Case No. 22-0003-GPA
RECOMMENDATION:
Adopt Resolution No. 22-___, entitled “ A Resolution of t he City Council of the City of Goleta, California, Initi ating the Processing of An Ap plicant-Requested General Plan Amendment for a 5399 Overpass Road known as APNs 071-220-031, -036, -024; Case No. 22-0003-GPA”
BACKGROUND:
General Plan Amendment Initiation
The City of Goleta adopted t he Goleta General Plan/Coastal Land Use Plan (General Plan) on October 2, 2006. The General Plan contains the following seven state-required elements and two optional elements as follows: Land Use Element, Open Space Element, Conservation Element, Safety E lement, Visual and Histori c Resources Element, Transportation Element, Publ ic Faciliti es Ele ment, Noise Element, and Housing Element. The Land Use Element includes a Land Use Plan Map (Figure 2-1), which identifies a l and use designation for each parcel in the City. Since its adoption, the General Plan has been amended on 25 occasions. The most r ecent amendment occurred on April 5, 2022.
The General Plan Amendment (GPA) process is governed by Article 6 of State Planning and Zoning Law (Government Code Sect ions 65350 et seq.). Pursuant to state law, GPAs require the Planning Commission’s consideration and recommendation .
However, the final decision is a legislative action and is reserved for the City Council to make.
Before a GPA can be consider ed, it must be initiated, applying procedures established by City Council Resolution No. 12-13 for the initiation process, a s codified in G oleta Municipal Code (G MC) Section 17.67.030. These procedures require that all requests 1 Meeting Date: October 18, 2022
for GPAs be referred to the Ci ty Counci l fo r initiation at a public hearing prior to processing. Resolution No. 12-13 and GMC subsection 17.67.030(B) provide five factors the City Council must consider for the initiation of a GPA. These five factors are:
1. The amendment proposed appears to be consistent with the Guiding Principle s and Goals of the General Plan;
2. The amendment proposed ap pears to have no material effect on the community or the General Plan;
3. The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy;
4. Public facilities appear to be available to serve the affected site, or their provision will be addressed as a component of the amendment process; or
5. The amendment proposed is required under other rules or regulations.
Once initiated, the applicant could apply for the GPA and any intended development project associated with the GPA . Once submitted, staff would review and analy ze the application along with the pre paration of the appropriate environmental analysis. All aspects of a future development proposal, including the environmental analysis, would be considered by the Planning Commission at a noticed public hearing, followed by the Planning Commission making a recommendation to the City Council. The Cit y Council would be the decision-making body for all the project components at a public hearing.
Site Information
The 3.98-acre subject parcel s are currently owned by the Santa Bar bara Humane Society, located south of Highway 101 and immediately west o f State Route 217 (See Figure 1: Subject Site). The current General Plan land use de signation and zoning at the subject site is General Industrial (I-G). The land use designation surrounding the subject site to the north, east, and south is also I-G. The area surrounding the su bject site and existing land uses of those s ites are shown in Figure 2 below with the su bject parcels outlined in red.

DISCUSSION:
On June 27, 2022, Steve Fort of S EPPS, Inc. submitted a request for the initiation of a GPA on behalf of the Santa Barbara H umane Society (property ow ner). The GPA initiation request is to st udy a change to the la nd u se desi gnation, as established on General Plan Figure 2 -1, Land Use Plan Map, at 5399 Overpass Road (Assessor’s Parcel Numbers [APN ] 071-220-031, -036, -024) from I-G to General Commercial (C- G). The existing land use designation does not allow for Boarding-Kennel uses, which is the use category that is needed for the existing facility. Santa Barbara Humane Society is operating as a legal non-conforming use since the y were granted a C onditional Use Permit by the County of Santa Bar bara in 1963, at which time the z oning was Design Manufacturing (DM-X) and permitted the ke nnel use. Prior to adoption of Title 17, the parcels were zoned M -1 (Light Industry) where small animal hospitals were permitted but not boarding kennels . The City changed the zoning when Title 17 zoning code was adopted to reflect the General Plan land use designation of I -G. The Humane Society desires to upgrade their facility and cannot do so under the current land use and zoning designation of I-G.
