EXECUTIVE SUMMARY
The City Council called a General Election for November 5, 2024, by approving Resolution CC 2024-22.

Specifically, the Resolution called for the election of three members of the City Council, representing Districts 2, 3, and 5, for a full term of four years. The nomination period for the November 5, 2024, General Municipal Election was Monday, July 15, 2024, through Friday, August 9, 2024. The following candidates filed verified nomination petitions at the close of the nomination period:

District 2:

David Fredendall Member of City Council District 2 4-Years District 3:

Jenny Chan Member of City Council District 3 4-Years
Shaunna Elias Member of City Council District 3 4-Years Erica Landmann Member of City Council District 3 4-Years Dustin Snyder Member of City Council District 3 4-Years District 5:

Mendell Thompson Member of City Council District 5 4-Years An election will be held as planned for District 3 since there are more qualified candidates than elected office. Qualified candidates for Districts 2 and 5 are unopposed; under these circumstances, State law allows the City Council to appoint the nominees to office, thereby canceling associated portions of the election. In accordance with § 10229 of the Election Code, on August 9, 2024, after the close of the nomination period, the City Clerk prepared the City Clerk Certification that there were not more candidates Item #1. Meeting Date: 8/21/2024 / Packet Page #: 4
than offices to be elected in District 2 and District 5. Notice was emailed to the City Council, posted on August 12, 2024, and published in the San Gabriel Valley Examiner on August 15, 2024.

LEGISLATIVE HISTORY / PREVIOUS ACTIONS
Pursuant to Glendora Municipal Code §2.54.010, the City of Glendora conducts its General Municipal Election on the same day as and consolidated with the Statewide Primary Election held on the first Tuesday in November of even-numbered years.

The City Council adopted Resolution CC 2024-23 on May 28, 2024, calling and giving notice of holding a General Municipal Election on Tuesday, November 5, 2024, for the following offices: three members of the City Council representing Districts 2, 3 and 5 for the full term of four years.

DISCUSSION
The City of Glendora is scheduled to conduct a General Municipal Election on Tuesday, November 5, 2024, for three Members of the City Council, representing Districts 2, 3 and 5.

The nomination period for the November 5, 2024, General Municipal Election was Monday, July 15, 2024, through Friday, August 9, 2024, with an extended filing period to Wednesday, August 14, 2024, if the incumbent chooses not to file. As of the close of the nomination period on Friday, August 9, 2024, for the members of the City Council representing District 2 and District 5, there are not more candidates than offices to be elected. Additionally, since the incumbent did not file for re-election during the filing period for District 3, the nomination period was extended to Wednesday, August 14, 2024, at 5:00 p.m.

The persons so nominated are:

David Fredendall Member of City Council District 2 4-Years Mendell Thompson Member of City Council District 5 4-Years As of Wednesday, August 14, 2024, the close of the extended nomination period, four candidates qualified for District 3. The persons so nominated are:

Jenny Chan Member of City Council District 3 4-Years
Shaunna Elias Member of City Council District 3 4-Years Erica Landmann Member of City Council District 3 4-Years Dustin Snyder Member of City Council District 3 4-Years An election will be held as planned for District 3 since there are more qualified candidates than elected office. Since qualified candidates for Districts 2 and 5 are unopposed, the Election Code §10229 provides procedures for appointment and cancellation of an election, if only one person is nominated for an elective office. The City Clerk is required to submit a certification of these facts to the City Council, publish a notice of the same, and after the fifth day following of these facts to the City Council, publish a notice of the same. Additionally, after the fifth day following the date of publication, the City Council will meet to either make the appointment(s) or direct an election to be held. The person(s) appointed, if any, shall qualify and take office and serve exactly as if the person(s) were elected at a municipal election for the office.

In light of the foregoing, the Election Code §10229 permits the City Council to take one of the following courses of action:

1. Appoint to the office(s) the person(s) who have been nominated.

2. Appoint to the office(s) any eligible voter if no one has been nominated.

3. Hold the election if either no one or only one person has been nominated.

As prescribed by the election code, action must be taken prior to Thursday, August 22, 2024 (75th day before the general municipal election), or the General Municipal Election will go forward.

Item #1. Page 2
Meeting Date: 8/21/2024 / Packet Page #: 5
The City Clerk has provided the required certification to the Council that there are not more candidates than the offices to be elected (Attachment A) in District 2 and District 5; therefore, the City Council has the option to appoint the nominees to the corresponding office and cancel the corresponding portions of the City’s election. Staff recommends this action and has prepared an appropriate Resolution (Attachment B).

Although the Council could choose to hold the election in its entirety despite the fact that there will be no contest for the open offices in Districts 2 and 5, staff does not recommend this action since it may result in the City unnecessarily incurring additional election costs.

If the Council appoints unopposed candidates to the open offices, those appointees will serve in office exactly as if they had been elected, starting their new term when they are sworn into office during the City Council’s first regular meeting in December 2024, which falls on December 10, 2024.

PUBLIC NOTICING
As required by the Election Code, a notice entitled “City Clerks Certification that there are not More Candidates than Offices to be Elected” providing the facts set forth herein and providing notification of the Council’s authority was posted on August 12, 2024, after the close of nominations and published on August 15, 2024 in the newspaper of general circulation in the city pursuant to § 6061 of the Government Code.

FISCAL IMPACT
If the City Council chooses to hold the election in its entirety, the City election costs for the three offices from the County Registrar, are currently estimated at $116,211. There are sufficient funds available in the Adopted FY24-25 Mid-Cycle Budget in the City Clerk’s Election Division to cover the required elections costs.

If the City Council makes recommended appointments of unopposed candidates and cancels portions of the election associated with District 2 and District 5, it should result in cost savings of approximately $30,000 per district (approximately $60,000 in total). These savings would be used to offset the costs of Measure Z, a 0.25% sales and use tax placed on ballot by the City Council in August 2024 (www.CityofGlendora.org/MeasureZ).

Upon completion of the election cycle, the City will be provided with updated election costs by the County Registrar based on the final number of elections held in Glendora and all other City’s that had previously planned elections in Los Angeles County.

ENVIRONMENTAL DETERMINATION
There is no CEQA impacts associated with the recommendation in this report.
