective immediately.
On the bright side, I will be retiring next year, after working full-time for over 43 years. I hope to reenter community service at that time, when I have more time and better control of my personal schedule.
I appreciate all the help and assistance I have been provided by fellow commissioners and by our wonderful staff over the last several years.
Thank you,
John

Jeff,
I have been trying to get the time off to make this evening's meeting and was unsuccessful. I believe the best thing for me to do at this point is to resign my position. It has become very difficult due to the nature of my job and the unpredictability of our work, to be consistent. I have really enjoyed working with you and all of the other commissioners. I have learned so much from you and Mark and have really enjoyed being a part of positive change for the City. I know that if it was a different season of my life I would love to continue, and hope to do so some day. Thank you and please feel free to pass this along to the other commissioners.
