EXECUTIVE SUMMARY
The City Clerk’s Office received a letter of resignation from Marianne Cintron for Office No. 2 on the Board of Library Trustees (Attachment A). The term for this position is set to expire on June 30, 2027. In accordance with California Government Code § 54974, a Notice of Unscheduled Vacancy was posted (Attachment B), establishing an initial application deadline of March 20, 2025. By the close of the initial recruitment period, three qualified applicants had submitted applications for City Council consideration.

At its meeting on March 25, 2025, the City Council received an update on the recruitment process and was presented with three options for how to proceed. The Council unanimously selected Option 2, directing staff to extend the application deadline to April 8, 2025. A Notice of Extended Application Deadline (Attachment C) was posted on March 27, 2025. One additional qualified application was received prior to the close of the extended deadline.

In total, four qualified applications were received and are included for Council review as Attachment D. Interviews are scheduled for Tuesday, April 22, 2025. Following the interviews, the City Council will appoint one applicant to fill the vacancy for the remainder of the term ending June 30, 2027.

LEGISLATIVE HISTORY / PREVIOUS ACTIONS
California Code, Government Code § 54974 regulates the process utilized by cities to fill unscheduled vacancies on the City Council appointed commissions and boards and requires the following:
(a) Whenever an unscheduled vacancy occurs in any board, commission, or committee for which the legislative body has the appointing power, whether due to resignation, death, termination, or other causes, a special vacancy notice shall be posted in the office of the clerk of the local agency, on either the local agency's Internet Web site or at the library designated pursuant to Section 54973, and in other places as directed by the legislative body, not earlier than 20 days before or not later than 20 days after the vacancy occurs. Final appointments to the board, commission, or committee shall not be made by the legislative body for at least 10 working days after the posting of the notice in the clerk's office.
(b) Notwithstanding subdivision (a), the legislative body may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. A person appointed to fill the vacancy shall serve only on an acting basis until the final appointment is made pursuant to this section.

DISCUSSION
At the March 25, 2025, City Council meeting, staff provided an update on unscheduled vacancies, including the vacancy on the Board of Library Trustees, Office No. 2. The City Council was presented with the following three options to proceed with the appointment process:

Option 1: Direct staff to schedule interviews with the current pool of applicants.

Option 2: Extend the application deadline to April 8, 2025, to allow additional candidates to apply.

Option 3: Provide alternative direction to staff.

Following discussion, the City Council unanimously selected Option 2, directing staff to extend the recruitment period. In response, a Notice of Extended Application Deadline (Attachment C) was noticed on March 27, 2025, in the same public locations and through the same publication channels as the original notice. The new application deadline was set for April 8, 2025, at 12:00 p.m. The notice indicated that candidate interviews were anticipated to take place on Tuesday, April 22, 2025, between 4:00 p.m. and 7:00 p.m., following the close of the extended recruitment period.

By the close of the extended application period, one additional qualified application had been received, bringing the total number of applicants requesting consideration to four. Copies of all submitted applications are included for reference as Attachment D.

Staff recommends that the City Council proceed with interviews and appoint one candidate to fill the unscheduled vacancy on the Board of Library Trustees, Office No. 2, for the remainder of the term, which expires on June 30, 2027.

Dear Janet and Kathleen,
Please consider this email my notice of inability to continue as the Library Board Trustee.

After I was elected Board Trustee on 5/14/24, I experienced some severe health issues and have not been able to contribute as needed.

I believe it is time to step down from the Trustee duties. Thanks for your conversations and friendship. I look forward to get back on my feet and stay involved in my community.

Blessings,