General Plan Policy LU 4.5 defines the intent of the I-G land use designation as follows:
This designation is intended to pr ovide land area s for a wi de range o f manufacturing uses, including those with potential noxious impacts, and for similar heavy comm ercial uses . U ses in thes e areas may occur in a less managed environment than in the Business Park designation. The processing or storage of hazardous materials shall be strictly controlled and subject to necessary permits in accordance with state and federal law. Uses appropriate in this land use designation include but are not limited to general manufacturing, assembly and fabrication, heavy commercial uses, hi gh-technology manufacturing, research and development, wineries, breweries, building and construction services, and public facilities.
Allowable us es within I-G are l isted in General Plan T able 2 -3, Allowable Uses and Standards for Office and Industrial Use Categories, and is provided as Attachment 2.
General Plan Policy LU 3.7 d efines the intent of t he C-G land use de signation as follows:
The purpose of this category is to provide appropriate sites to accommod ate a diverse set of commercial uses that do not need highly visible locations, such as wholesale tr ade and service comme rcial, or t hat may invo lve activities th at reduce compatibility with other us es. Appropriate sites are in locations that may have limit ed s uitability for other more retail-oriented use s. Ge neral commercia l uses may serve as a buffer be tween industrial acti vities or m ajor transportation corridors and residential areas. The following criteria and stan dards ap ply to lands within this designation:
4 Meeting Date: October 18, 2022
a. The permitte d uses in t his class ification have similar charact eristics t o some industrial uses, and mixed-use developments that include residential uses, except for assisted living residential uses, are not allowed. b. While General Commercial uses do not usually generate high volumes of traffic, s ites within this desig nation sho uld be accessible fro m major arterials in order to minimize the need for traffic to pass through residential areas on local streets.
c. Uses that re quire access by heavy vehicles s hall be permitted o nly in locations where the street can support such heavy vehicle traffic and such uses would be compatible with adjacent uses.
d. Heavy commercial uses that may cause noise, air emis sions, hazardous materials, o r e xcessive light and glare s hall require approv al of a conditional use permit.
Allowable uses within C -G are listed in General P lan Table 2-2, Allowable Uses and Standards for Commercial Use Categories, and is provided as Attachment 3.
The land use change would modify the allowed uses on the subject parcel by increasing the amount of Retail Trade and Services uses such as General Merchandise, Food and Drug Stores, Ap parel an d Specia lty Store s, Eat ing and Drinking Establishments , and Other Ret ail Trade Establishments; adding the Transien t Lodging & Services and Wholesale Tr ade & Storage uses such as RV Parks and Other Visitor Serv ices and Attractions; removing Industrial (Manufacturing) uses such as General Manufacturing – No Noxious Impacts , General Manufacturing – Potential Noxious Impacts , Research and Development , Scientific and Similar Instruments, Bio-Medical Technology, and Other Advanced Technology; Transportation & Utilities u ses such as Tra nsportation (other than right -of-way) and Wireless Communications/Telecommunications; and introducing Residential uses such as Assisted-Living Residential Units.
As previously noted , the Council must consid er a specific set of five factors when determining whethe r to in itiate a GPA. Pursuant to R esolution 12 -13 and GMC subsection 17.67.030(B), s taff presen ts the fo llowing discussion of the GPA initiation factors for City Council consideration:
1. The am endment proposed appea rs to be c onsistent with th e Guid ing Principles and Goals of the General Plan.
The proposed amendment is consistent with the following Guiding Pri nciples and Goals of the General Plan : Land Use Element Guiding Principle and Go al 4 to “Maintain economic prosperity wi th a sustainable economy that is not based on growth” and Land Use Element Guiding Principal and Goal 6 to “Maintain a balanced community, with an appropriate mix of resid ences, workpl aces and services.” The proposed land use designation change would potentially provide for a wider variety of employment o pportunities and housing developmen ts in Goleta. The proposed land use designation change to C-G would allow more retail and service uses than I- G, and caretaker and assisted-living resid ential units as permissible. This ch ange 5 Meeting Date: October 18, 2022
also c reates an opportunity for the current n on-conforming use to b ecome conforming.
