SUBJECT: Notice of Completion of Fairview Avenue Sidewalk Infill Project (Project No. 9070)
RECOMMENDATION:
A. Adopt Resolution No. 22-___ entitled “A Resolution of the City Council of the City of Goleta, California, Authorizing the Filing of a Notice of Completion for Fairview Avenue Sidewalk Infill Project”; and
B. Direct the City Clerk to file a Notice of Completion with County Recorder’s Office.
BACKGROUND:
The Fairview Avenue Sidewalk Infill Project was included as part of the City’s 5 -year Capital Improvement Program (CIP) and identified as Project No. 90 70. The project consisted of the completion of sidewalk along the north side of the South Fairview Avenue, west of the intersection of North Fairview Avenue and northbound US 101 on and off-ramps. The scope of work included sidewalk infill improvements necessa ry to conform to the existing bicycle and pedestrian ramp connecting South Fairview Avenue and Calle Real.
The City received a Measure A South Coast Regional Bicycle & Pedestrian Program Cycle 3 grant to construct the project improvements and in July 2018, the City entered into a Professional Design Services Agreement 201 8-060 with Stantec Consultant Services, Inc. to complete the design for the project.
On July 20 , 20 20, the City Manager awarded the construction contract to , Lash Construction, Inc. in a not-to-exceed amount of $59,874, with a contingency of $124.44.
On August 5, 2020, the City Manager execute d a consultant services agreement with MNS Engineers, Inc. in an amount not-to-exceed $44,000 for construction management and inspection services.

Throughout the design process, Public Works engaged the community and neighboring businesses numerous times (in both English and Spanish) regarding the overall design, and potential construction impacts.
DISCUSSION:
On July 21, 2020, Public Works i ssued Lash Construction, Inc. a Notice to Proce ed to commence work on September 8, 2020. Construction activities consisted of construction of new sidewalk to fill the sidewalk gap along the north side of South Fairview Avenue leading to the signalized intersection at the northbound US 101 off -ramp. The work also included removal and replacement of existing sidewalk to conform to the existing bicycle and pedestrian ramp connection at Fairview Avenue and Calle Real per the Project plans and specifications.
The work was performed per the approved project Plans and Specifications. Lash Construction, Inc. completed construction on October 7 , 202 0, on budget. A change order, CCO-01, was issued to provide a credit for a materials quantity reduction, CCO-01 was issued to remove a “No Ped” sign, and CCO-03 was issued to include additional PCC Sidewalk.
Public Works is recommending adoption of the proposed resolution to facilitate the final close-out of this project (Attachment 1). A Notice of Completion pursuant to Public Contract Code §20854 is recommended for approval and direction to be filed with the County of Santa Barbara, County Recorder Office (Attachment 2).
FISCAL IMPACTS:
The construction, contingency, equipment, and construction management and inspection costs were estimated to be $103,998.44. The actual cost for construction, including quantity changes and construction management, totaled approximately $75,000. There were no change orders issued that affected the cost of the project. The final budget worksheet for the construction and the overall project costs are shown in the following tables.

ALTERNATIVES:
The City Council may elect to direct staff to not file a Notice of Completion for the project.
If a Notice of Completion is not filed, then the project will not be officially closed out.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GOLETA, CALIFORNIA, AUTHORIZING THE FILING OF A NOTICE
OF COMPLETION FOR THE FAIRVIEW AVENUE SIDEWALK
INFILL PROJECT
WHEREAS, on July 20 , 20 20, the City of Goleta authorized award of a construction contract to Lash Construction, Inc., for the Fairview Avenue Sidewalk Infill Project; and
WHEREAS, the City Engineer has evaluated the work and has determined that the work was satisfactorily completed within the City extended contract period and within budget; and
WHEREAS, the City Engineer recommends the filing of a Notice of Completion pursuant to Government Code section 20854.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLETA AS FOLLOWS:
SECTION 1.
The work required to be performed by said Contractor has been completed.
SECTION 2.
The work is hereby accepted and approved based on the recommendation of the City Engineer.
SECTION 3.
The Finance Department is directed to release retention posted for the completion of the project as required by the California Civil Code.
SECTION 4.
The City Clerk is directed to forthwith forward a Notice of Completion to the Recorder of the County of Santa Barbara for recording.
5 SECTION 5.
The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
