BA
CKGROUND:

I
n general, the City Council acts as a whole, with all members participating equally in the consideration and deliberation of issues, and in providing direction to staff . Full Council consideration of issues also ensures maximum transparency and public participation in the deliberative process. However, there may be occasions where a complicated and/or time-consuming issue or area of focus makes it desirable for Council to form a subcommittee to consider the issue separately and develop recommendations outside of a regular Council meeting. There are two types of advisory subcommittees which Council can establish.

S
tanding committees are policy subcommittees that consist solely of less than a quorum of the Council (i.e., two members) and that either have some “continuing subject matter jurisdiction” or have a meeting schedule formally adopted by the Council. Standing committees exist to make routine and regular recommendations in an area of policy, they continue to exist as specific issues and matters are resolved, and they are part of the 1 M eeting Date: February 7, 2023

regular governing structure. Common examples are the Finance and Audit Committee and the Ordinance Committee. These committees are subject to the provisions of the Brown Act (e.g., noticed agendas, public attendance and comment).

A
d Hoc Committees are also policy subcommittees that consist solely of less than a quorum of Council and make recommendations to the full Council ; however, they differ from standing committees in that they are not intended to have continuing subject matter jurisdiction and do not have a meeting schedule formally set by the Council. Rather, these committees are created to serve a limited or single purpose. An important characteristic of ad hoc committees is that they are not perpetual; they are meant to be dissolved once that limited or single purpose has concluded. Ad hoc committees are exempt from the Brown Act’s requirements and should therefore be used carefully and in strict accordance with their limited purpose.

C
urrently, the City Council has 17 subcommittees: 11 standing committees and 6 ad hoc committees. The existing committees are as follows (the dates in parentheses indicate when the committees were formed):

S
tanding Committees
• City Hall Facilities Standing Committee (1/15/2013)
• Economic Development and Revitalization Standing Committee (8/6/2007) • Energy/Green Issues Standing Committee (10/6/2009)
• Finance and Audit Standing Committee (2/5/2007)
• Goleta Beach Park Standing Committee (1/15/2003)
• Grant Funding Review Standing Committee (4/15/2014)
• Homelessness Issues Standing Committee (3/17/2020)
• Naming Standing Committee (9/7/2010)
• Ordinance Review Standing Committee (7/16/2007)
• Public Safety & Emergency Preparedness Standing Committee (11/17/2009) • Town and Gown Standing Committee (2/20/2007)
• Solid Waste Issues Standing Committee (1/19/2010)
A
d Hoc Subcommittees
• Fire Station Development Ad Hoc Committee (2/2/2010)
• Library Ad Hoc Committee (9/1/2009)
• Ad Hoc Revenue Neutrality Agreement Committee (1/15/2013) • Santa Barbara Airport Support Property Development Review Committee (11/17/2014)
• Goleta Valley Community Center Committee (2/19/2019)
• Diversity, Equity and Inclusion Plan Committee (10/6/2020) I
t is important to occasionally revisit the need for committees and to make adjustments as appropriate. At the Council meeting of January 17, 2023, staff reported that it was time to reach out to all of our regional partners and to also review the establishing resolutions for the various Council subcommittees (standing and ad hoc) to determine whether the need for all of these assignments persists or whether other assignments and/or committees should be dissolved or discontinued.

Also included in this report is a request by Mayor Perotte, concurred by Councilmember Kasdin, to place an item on the next agenda to reconsider membership of the City Council appointments to the Economic Development and Revitalization Standing Committee.

DISCUSSION:

Dissolution of Certain Committees
Since the January 17 th Council meeting, staff has reached out to liaisons for regional, standing and ad hoc committees to confirm the need for these appointments. Council is being asked to review staff’s recommendations related to the following committees:

Standing Committees:

City Hall Facilities Standing Committee
Current Appointment – Mayor Perotte and Councilmember Kasdin Staff Recommends: Dissolve. This co mmittee was est ablished in 2014 to advis e staff on use of the current City Hall facility and to assist in the search for a new permanent City Hall. Now that the City has purchased City Hall and occupies all four suites in the building, staff believe this policy issue no longer carries the level of complication it once did, and a specific standing committee is no longer needed. While there may still be policy issues to discuss related to City Hall (e.g., the use of the triangle property next door), these can be addressed through regular C ouncil channels as t hey ar e with other C ity f acilities and properties. Staff ant icipate bringing policy decisions on facilities -related issues t o other standing committees such as t he Finance Committee and the Energy/Green Issues Committee, and to the full Council through regular meetings and capital project forums.