The purpo se o f initiating this GPA is to allow t he property o wner to submit for a project that w ould be co nsistent wit h th e goals and policies of the General Plan.
Santa Barbara Humane Society has operated as a boarding kennel as approved by the County of Santa Barbara since 1963. When the City of Goleta adopted Title 17 of the GMC, the land use designation and zoning district were changed and created a non -conforming use for the boarding kennel use on the property. Amending the General Plan would allow the existing boarding kennel use to be a permit ted use, and also provide a wider range of uses which would support these guiding principles and goals.
2. The am endment p roposed ap pears to h ave no material effec t o n the community or the General Plan.
It is an ticipated that the proposed amendment from I-G to C-G would have no material effect on the co mmunity or the General Plan because the cha nge will only apply to an approximately 3.98-acre site. While the change will be to a different land use type, there are 125.56 acres of I-G-designated land within the City. This proposed GPA would decrease the amount of land planned for I-G uses by 3.17%.
As a result, the change would not cause a fundamental shift in the overall land use pattern in the city. The site would sti ll be considered for devel opment, just wit h a different range of uses than original planned for this area of Goleta.
C-G would allow caretaker and assisted-living residential units as permissible. I-G only allows residential use of one caretaker un it per parcel. As such, a change to C- G represents a potentially broadening of commercial and residential uses on the site.
Pursuant to Tables 2-2 and 2-3 of the Land Use Element, the maximum allowable height is the same for I-G and C-G, at 35 feet.
3. The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy.
The proposed land use change from I-G to C-G provides additional public benefit to the community by providing more potential housing opportunities and allowing more retail and service uses. While C-G is a commercial designa tion, various industrial - related uses a re allowed including: several a uto-related uses, including retail automotive sales and rentals, auto repair and painting, auto wrecking yard/junk yard and auto service (gas) stations; s everal wholesale trade and storage uses including general wholesale trade; general and self-storage warehousing and outdoor storage.
In addition, the proposed change to C-G would allow for the Santa Barbara Humane Society to remove its legal non-conforming status and allow it to continue to provide, 6 Meeting Date: October 18, 2022
and po tentially expand i n the future. T he use ha s p rovided for various animal services for the community for the past six decades.
4. Public fa cilities appe ar to be ava ilable to serve the affected site, or t heir provisions will be addressed as a component of the amendment process.
The parcel is currently owned, occupied, and o perated by Santa Barbara Humane Society and all public facilities required to serve the site already do so. The provision of public facilities wo uld also be address ed as a component of any future development.
5. The amendment proposed is required under other rules or regulations.
The proposed GPA is not required under other rules or regulations.
Based on the analysis of the five factors above, staff recommends initiating the GPA, to change the land use de signation of the site f rom I-G to C-G. A draft resolution for the GPA initiation from I-G to C-G is provided as Attachment 1 t o this report . Section E of the Resolution requires that the applicant apply for the GPA within two years of adoption of the Resolution (17.67.030(D)). If that were n ot to occur, then t he Council action to initiate the General Plan Amendment would expire.
ENVIRONMENTAL REVIEW:
The initiation of a GPA is not a proj ect under th e California Environmental Quality Act.
The init iation merely instructs staff to consider the amendment and does not obliga te the City to any further ac tion in the futur e and doe s not res ult in any d irect ph ysical change in the environment or any reasonably foreseeable change in the environment.
FISCAL IMPACTS:
The case processing costs associated with the initiation of the proposed GPA for the Santa Barbara Humane Society parcels are being are being borne by the Applicant.
TIME LIMIT:
The Council action to initiate this General Plan Amendment will automatically exp ire after two (2) years from the date of this Resolution, if an application for the General Plan Amendment is not submitted to the P lanning and Environmental Review Department during this timeframe.
