SUBJECT: Amendment No. 4 to a Memorandum of Understanding between the City of Goleta and People Assisting the Homeless (PATH)
RECOMMENDATION:
Approve and a uthorize the City Manager to execute Amendment No. 4 to a Memorandum of Understanding between the City of Goleta and Peopl e Assisting the Homeless, adding $20,000 to the current not-to-exceed amount, for an amended total not-to-exceed amount of $73,250.
BACKGROUND:
People Assisting the Homeless (PATH) operates a 100 -bed homeless shelter and interim housing program at 816 Cacique Street in the Cit y of Santa Barbara . Si nce December 2019, at the request of t he City of Goleta, PATH has prov ided two beds dedicated to individuals experiencing homelessness in the City of Gole ta, including supportive case management services. The original Memorandum of Underst anding (MOU) for reservation of shelter beds (2019-134) was approved by the City Council in August 2020 and allowed for a not -to-exceed amount up to $48,359. For various reasons, the MOU agreement was not executed until December 2019. Given the MOU would expire on June 30, 2020 , and nearly half the fiscal year had passed at that point, the initial executed agreement specified that the total cost for these services was not to exceed $ 28,250. The following three amendments h ave been approved sin ce the original MOU agreement was executed:
Amendment No. 1 to the MOU was approved in June 2020, extending the term of the MOU to June 30, 2021.
Amendment No. 2 to the MOU was approved in June 2021, extending the term of the MOU to June 30, 202 2, and ad ding $25,000 i n funds, increasing the not -to- exceed amount to $53,250.
Amendment No. 3 to the MOU was approved in May 2022, extending the term of the MOU to June 30, 2023.
1 Meeting Date: December 20, 2022
Amendment No. 4 to the MOU would add $20,000 to the contract, bringing the total not- to-exceed amount to $73,250. This amount averages to approxi mately $1,700 a month over the 43-month term of the agreement.
The PATH MOU agreement essentially replaced the one the City previously had with the Salvation Army for t he provision of two beds with case man agement for homel ess persons from Goleta. Although costs for Salvation Army’s services were lower than the cost for PATH’s se rvices, the Salvation Army charged the City whether the beds were occupied or not. PATH only charges the City for nights the beds a re occupied. The additional advantage of contracting with PATH is that the organization has a much lower threshold for acceptance of clients and a greater tolerance for client problems.
DISCUSSION:
At the time the M OU was amended for the time extension (Amendment No. 1) in June 2020, most of the not-to-exceed amount had not been expended. As mentioned above, the way the MOU is structure d, the City is only charg ed when a bed is actually occupied. Given that the bed utilization rate was very low for the fi rst six months, at a rate of $66/night, staff estimated the remaining amou nt was sufficient to cover the cost for Fiscal Year 20/21 , so no additional budget was added to the MOU as part of Amendment No. 1.
As a result of the COVID-19 pandemic, the City has seen a rise in the number and size of local encampments. A little over a year ago , the City contracted with the non -profit City Net to provide outr each to homeles s individuals sleeping on the streets and in encampments. The reservation of beds at the PAT H shelter has been a key component of the City Net outreach effort in addition to r eservation of motel rooms. Table 1 b elow indicates the number of nights per month that the two Goleta beds were oc cupied and number of clients served. Thes e numbers are up c onsiderably over th e past three months. Staff believes these increases may be due to the outreach effort by City Net.
Bed nights over the past three months were more than the prior 12 months combined.

In addition to the every day outreach conducted by City N et, the reservation of beds at the PATH Shel ter provides an emergency housing option that can be offered to encampment residents should the City need to clear one.
As of the date this report was prepared, in early November, approximate ly $8,630 was available remaining on the purchase order for PATH . These funds are expected to cover the next 2 -3 months . Given spend ing has ranged from $ 3,000-$4,000 a month over the past couple months of increas ed usage, staff estimates that $20,000 will be enough to cover the remainder of the fiscal year (ending June 30, 2023).
FISCAL IMPACTS:
The current budget for FY 22/23 includes $86,750 in account number 101-60-6200- 54013 – Support to Other Ag encies – Other. Of these funds, $57,500 was set aside for miscellaneous costs and services related to homelessness. Given $28,250 of this amount was used for an amendment to the agreement with the Santa Barbara Alliance for Community Transformation (SB ACT), this lea ves $29,250 available for other uses related to homelessness. Use of $20,000 for the PATH amendment wo uld leave $9,250 available.
ALTERNATIVES:
The City Council could opt not to amend the contract for the reservation of shelter beds to add additional fu nds. If no additional funds are added to the agreement, the current purchase order amount is expected to be exhausted by the end o f January 2023 . If funding is fully expended, homeless i ndividuals fro m Goleta would not have priority entrance into the PATH shelter and may need to wait several weeks for a bed to open 3 Meeting Date: December 20, 2022
up. In addition, not contracting for beds at the PATH Shelter may make it difficult for the City to cle ar encampments on City property if the City Net reserved hotel rooms are occupied.