Staff also reviewed the purposes of the following ad hoc committees, how long they have been in existence and the frequency with which they have met, and whether their limited tasks have been completed. As mentioned earlier, because of their Brown Act exemption, it is particularly important to scrutinize these subcommittees. Based on these factors, staff recommends the following:

Ad Hoc Committees:

Santa Barbara Airport Support Property Development Review Committee Current Appointment: Councilmember Kyriaco and Mayor Pro Tempore Richards Staff Recommends: Dissolve. The City
of Santa Barbara owns certain property (“airport
support pr operty”) between Hollister Ave nue and t he 101 Freeway, w hich it has historically managed in support of airport operations. In 2014, this committee was formed after S anta Barbara sold a pi ece of pr operty to Direct R elief I nternational f or t he development of a new facility, with the limited purpose to gain a better under standing of the airport support property and to report its findings to the City Council. Staff and Council now have a better understanding of t hese issues and staff monitor development to alert Council should an issue arise. G iven the time since this l imited purpose committee was established and that i t has not m et i n years, st aff bel ieve t he ad hoc co mmittee is appropriate for dissolution.

Library Ad Hoc Committee
Current Appointment – Councilmembers Kasdin and Reyes-Martín Staff Recommends: Dissolve. This committee was formed in 2009, when the City of Santa Barbara managed the Goleta Valley Library (GVL) on behalf of the County of Santa Barbara, and the City of Goleta only provided the building and some additional supplementary funding. It was formed because Council was concerned that the funding provided by the County via its per capita allowance and through Measure L tax revenues was insufficient to meet operational needs at the Library and Council wished to work with the County to identify additional funding. Since then, the City has assumed management responsibility for the GVL (July 2018), however, Library funding from the County remains an ongoing problem. The growth in the County per capita funding for libraries countywide has not kept up with operational costs and the City has had to put more General Fund revenues in eac
h year to support operations of this regional main library, which is open to all County residents. There have also recently been various new proposals to move what County funding the GVL has historically received away from the GVL to specialty services in uninc orporated areas of the County (Isla Vista Bookvan) or to other jurisdictions (City of Santa B arbara Li brary representativ es have pr oposed to rec eive Hope Ranch per capita historically allocated to GVL). Staff recommend dissolving the ad hoc committee, as Library funding is an ongoing issue exceeding the initial limited intent of the ad hoc committee. Staff will work with our Library Advisory Commission and the full Council on funding issues and, if necessary, staff will r eturn to Council with a recommendation to form a standing committee with “continuing s ubject matter jurisdic tion” over issues related to Library Funding, as appropriate under the Brown Act.

Goleta Valley Community Center Committee
Current Appointment – Councilmembers Reyes-Martín and Kyriaco Staff Recommends: Dissolve after Council adopts a Goleta Community Center Strategic Plan. This committee was created in February 2019 to understand the community’s desires for programming and uses at the Community Center and how the Center can best serve these needs; to discuss what types of programming ar e appropriate and what the best management structure would be; to consider whether the GCC should simply be a place for other programs to oper
ate or is there an interest in a management structure that directs and incorporates specific programming based on the community’s needs; and to discuss what elem ents should be included in a r equest for proposals (RFP) for management at the Center in the future. After an extensive public input proc ess, the Ad Hoc Committee recommended, and Council appr oved, the City assuming direct management of the Community Center, which occur red in January 2023. Council also referred the creation of a Goleta Strategic Plan to the Ad Hoc Committee, which will inform the future management and possible RFP for
the management of operations at the
Community Center, consistent with the ad hoc committee’s initial limited purpose. Once the Strategic Plan has been adopted by the City Council, which staff anticipate will occur this fiscal year , staff believe that it will be appropriate to dissolve this limited-p urpose committee. Council may wish to cr eate a standing c ommittee with “continuing subject matter jurisdiction” over issues related to the Community Center in the future, consistent with Brown Act Requirements.