ALTERNATIVES:
The City Council could choose not to initiate processing of th e requested GPA. If not initiated, the parcel and it s zonin g designation will remain unchanged. If init iated and upon applicati on submittal, City staff w ould proceed with ca se pro cessing, including environmental r eview and a GPA for Plann ing C ommission’s c onsideration and recommendation to the City Council for final action.

WHEREAS the City Council considered the entire administrative record, including staff reports, the General Plan, and oral and written testimony from interested persons;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GOLETA, AS FOLLOWS:
SECTION 1 General Plan Initiation Factors
The City Council makes the following statements regarding the initiation factors outlined in City Council Resolution No. 12-13 and Goleta Municipal Code Section 17.67.030:
a. The amendment proposed appears to be consistent with the Guiding Principles and Goals of the General Plan.
The proposed amendment is consistent with the following Guiding Principles and Goals of the General Plan: Land Use Element Guiding Principle and Goal 4 to “Maintain economic prosperity with a sustainable economy that is not based on growth” and Land Use Element Guiding Principal a nd Goal 6 to “Maintain a balanced community, with an appropriate mix of residences, workplaces and services .” The proposed land use designation change would potentially provide for a wider variety of employment opportunities and housing developments in Gol eta. The proposed land use designation change to C -G would allow more retail and service uses than I-G, and caretaker and assisted- living residential units as permissible. This change also creates an opportunity for the current non-conforming use to become conforming.
The purpose of initiating this GPA is to allow the property owner to submit for a project that would be consistent with the goals and policies of the General Plan. Santa Barbara Humane Society has operated as a boarding kennel as approved by the County of Santa Barbara since 1963. When the City of Goleta adopted Title 17 of the GMC, the land use designation and zoning district were changed and created a non-conforming use for the boarding kennel use on the property. Amending the General Plan would allow the existing boarding kennel use to be a permitted use, and also provide a wider range of uses which would support these guiding principles and goals.
b. The amendment proposed appears to have no material effect on the community or the General Plan or Specific Plan.
It is anticipated that the proposed amendment from I -G to C-G would have no material effect on the community or the General Plan because the change will only apply to an approximately 3.98 -acre site. While the change will be to a different land use type, there are 125.56 acres of I -G-designated land within 11 Resolution No.22-_ Initiation of General Plan Amendment for APNs 071-220-031, -036, and -024 Page 3 the City. This proposed GPA would decrease the amount of land planned for I- G uses by 3.17%. As a result, the change would not cause a fundamental shift in the overall land use pattern in the city. The site would still be considered for development, just with a different range of uses than original planned for this area of Goleta.
C-G would allow caretaker and assisted-living residential units as permissible.
I-G only allows resid ential use of one caretaker unit per parcel. As such, a change to C -G represents a potentially broadening of commercial and residential uses on the site.
Pursuant to Tables 2-2 and 2-3 of the Land Use Element , the maximum allowable height is 35’ for C-G and I-G.
c. The amendment proposed provides additional public benefit to the community as compared to the existing land use designation or policy.
The proposed land use change from I -G to C -G provides additional public benefit to the community by providing more potential housing opportunities and allowing more retail and service uses. While C-G is a commercial designation, various industrial-related uses are allowed including: several auto-related uses, including retail automotive sales and rentals, auto rep air and painting, auto wrecking yard/junk yard and auto service (gas) stations; several wholesale trade and storage uses including general wholesale trade; general and self - storage warehousing and outdoor storage.
In addition, the proposed change to C -G would allow for the Santa Barbara Humane Society to remove its legal non -conforming status and allow it to continue to provide, and potentially expand in the future. The use has provided for various animal services for the community for the past six decades.
d. Public facilities appear to be available to serve the affected site, or their provisions will be addressed as a component of the amendment process.
The parcel is currently owned, occupied, and operated by Santa Barbara Humane Society and all public facilities required to serve the site already do so. The provision of public facilities would be addressed as a component of any future development.
e. The amendment proposed is required under other rules or regulations.
The proposed General Plan Amendment is not required under other rules or regulations.