Consideration for Future Elimination

Staff have identified several other committee appointments that may be appropriate for elimination in the future. After consideration and consultation with the Mayor and the Mayor Pro Tempore, these are not recommended for elimination at this time.

Regional Committees:

Liaison to Goleta Valley Community Center Board of Directors Current Appointment – Councilmember Kyriaco
Staff Recommends: No change. Until recently, the Goleta Valley Community Center (GVCC), an independent non-profit organization, managed the City’s Community Center in Old Town. City Council currently provides a non- voting appointee to the GVCC Board of Directors. With the City assuming direct management of the Goleta Community Center in January 2023, the relationship with the GVCC organization has changed. However, given the GVCC’s core mission to support the Goleta Community Center, it may still be helpful to both organizations for Council to have an appointed liaison. Staff have reached out to the GVCC President to clarify the continuing relationship, and for now recommend no change. However, staff will return to Council if the GVCC requests a change.

Goleta Beach Park Standing Committee
Current Appointment – Mayor Pro Tempore Richards and Councilmember Kasdin Staff Recommends: Consider future dissolution. This committee was formed in 2013 out of concern about beach erosion and County budget limitations to ensure recreational access to Goleta Beach for Goleta residents. The City has no jurisdiction over Goleta Beach, and the County has been active in its management of the park and efforts to address erosion and recreational access. The committee has not met for several years.

Staff feel that individual advocacy by Councilmembers and staff with the County has been very effective in addressing issues that arise. Staff do not believe the level of activity and complexity of this issue warrant a separate standing committee in perpetuity. However, given the recent deposition of flood- related material at Goleta Beach, after consultation with the Mayor and Mayor Pro Tempore, the committee is not recommended for elimination at this time.

Ad Hoc Revenue Neutrality Agreement Committee
Current Appointment – Mayor Perotte and Councilmembers Kasdin Staff Recommends: Consider for future dissolution. In 2013 Council discussed the need for a n ad hoc Council Committee to work with staff to identify opportunities for the renegotiation of the City’s Revenue Neutrality Agreement (RNA) with the County of Santa Barbara. At the time, it was anticipated that this would be a limited duration committee during the negotiations, until final recommendations about revisions to the RNA had been presented to Council . H owever, efforts at engaging in renegotiation have not been successful. The committee has not met in some time, but Mayor has indicated the desire for the committee to meet again prior to consideration of dissolution. Staff will continue to only bring issues to this ad hoc committee that are consistent with its initial limited purpose, and will bring other issues to the full Council, as appropriate. S taff and the committee may recommend that Council consider dissolving the ad hoc committee and forming a standing committee with “continuing subject matter jurisdiction” more broadly over issues related to the RNA, as appropriate under the Brown Act. 5 Meeting Date: February 7, 2023

Reconsideration of Economic Development and Revitalization Standing Committ ee Appointment

On January 17, 2023, staff brought before the City Council the Selection of City Council Representatives to Regional Agencies and City Council Subcommittees.

Councilmembers Kyriaco and Reyes -Martín were appointed by majority vote to the Economic Development and Revitalization Standing Committee. Mayor Perotte with the concurrence of Councilmember Kasdin has requested that staff place an item on the City Council agenda to consider changing the appointments.

Council is asked to e ither to reaffirm the City Council appointments to the Economic Development and Revitalization Standing Committee (through vote or taking no action),or change the appointments by (1) removing either or both Councilmembers Kyriaco and/or Councilmember Reyes-Martín and (2) making a new appointment(s) to that Committee.

Procedurally, if the Council desires to remove one or both councilmembers and make new appointments, they should be done in two separate motions and votes so that the record is clear that a vacancy was created.

FISCAL IMPACTS:

There is no fiscal impact associated with this item.

ALTERNATIVES:

Council could decline to dissolve any of the above committees, or request that other committees be dissolved. Council could direct staff to return with actions necessary to create standing committees to replace any of the ad hoc committees recommended for dissolution, to be consistent with Brown Act requirements. Otherwise, staff will return with recommendations to create such committees should they be needed in the future.
